I was on a jury for a DUI case. After they showed us the videos, we decided he was not drunk. He refused the breathalyzer, so he lost his license for a year, but no DUI on his record.

I like telling people that it’s possible to get a DUI when you blow 0.00 just to start an argument. It’s only natural that we assume alcohol is involved. But it could be illegal drugs, or even prescription medication that’s causing the issue and it doesn’t register.

I registered a 0.03% It was 4th of July and by the time a nurse came to take my BAC.. the level dropped to that point. Three weeks later I got a letter from the D.A. saying they were dropping all the charges against me and I didn't need to appear in court. And I haven't driven drunk since. Its not worth it. Just stay home, or now. Uber or Lift!!!

The breathalyzer doesn't detect drugs. So the field tests are necessary. Everyone loses their license after a DUI. Pay the fine and take classes to get it reinstated. Depending on the state, jail time is mandatory after a certain number accumulated.

Daz is correct. Generally, though I’m sure each state is different, if you pass the FST, you are not given the breathalyzer.

Correct. I got pulled over with no plates on my car (I had just bought it in a private transaction earlier that day and was in the process of bringing it home), and the officer told me that for whatever reason, he believed I was under the influence of drugs or alcohol. He ran me through the tests, which I gladly consented to perform because I knew I was sober. I passed, and he let me go with just a warning to register the vehicle ASAP.

I knew a girl who had multiple DUI's to the point that should could only legally drive to work and back. She then got another DUI and was no longer allowed to even drive to work. She would get dropped off to work every morning, then picked up in the evening

My nabour growing up was this old man and he would pay me to drive him every where calls they took his license for life calls of dui's. he even have a court ordered breathalyzer on his ignition but he got caught drinking and driving again any way, he was using a bicycle tire tube to blow air in the breathalyzer to start the car. Dude said they took his license calls he out smarted them and they were pissed.

They still do the tests and breathalyzer to have more evidence against you in court. They get it all on video of you failing. You should always just keep your mouth just and decline the tests. By the time they do a blood test, you’ll have sobered up some. Of course it’s way better just not to drink and drive😂

I've been pulled over while pissed. Horrible decision btw. But I passed the field test with no issues. As long as you have some athleticism you should be ok. This was in my early 20s. Don't drink and drive lads!

By having the suspect perform the sobriety tests, they eliminate at least some of the subject nature of determining if a person is legally too drunk to drive. These tests are standardized for law enforcement nationwide. Field breath tests are also used. These measures help build a case against the alleged dui suspect.

SFST, Standardized Field Sobriety Test is set by the FEDs. In the US, it provides "probable cause for arrest'. But many states have lesser charges. In the US, you don't technically 'pass' or 'fail' a SFST. It just gives the officer 'clues' as to whether the individual is capable of driving safely. Arrests may or may not occur. In some states, you are required, when asked, to take the test or automatically get charged with DUI/DWI/whatever you call it and will automatically lose their license. (possible jail, fines, etc.) It would be nice if the states and the feds re-evaluated the SFST and went with the breathalyzer or blood test.

The tape tells the tale in court..If that was a dude the cop would've slammed him into the car...What kind of world do we live in where somebody thinks they can just pull over and walk away... It's beyond entitled it's sheer ignororance... Technically once you're cuffed and in the backseat you don't have to consent to feild sobriety tests it's a trap 🤘✌️🧐

Here in the states, at least in Kentucky, if cops think you are under the influence but you pass a sobriety test, they will sit you on a sidewalk and basically watch you sober up before they let you go

I'm not a fan of drunk drivers, but when the chick heard she could keep her mouth shut, that includes providing evidence that could be used against her. The full constitution kicks in as soon as it becomes a criminal investigation.

Lenient? No. It's them building a case, nothing more. I spent the night in jail and got a DUI charge. Failed DUI test because my "eyes weren't following accurately enough" to the pen he was waving back and forth while he shined his torch in my face. Then got to the station and blew well under the legal limit. Still spent the night in jail, still dealt with court. All because of a dim tail light.

DUI laws vary state by state as do most laws. It's usually a fine with the possibility of getting points that if you get too many you can lose your license. In PA if you're a certain percentage over the legal limit you can lose your license automatically for a period of time. And/or you have to have a breathalyzer installed in your vehicle that you have to breathe into for it to start. In some cases, you can pay to get a temporary work permit to drive back and forth from your job if you lose your license.

I believe they do the test to as document that they are over the legal limit. The person could be reacting to a medication or something else.

The fines and costs are huge the more they continue. If you have a job where you need to maintain an air of responsibility, and keep transportation and insurance, but you still drive your cars off the road, it can cost a lot. i think you can pay the state a $50,000 bond as your insurance , but I don’t know how often lol. I knew a guy doing that but he wasn’t giving up his um hobbies.

I don't know why their first go-to is a field sobriety. As to your conversation about and after that though, you can do time after so many of them. An ex from my youth got 12 months in county jail after his 3rd DUI. He did all but about 2 or 3 weeks of that 12 months too.

