Plaintiff should have gotten some money for the work his team did, though he did a few things incorrectly-- mainly setting improbable expectations. You NEVER guarantee a lush/full lawn after one seeding application. That takes years to achieve, unless you're going to lay sod (even then, it's not 100% foolproof). He should have proposed a few lime applications to raise the soil pH (counteract the acidity), provided a plan of care with watering/fert schedules, & actually hydroseeded, IN ADDITION to aerating/overseeding. Source: I did similar work for about 7 years in that area of the US.

I can see how the plaintiff thought the defendant would never be satisfied. He did some stuff- he should have gotten half.

I moved to the mountains and am surrounded by pines. I never thought about it but there is never grass anywhere near them. Acidic soil makes sense actually.

It seems the plaintiff only explained the lack of fertilization and how pine tree needles makes growth impossible in court, but to never to the defendant. He's meant to be paid for results, not an flimsy attempt. It was only when the defendant demanded results, the landscaper gave up. So many tradies just fake it till they get that final payment. Always pay after you see the final top quality product.

Watching this in 2022 and seeing the guy with the two popped collars behind the plaintiff and remembering when it was a thing to pop as many collars as possible. 😂

I don’t understand how a LANDSCAPER from MA doesn’t know that grass won’t grow under a pine needles tree, if you park your car under one you will understand what I’m saying.

Defendant wasn’t going to pay the landscapers until he saw grass not only growing but full. That’s not appropriate and I can see why after the communication with him- the landscaper believed he would never be paid and therefore left.

Once again I don’t understand her ruling? I agree with the plaintiff for working off the job. When the defendant said he wasn’t paying until he’s totally satisfied, thats like saying no matter what he’s not paying. Instead of saying until the job is completed he said, until I’m totally satisfied. At the end of the day when you look for imperfection, you will always find something. Which would’ve gave the defendant an out!

Of course you don’t wait until everything is growing and blooming and the grass is green the NEXT SEASON!!!! You pay when he is done. And if it doesn’t grow the next year, you go back to the gardener. Just like other things that stop working over time. The defendant could have done all sorts of things that caused the bad result. But everyone has to pay immediately after the work is finished. (IF all the work is done that’s stated in the contract) And here is a thing that I see a lot in these Court Shows: If you don’t think that whatever the customer wants to have done is possible (or will work out): then DON’T do it. Don’t come to Court later saying that you told the customer that, BUT that the customer insisted on it, so you did it anyway. Have the guts to say: “No. I will not do/sell this.”

Shade seed is iffy. For 4 years it has only worked a little. I just accept the yard as is and happy to have shady spots on hot summer days

People do neglect their lawns I used to mow over two acre lawns in s.c and people used to let it get knee high or sun burnt during dry season. Mayb they should get actual experts during cases like these

Grass will NEVER grow in an area under pine trees, so the defendant would NEVER have been satisfied, so the plaintiff got off lightly...

The defendant and his smug smile the whole time is irritating. He knew he was never going to pay up, because unless the defendant was going to do his part, it could take weeks before the grass starts to grow and then you need to care for it and it might be another year before it starts to look like a lawn which could take a year, at which point the defendant would have said 'see, it still isn't growing' and still never pay him...

Yes Pine trees produce shade, ALL Year because they are Evergreen...BUT Pine trees are very acidic, and is almost impossible to get any type of grass to grow where Pine Trees *Shade*/Shed needles, producing Acidic acid on the ground about 50 to 90% of the time. I feel the Landscaper shouldn't have taken on this job knowing that or explained in GREAT Detail, that it's a losing battle to have green grass near and especially under pine trees.

The judge made up a scenario that they say didn't happen and that's what she based her ruling on,bs!

Defendant tried to get paid double.. he also was trying to use the old sucker move where you just keep doing more work over what your suppose to do and he keeps on not being satisfied that was his game plan.

I had pine trees around a house I use own and those things kill every thing around them.

So he did all that work and bent over backwards to help him and didn’t paid for any of it. Wow. Their contract doesn’t state you pay me when your certified, it says I’ll do this and you pay me. Period. You don’t have a tooth removed and then tell the dentist I’m not satisfied because there’s a hole in my gums so I’m not paying you. You pay for work done, I think the judge was wrong which happens very little but still happens.

