In a scary but not so shocking turn of events, conservatives are now trying to ban drag. Unfortunately their definition of drag includes everyone who isn't cis. As a trans guy who is also a fan of drag, I'm not stoked!

K, so, I just read the AZ bill, and oh. My. God. Anyone who uses makeup or clothes “opposite their gender at birth that exaggerates gender signifiers” and performs is a drag performer. The problem when you try to make this a law? WHAT IS THE STANDARD FOR “EXAGGERATION” THAT THEY WANT LAW ENFORCEMENT TO LOOK FOR?? What size breasts, what height hair, how much glittery eyeshadow can a trans woman have while doing Karaoke at Sunday brunch before they get fucking arrested??

This is my home state, and we had a couple of openly gay trans boys in my old neighborhood, Alex and Shadow I believe, only a few years younger than me. I fear one day they'll get caught while walking to the store, or riding their bikes to school. I also fear of myself, my previous coworker who was a trans man, and for my friend who is nonbinary and dresses like an 80s glam rocker on their days off from work. This bill awfully reminds me of anti trans bills from the years of Stonewall, where one couldn't wear more than 1 article of clothing from the "opposite sex". Kinda weird history is repeating itself, I hope to get my claws on some T to get myself looking like Orlanda Bloom in 2004 soon enough.

Unfortunately, that's not that out of the question given the fact that the three-article rule already existed and was enforced back in the 40s-60s. Yet the three-article rule didn't have direct code written about it and was instead a social understanding that police officers could arrest folks for homosexuality if the person was not following it. Even with arrests not being extremely common under that concept, the use of it to humiliate/harass people via strip searches and the safety the idea provided to inflict violence on queer people was very real. These bills feel like they're trying to bring that idea back but make it the literal law of the land. If these bills are passed, they will be enforced whether it be through actual "investigations" and arrests or simply by using them as shields to hide behind when enacting violence and oppression.

What is the difference between a drag show and a minstrel show? Both shows are meant to make fun of groups of people based on negative stereotypes. For example, most drag queens embody the stereotype of the seductress which promotes the idea all women are sluts. This in turn has encouraged many men to be sexually aggressive. As someone who is afab themselves, this causes problems for people who are afab. And no, this does not apply to transgender people. It would require that that: 1. You can't find a half-decent lawyer to find a loophole in the garbled mess of the first paragraph. I know money is often tight for transgender people but the government is required by the Constitution to give a defendant a lawyer if the defendant can not afford one. At that point, the defendant can direct their lawyer to the first paragraph. 2. It requires an audience that is there for the purpose of being entertained. So, humming in the car or singing in the shower would not count as the person is not doing so to entertain an audience. 3. It must be done to cause sexual arousal which would exclude almost all karaoke singers. Unless you are well-known for your vocal skills, you are not sexually arousing anybody. 4. This video is clickbait. Note how many times he says conservatives/Republicans (the fact that he uses those words interchangeably shows that he doesn't know what those words mean and is just looking to sow division). Beware of opinion pieces like this from any political party and be willing to hear the whole story. That's all I have to say for now.
@thetruthseeker4771
@thetruthseeker4771 Год назад
5. I forgot. It only applies to performers doing a performance so those complaining that this law bans them from singing/humming to themselves are implying that their gender identity/expression is just a performance... Yikes. Needless to say you are not going to get any respect from others with freudian slips like that. That is like Mulhaney saying "Day One" of being a "girl" occurred as an adult with too much makeup and a slutty outfit on in front of a camera. Mulhaney then went on to complain that woman were too emotional. Now Mulhaney is held up as the pinnacle transgender womanhood by conservative RU-vid channels. Don't be a Mulhaney.
@jsk-art

@@thetruthseeker4771 There's a big difference between a drag show and a minstrel show. Drag shows and crossdressing as a whole, for most people who do it, is expressing their feminine side. Yes, this often comes with a persona they play, but so does pretty much every other form of performance. Comedians will put on an exaggerated persona, youtubers will do the same, actors, and don't forget pageants. Minstrel shows were done not out of any relatability to POC but out of hatred and bigotry. 1: You shouldn't have to find a lawyer for a law inherently targeted at queer people. The law shouldn't even exist to begin with. Not to mention, just because you're assigned a lawyer, doesn't mean they're a good lawyer. 2: Except an audience is defined as "2 or more people," and it doesn't matter if it's paid or free. This means if, say, a small group of friends got together for a picnic and shared some poetry with one another, and one of them was trans or crossdressing, they would be breaking the law. Public space. Audience of 2 or more people. 3: Have you heard of the "trans panic" defense? Basically when someone is so startled when they learn someone's trans (usually in a sexual or romantic setting) they hurt and/or kill the trans person. I imagine the same leaps in logic would be made in the case of this bill. Someone gets aroused or attracted to a person (not because the performance is sexual, just because of how the person looks) and gets pissed and insecure about it. Not to mention plenty of people think just any man in a dress (no matter how much or little it covers) is inherently sexual. 4: No, you're just underestimating or brushing off the likelihood this law can and will be abused. And the fact that it's a stupid law to begin with. Wouldn't any public indecency law in place already cover this? 5: No. Because this law defines drag based in how you dress vs your assigned sex. It's not people implying their gender identity as a performance, it's pointing out that this law WOULD define their gender identity/expression as a performance in a lot of settings, even without them actually being in drag, and even though gender identity is NOT a performance. This law does not go by "clothes/expression opposite to your GENDER IDENTITY" it defines drag as wearing clothes opposite to your assigned sex. This means that any trans person who wears clothing matching their GENDER would be considered dressing in drag. It never says the focus of the performance has to be the drag, but simply that anyone "dressed in drag" as defined by that law, and is also performing, is putting on a drag performance.

