Today we are talking about the legalisation of distilling and malting corn with Bearded & Bored.
Bearded is one of my oldest youtube buddies, so it was pretty cool to be able to hang out with him. This is a topic that we are both very passionate about. So we figgered it was worth getting a quick conversation on camera to share with you.
In the USA its legal to homebrew, legal to make wine and mead. But not spirits. We think its crazy and would love to see it change.

I am putting together text so I can push it through email and text with the appropriate link and I’m going to implore all to sign this petition. Everyone; please blast this out far and wide! 100,000 signatures is a lot, but I think this home hobby of distillation of alcohol spirits can and will support it! Go team go!

Jessie, I'm in Texas as well. I brew, I distill, and I occasionally smoke. Never been to jail forever... ;) Brewing is of course legal. The other two are perfectly legal as long as you don't get caught. The absolute keys are to never be in possession of a FULL working still, never have anything on you that you can't swallow in two seconds, and never tell neighbors, boyfriends/girlfriends, etc about anything you don't want to see on legal documents. The last one is the biggest. Neighbors and booty calls can fall out with you much quicker than lifetime friends and family. Never give them any rocks to throw. Not saying it's OK to break the law, but IMO, if you aren't hurting anyone, the government can piss off. I have no moral issues with that line of thinking.

Yeah I hear you. I guess a lot of people put it into the same sort of category as torrenting a episode of your fav show that you just cant get in your area or whatever. And I totally agree, IMO there are very few situations where these two rules dont cover everything that need covering: 1 - Dont be a dick 2 - If you are an adult make up your own mind. As long as you are not hurting anyone else. Also, Im glad the channel now has a resident expert on the important things. You know, neighbors and booty calls!

@@StillIt - Yep, Rule #1 is spot on. Not being a dick can get you out of a bunch of jams with many types of people. Neighbors, cops, ex's, etc. Be cool and nice, and people usually don't want to be a dick to you. Be a jerk, and people will feel obligated to put your ass in it's place. As for booty calls, I make no apologies for my behavior. I'm fairly young, not too hard on the eyes, and have a "Unique" relationship. Life is too short to not enjoy it. (Again, without hurting others).

@Made In Poverty Agreed. Check out homedistiller.org forum for a much more informed group, also r/firewater on Reddit. Legalization of hobby distilling may be a pipe dream, but I'll keep hoping that eventually the good information will outweigh the bad and we'll get some mainstream support.

Should be legal. It's an archaic law that is being ignored. There's on average of 1000 fire reportedly caused by Turkey frying, how many from an amateur homedistiller?

@@CrapSandviche Well, New Zealand is the only country where it's legal so they actually have data on that. There are more house fires caused by candles, cooking, and cigarettes. Distilling related fires were "statistically insignificant" in 20 years of data.

100% agree about home distilling being illegal in the US as a dumb thing and a holdover from ye olden days. It's all about taxes. I'd love to learn more about it and share that information with my viewers too, but alas, we can't do it. Great job guys.

I was just researching this in Arizona. It turns out you can possess a still, with two restrictions. One; you must register it with the States department of Alcohol - including a picture of the still (That brings up the chicken/egg issue. I take a picture of my still to get it registered but it's not registered so it's illegal...) Two; You may not sell the product. Give it to family and friends over 21 is cool. I'm still designing my still in my head. Jesse gives me some great ideas. Thanks for your videos.

Thanks for sharing this. It is a major disappointment here in America. Some folks distill anyways but in my state they are risking a 12,000 dollar fine and 2 years in prison. Some of it comes from the tax that the states collect on spirits. Money money money. It has been a joy to watch what you can do in New Zealand keep up the good work!

That's really cool that you can malt popcorn! But a 50 lb bag of whole kernel corn can be purchased at the feed store (ace, tractor supply etc) for $8.

@keith moore that's why I specified "whole kernel corn". Popcorn may indeed be sufficient for small batches of home brewed beer, but being on a farm, and somewhat larger scale, jesse (still it) likely has access to feed stores and could benefit from the larger volume

@keith moore I totally understand, its allergy season here too. In hindsight my reply may have come off a bit more stern/abrasive than I intended. Bearded mentioned that he prefers the flavor of the popcorn, I'm curious about the flavor difference between popcorn and field/feed corn.