Plaintiff should have told the defendant right from the get go that grass will not grow right under pines.

People can't even finish what they're saying after a question. I'd just tell her look, either don't ask the question or after asking answer it as well and I'll stay quiet. Fucking ridiculous

H**l will freeze with all those pine trees......that lawn will NEVER grow.. (MY mum's friend's hubby spent decades trying to grow grass under the pine trees at theri cottage......it never worked. The pine needles make the soil too acid and there's too much shade.)

Interesting case. They both have good arguments. Defendant deserved to get what he paid for and plaintiff deserved to get paid. In the end I think the plaintiff should be glad this is over and he can wash his hands of this defendant. Won't pay until he's totally satisfied? Sounds good on paper but; Not paying yet, grass isn't thick enough or green enough, I'm going to hold final payment. Wait, I got a grub or mole infestation and the lawn is all dead and spotty. Come fix it or I won't be totally satisfied. Unusually hot dry summer and grass is dead? Come fix it or I won't be totally satisfied. Lather, rinse, repeat. I get the vibe that this defendant never had any intention to pay that final $1000.- and was going to make the plaintiff jump through hoops expecting to finally get that money,

Ok this landscaper took a guess at it, what he should of did was get the soil tested and it would of told him what it’s missing to grow grass and boom he would of had his lush grass never guess because this happens all the time

The plaintiff didnt honor the terms of the contract. He shouldn't have guaranteed that grass would grow, only that he would plant and treat. Re the defendant, Re the defendant 'I'm not going to pay until I'm satisfied' really doesn't really mean anything

I think that was a wrong verdict. He did all that work and got minimal payment. When he went back to do the 3 things once again to try to get the grass to grow, the guy Def wasn't going to pay him, he wasn't ever going to be satisfied. I think the plaintiff is probably correct. The pine needles made it hard for grass to grow. It likely takes something special to make it grow, because some dirt and areas are different than others. He has probably never had grass.

The defendant seems like a guy that once he pays for something he thinks it should stay perfect without any effort on his part. It was obviously an issue before. I believe he didn’t go above and beyond for that part of his lawn and thought doing the minimal that he does everywhere else would suffice.

The judge got it wrong about it being $1000 to each, when in fact the defendant had two estimates, one for $370 to sow the seed and another for $630 to fertilize the ground, whereas the defendant had refused to do any fertilizing so that means that should never have been taken into consideration, therefore the defendant should have had to pay the plaintiff $630...

I think the defendant is a scam artist. How many times does the landscaper need to show up just to make his measly 1k🤦🏾‍♀️ i have a feeling the defendant will be in court again because he's unreasonable.

The judge’s attitude is ridiculous in 99% of these episodes. It’s sad cuz I really used to like her a lot. Hope she’s not like this at home but I have a feeling she is lol.

I think that he DID neglect his lawn. When it was brought up he tried to say he had an irrigation system.....ok that is the first clue that a person doesn't understand how grass/plants grow. You don't just turn the water on and think that is going to fix it. In a large yard there could be multiple zones that require differing water requirements, types of fertilizer, etc. A blanket fix is never the right answer. Spent time, not money, on your yard and you will be far better off.

The ruling is easy, the plaintiff enacted a new contract stating that he would come back to do the job that the defendant wanted then get the $1000, which means he agreed to a settlement, but he broke it by just suing and not doing the work. Usually, the plaintiff would win if his argument was that the defendant refused to pay until the grass is green. However, he never did the work that would make the grass green because his machine wasn't working.

25 years ago I had a customer contract with me for landscape work worth 4800$ when we finished he said I had a great crew , worked hard and did a fantastic job , he wanted to refer me to his friends , when he cut me a check he made it out for 700$ which didn't even cover the cost of his supplies ,I asked for the 4100$ he owed me he says no we haggled I said no we have a contract n this doesn't cover labor n supplies you need to come up w 4100_ he says no sometimes you get burned I'm like say that again I work hard for my money yr not burning me we argue so pissed off I go to my truck pour some gas into a bottle go back ask for my money he says yr getting burned I said this is america I work hard for my money let me teach you about burning people I threw the gas on his legs and lit him on fire ,🙄we settled in court I owed him he owed me bet he never does that again