Daz is somewhat right on sobriety test but there's several other reasons the main 2 though are that the breathalyzer only tests for alcohol so if someone passes it but is clearly completely messed up/high on something (for instance bars which really mess you up even with a little alcohol) the cops will have to make them take the sobriety test anywayn plus the sobriety test is easy to fail and fairly subjective so its kind of a sure thing that if you take one and the cop wants to then you're going to go to jail. You also pretty much automatically go to jail if you refuse to do the field sobriety test so its basically a win win for the cops. Most lawyers even say to not take the sobriety test even if you're sober and instead just spend the night in jail and when you get to the jail you either have to do a different high end breathalyzer or you can be forced to do a blood draw and either way that will get used in court either to your advantage or against you. It all seems stupid to do it that way but its the smart way to do it for the cops because again its a win win. You really have no idea how stupid our legal system is until you've gone through it. I blew half the legal limit once and stupidly took the field sobriety test and the cop flat out lied on the police report and said I failed a bunch of stuff but I didn't and they lied about a bunch of other stuff too but its a long story. Best advice to anyone reading this is don't be a dick to cops but don't tell them shit, up until that point in my life I had plenty of good experiences with cops and having many in my family I always respected cops then at 18 or 19 within a 2 week period I got arrest 2 times on complete BS charges and was cool with the cops yet as soon as they realised I wasn't going to snitch they treated me like shit and blatantly lied on all the police reports. Plus both instances happened because of literally the worst timing possible, to this day its like I won a haunted F U lottery ticket. Since then I've had nothing but good experiences with cops though so its just a gamble but don't fight or argue with them regardless of how they act, just know your actual rights AND responsibilities when interacting with cops (including little known stuff like the fact that you HAVE to step out of the car when the cop asks) then just fight it all in court if it comes to that and its a lot easier when you handle yourself professionally.

Before you can give them the breathalyzer you have to have probable cause. That is the reason for the field sobriety test.

The penalty for dui is decided by the state that the infraction occurred. The cops don't convict you. A court of law does. Cops gather evidence to support the criminal charges. Hence the field sobriety tests. Lawyers seek to dismiss evidence,question the integrity of officers etc. A fine based on the totality of taxpayer money wasted would violate the us constitution, a law seeking to do that would have to be very carefully crafted.

8:52 It's so they can prosecute you with more evidence. Was the breathalyzer properly calibrated before use? No? If that's the only thing you got, the defense is gonna have a field day. However, Standardized Sobriety Tests are designed to make you fail (EVEN IF YOU ARE SOBER). I would NEVER do them. You are going to jail anyways and are only giving the prosecutors more evidence against you. (Disclaimer: I am not a lawyer. This is not legal advice, it is just what I would do.)

I don't think taking a field sobriety test is in anyone's best interest, besides for the police. Like any type of inspection, if you look hard enough you can find a reason to fail someone. All you're doing is providing more evidence. I'd be curious if there are any stories where it actually helped someone, because I've never heard them.

Here in Wisconsin (where a lot of these police cam channels are based out of) you can literally have like 10 DUI's.. it's quite common to read of someone with their offense well above at least 6. In most other states, u'd lose your license for life.. but here.. nah it's a slap on the wrist. Most beer is brew'd here. Our baseball team is called the Brewers.. Alcohol is king here. While most states legalized marijuana, we've had the tavern league fight it tooth and nail to not allow it here.. cuz alcohol is king. Hell.. it's so bad... that during Covid... most of our Bars (taverns) we literally have them on every street corner. Were losing so much $... the temporarily legalized DRIVE THRU ALCOHOL SALES! Now.. ask yourself... How often... have you gone to McDonalds ordered a burger n fries (chips) and waited the whole time to eat those fries, before u got home?? I know i never have... SO WHAT IN GODS NAME DO YOU THINK is going to stop someone who loves alcohol from consuming that drink, BEFORE THEY GET HOME...? It was the recipe for drunk driving, the only upside was there werent a lot of people out on the roads at that time.. But still.. Pure genius from our politicians allowing that. But yet.. "we have to think of the children.. we cant legalize marijuana! THINK OF THE CHILDREN!" ... but F them children when it comes to drunk driving. Let that gigachad over there take them out as he drives drunk home. Logic, we dont need it! That's for educated people!

You should read WI OWI laws before talking about it, 4th OWI is felony with mandatory jail time (60 days to 6 years) and depending when was your previous one it could double fines and jail time, 5th is 6 months to 10 years...

This always amazes me. I don't know how many times as a young drunk knuckle head, me and my buddies got pulled over coming back from a party. We always did exactly as we were told. Cop asks.. Have you guys been drinking. And our response was always.. Yup..we sure have. We were just straight and honest with them, and they would let us go because of our honesty and the fact that we just young idiots with clean records. Well, some of us. Never fight a cop or argue because its not going to end well. You just want to do what you are told and be respectful. Cops don't want to arrest people unless they have to especially for what is really a traffic violation. Because then they have to take you in, book you and fill out a incident report and all that. The last time I did drink drive, back in my mid 20's some 20 or so years ago. I got arrested. And all I heard from all the cops was.. Is this your first DUI.. I was like yeah. Well don't worry its just a slap on the wrist and you will have to pay a fine. Then they did go on to say that they could be booking me in for homicide, getting plastered and then driving, is it worth it. And it wasn't and that was the last time I drove drunk, because they were right, I could have ended innocent people's lives just because I want to have a good time somewhere.