I've started to talking to my delegate and state senator and trying to get it legal to own a still in Virginia. Not even a water distiller can you have.

The same bullshit law in Florida! One cannot even own or possess a still; not even for decoration purposes! I too am trying to hook up with our state legislators to see about changing that. But it is an uphill battle for sure!

With VA’s history of the moonshine wars and how strict our laws are as a result, I doubt it would ever be legal in VA regardless of federal law.

A Boy Howdy and a big old Who Ya to Ya; Jesse and Bearded! I too, am a law breaking home distiller in the states. I also happen to be blind. Hey, maybe I can play the blind card if the revenuers come a knocking at my door? Let’s not dwell on that one for now! I’m getting ready to set up an appointment with my state of Florida District Representative; to discuss possible state legislation making it legal to distill alcohol at home as a hobby. Or at the very least; make it legal to possess/own a still. As of right now; in the state of Florida it is not legal to even own a still for decoration purposes! I then want to talk to him about what he’d think about trying to pass federal legislation on this truly outstanding hobby of ours. Then once congress goes back home, give the same a try with my US congressmen and Senators. It’s high time it becomes legal to distill alcohol spirits at home; as a hobby. Any Americans reading this post, or those that subscribe to Still It or Bearded & Bored; we all need to get together and get off are arses, how’d you like that one Jesse? And make this happen! “We must hang together, or we will indeed; surely hang together”!

Good on you for taking action. You are 100% right nothing is going to happen unless people start making some noise! Also, dude. Respect! I cant even begin to imagine how methodical you would have to be to partake in this hobby with out the use of your eyes!

I don’t know anything at all about illegal home hobby distillation... that 5 gallon stainless pot in the corner with the triclamps and copper pipe and shotgun condenser are for my ‘fuel alcohol’ that I have a free US federal permit for that I run in my... uh... lawnmower and weed whacker... yeah... It’s less harmful to the environment than fossil fuels... or something like that.

I brew beer. I make mead. I make wine. I would LOVE to get into distilling but the paperwork and fees feel overwhelming to me to even think about as a hobby. Really enjoying your videos! Keep em coming! :)

Actually the liquor lobby was in favor of the bill, the congress just got distracted by BS. THere were enough cosponsors in both houses to pass the bill if only cosponsors had voted yes.

Its the same here in Australia . . . perfectly legal to purchase or own stills and their components, ingredients, flavourings etc but against the law to use them to manufacture alcohol for consumption. Our stills are apparently for water and oils only :(

I agree. I'm in talks with my senators and congressman to look at what legalizing craft brewing had done to grow the brewing industry as well as grow small businesses! Legalizing craft distillery would result in a like boom. It's anything but the old bathtub gin where unscrupulous gangsters would add methanol to grow their profit! Craft distilling would be creative and safe and give so many different tastes,much like the plethora of different beers, ciders and IPA's. Make craft distilling legal in the USA!! It's all about freedom!!

I think it should be legal in the u.s. If only for personal consumuption. Of course there would be so, so many people making horrible products. Shit in shit out as we say in the kitchen. I do wish we could distill but at the same time I'm glad we cannot at the moment.

I've been malting corn for sometime now and my experience is regular yellow corn does not malt well and the yield is low. I would never use feed corn since it typically has all sorts of trash and dead insects in it. Pop corn does the best and the yield is very high, besides, it's cheap.

My state law is that you can distill up to 200gal/person in your household annually. Unfortunately that doesn’t help when the feds come around. So weird that it’s legal to distill non-alcoholic beverages, and it’s also legal to brew beer or wine, but combining the two is illegal. Could one distill insanely large amounts of something like kombucha or “non-alcoholic” beverages to get the alcohol off?