Then I'm in violation of the law? For dancing in public in jeans and a t-shirt? A priest wearing a cassock singing in church would also be a "drag performance". It's worth pointing out that inappropriate drag would most likely already be banned under a number of other categories listed there (i.e. live entertainment or cabaret). Literally the ONLY reason drag specifically needs to be mentioned if you want to essentially ban all drag. And you can't even say conservatives are regressing into the past, because male performers wearing women's clothes was very common in the past. And apparently trans men wearing drag would be perfectly fine... I'd love to see a conservative try to argue that should be banned too.

What annoys me is that not only does this potentially stop trans people from being able to sing 'I'm sexy and I know it' on kareoke, it also creates a legal avenue for trans people to be banned from being performers in general. If any trans people wanted to become singers like Britney Spears and this bill existed in law, they could very easily be barred from doing so. It would no longer be a theoretical barrier of banning trans people from media like we have now, it would be a law people could rely upon. :/ Edit: For those still concerned about Arkansas a passed ammendment has removed any references to drag, therefore making it a bill against public nudity. Something that is already illegal I'm pretty sure. So even if it does pass it doesn't do anything drastic anymore. This ammendment basically renders the bill kinda useless so I really doubt it will pass.

It gets even worse. Some of these bills (like the one in West Virginia) are worded in such a way that would criminalize not just performances, but the mere appearance in public of people not dressed in the manner of their AGAB classing it as "transvestite and/or transgender exposure." It classes "cross-dressing" as "obscene" and proposes to impose no less than $1,000 in fines and up to 6 months in prison. U.S. States are literally trying to bring back gendered clothing laws. If you look at the text of many of these "anti-drag" bills they use language that would make it very easy to enforce against anyone simply existing in clothing not traditionally associated with their AGAB.

It's much more extreme than no drag or trans people at pride, it's bordering on gender nonconforming people not being allowed in public. The law makes it sound like it's only a problem if you're "performing" but since it sounds like they didn't specify it being the performance for work/monetary gain and their description of performance is so vague, it's clear they've left open the door to interpret random citizens existing in public as "performing" and therefore able to be arrested. Wouldn't surprise me if the people crafting these laws are using the term "performance" specifically with the intention of turning the progressive idea that gender is a performance against us. That's one reason I don't like that definition of gender, I'm not "performing" for an audience, I'm doing what makes me comfortable, and I would still be doing it even if there wasn't a single other human left alive to observe me. I understand how that conceptualization of gender came about, but I think it's a harmful tool to put in the hands of people outside the community, because it gives the impression that living as a nonconforming person is *NOT* just who you are, instead it's an action taken intentionally and therefore open to societal scrutiny. *edited because proofreading grammar on mobile is hard

@butasimpleidiotwizard
@butasimpleidiotwizard Год назад
It goes both ways though, gender conforming cisgender people choose to perform gender signifiers associated with their assigned gender because that is how they wish to be perceived. When you say a doctor performs surgery you don't mean that they pretend to do surgery in front of an audience, you just mean they do a surgery, that's kind of what performing gender is about. It's not a costume you put on to pretend, but it is a social performance in the sense that you choose various characteristics and styles and traits to show to others that present you in the way you wish to be viewed, which is typically the way you view yourself but not always, eg. a closeted trans person presenting as their assigned gender. Even alone you are performing for an audience, that audience is yourself and all of the socialisation you've absorbed, all the social rules and cultural associations and visual language and the meanings of all of the symbols and signifiers, if you genuinely never saw another soul again then eventually that visual communication would lose against practicality, because without other people reinforcing those rules and symbols they would cease to mean anything to you. You would no longer see wearing x article of clothing as conflicting with your gender identity because without anyone around to reinforce those gender roles, it wouldn't. It's just fabric, it keeps the sun off you and helps you stay cool or warm depending on the weather, maybe you enjoy looking at the pattern, it wouldn't matter what gender it was originally meant for because if you were the only human only your gender would even exist. All that would matter would be how the clothing served you. The reason performing your gender makes you comfortable is because it communicates physically what you know about yourself internally, it allows people to see who you are on a surface level and that reinforces your understanding of yourself, you don't feel inadequate or like you need to change because who you see looking at you from the mirror is a person who looks like all the things that you are, and that's incredibly validating. In a different culture though you would be using different signifiers to present the same facts about yourself, you only like the ones you use because they're what you grew up with. It's like it's your first language almost, only it's visual and behavioural, rather than verbal. I don't mean that you grew up presenting with the same signifiers that you currently use, to be clear, I mean you grew up with the "language" they belong to, kind of like how you know the words that apply to all genders even though most people only identify as one. You knew what those symbols meant before you use them, you chose them for their meaning.

On one hand, maliciously complying with the law could be useful (what if one of their female senators wears pants?? sue!), but it's horrifying that you'd need to do it at all. Watching this from an Eastern European country where a now-large conservative party influences our politics and imports talking points from Russia or the Republicans (we can say they're the same thing), it is doubly horrifying that this is also what our future will be. I live in Eugene where the big riot about drag story time happened. That event had been happening for several months with no issue at all. The only reason Old Nicks was under fire was because some old republican across the county saw drag queens and kids next to each other. The main issue was that they were allowing a younger person perform, even though the event was for young people. Because cis people like to sexualize children AND drag queens, they thought it was some grooming bs. Rather than a kid having fun. Old nicks does have 21+ drag as well, but those people wouldn’t know that there’s a difference because they only see what they want to see. So yes. I agree that the Right like to rile people up and essentially turn them on each other. It truly shouldn’t be a way of governing anymore. It’s just sad. Edit: I just wanted to add, most of the people that came to protest against the event weren’t even local. Honestly it was mostly locals who were doing the anti protest and keeping everyone inside and out safe. It was very much a bittersweet moment in Eugene history. Cool to see the community come to support a local ally/lgbt+ bar, sad to see so many people without lives come out of their way to a city they don’t live in to protest an event they’ll never go to…smh. And now my favorite local bar has been struggling since that, on top of dealing with the Big Rona. Not only are they an lgbt+ safe bar, they’re also one of the only metal/goth bars in town 😭 I would riot if bigots got the best local bar shut down.

Part of me is just so tired. Why do Queer people and those who do not conform to what society tells them to (while also not hurting anyone, may I add) have to fight to express themselves and just co-exist in society? A country that goes on about freedom can't even let a person who may appear to be male walk around with nail polish as it's too 'feminine' without someone throwing a fit. Why does individual expression scare you so much that you need to ban it? I would pity those people who get upset over the sheer thought of a man wearing make-up or a person just using a different pronoun as their lives must be so sad to hate on people just being who they are, however, I can't pity someone who constantly wants my rights taken away as you can only go so far in attempted understanding before you realise that it is a pointless fight, especially when they don't even see you as human most of the time.

The thing is, drag isn't even trans only, like yes most drag you may see are performing a pushed version of "gender traits" that is opposed to their own gender, but there's plenty of people who do drag whilst being the same gender they perform. Drag is a universal art and language, it's not only men dressing up as exagered feminine features, it's also cis men dressing up as drag kings, cis women as drag queens, trans, GNC etc... This bills makes 0 sense at all and it shows they absolutely don't understand what drag is and are just covering their basic ass transphobia by attacking drag first. Also makes me feel like not only drag is attacked, but GNC people, or people that don't "look like" the general ideation of their gender (butch lesbians, feminine boys etc) that could be pointed as drag performers and banned. But with laws like this policing gender expression, how would/could one prove that I'm wearing women's clothing with the intent of exaggerating traits of the opposite sex versus what I'm really doing, which is, just wearing clothes that fit me that I like? This is just another example that proves that this was never about "protecting children," though most people that visit your channel probably knew that already. For them, it's about making anything that doesn't adhere to the binary model of sexuality and its expression go away by punishing those that don't. I never will, I don't know how, and I shouldn't have to wear certain clothes and put on the correct performance just to go to work and the grocery store and live my life...here endeth my rant...:)

If you don't want a dress code for going to the grocery store, fight back against this, even if it's much less likely to be wielded against cis people than trans people. The best analogy I can think of is assuming that all people who wear football jerseys are doing it because they get sexually aroused. When in reality some people where football jerseys because they are performers (football players). Some people wearing football jerseys because it's part of their identity (fans). And yes, some people wear a football jersey because it's part of their fetish. But just because some people wear football jerseys as part of their fetish, that does not make every single person who is wearing a football jersey a fetishist or inherently sexual.