Hey Jesse - Mate, I'm just starting out watching your channel. Not sure how far I'm going to go down the home distillation path yet, just weighing it all up right now and I've got a few other projects on the run like fermented chilli sauces, etc., but I was an avid home brewer about a decade ago and you have caught my interest. So a total noob question for you - due to the distillation process, can you afford to be a little bit more lax on the sterilisation aspect to the craft? I figure that seeing as all of this will be distilled out it should eliminate most of the nasties, but the thing I hated most about home brewing was keeping on top of the sterilisation. Blah, I will get through your library before I ask any more silly questions. Cheers mate; Simon

Nice mate. Its definitely a fun hobby, but it will take you down the rabbit hole! haha. Honestly it works well with other hobbies too. I definitly think you can be a little more relaxed. My current opinion is that as long as you are not getting meaningfull influence from "infection" in primary you are golden. So you dont want a raging infection, but its not like you need to worry about bottle bombs or off flavours developing in kegs. Dude, CLEANING SO MUCH CLEANING! Best thing I ever did with home brewing was to move to kegs. At least then you only needed to clean one bottle haha.

Hey Jesse, you’ve probably fielded this before but do you do anything to your water profile to get what you are looking for? Are you starting with RO water or something else? I’d be really interested to hear your take on it.

How's it mate. I used to mess with additions for beer brewing based on water tests for my tap water. Honestly I have not bothered for distilling. I have never built a profile up from RO although the geek in me would love to haha.

Still It, thanks for the response! I was recently in the Florida Keys at a rum distillery there and they said they pipe in water and then have RO filtration on their roof. I suppose it makes sense for diluting after you have a finished spirit, but I just can’t see a reason to do it for whatever you are fermenting. And even then, I’m curious how useful it would even be. What do you think? Would it even be worth it for spirits?

I mean some water does make it through right? Especially in pot stilled product. I assume it would be similar to beer. It's just going to shift the Ballance of what shows through more, and change the mouth feel a little. As you say though, surely it has to only be a limited effect. I do think, in some cases, the water profile could effect fermentation and clorine could definitely be a issue. So in those cases adjustments or cambden etc may be worth it. But, as you say, water to proof with seems to be the obvious focus to me. I recall seeing a taste test on lime water somewhere.......it may have been the whisky vault guys.

I believe Missouri is the only state; you have to apply for a state permit to distill alcohol at home. Hell, I’m thinking about beating feet out of the sunshine State and heading up to Missouri for that fact alone! But I like it down here too much, what a bummer!

Drones The same could be said for weed (the war on drugs ring a bell?) yet there are states where recreational smoking is legal and you can have 6 or 8 plants in your house for personal use. When the DEA pops Joe Rogan for smoking weed then I’ll worry. Until then, I’m going to trust that the combination of my states laws and the 10th amendment have me covered. Besides, I’m pretty sure the ATF has bigger things to worry about than my little still that gets run a few times a year.

Here in Oregon we can make our own wine. We can brew our own beer. We can even grow our own weed, but it remains a FELONY to distill spirits. It is farking crazy....

I dont hardly drink but maybe once or twice a year but if I could I would own a still and make my own alcohol I have alot of ideas in my head but can't act on them because jail is no fun in any manner of the idea

Unfortunately we may need to ‘bend’ the rules to get more ppl talking about distillation, and dispel the myths about it. A US federal ‘fuel alcohol permit’ is free to apply for, and allows you to distill ethanol “for use as fuel” and maybe a few pints go missing on occasion... oops.

Question about Applejack, if you were to throw it in the still until you have removed the foreshots then kill it and freeze distill what's left could you not have the good parts of Applejack without the worry about a hangover from hell if you go a little overboard

It's legal in Tennessee, your license cost $1000 per year lol or is that ethanol. Shit who cares. Drinking some Bulleit Rye. Green label. WOW , those hill folk. Delicious

To be honest I am not entirely sure on that. Legality in the USA is far from my wheelhouse. I am hoping Bearded will be along soon to confirm :)

You don't know why?? TAX!!! Calculate the amount of tax beyond sales tax that is charged on a bottle of alcohol. The government has been collecting tax on alcohol since the revolutionary war here in the US

I think this morning there were only 700 and something signatures; out of the 100,000 that we need by June 23? I guess all of us Home Distillers are just too nervous about putting our name on anything? Well we need to get this done people! Get off your ass, and make it pass!
