President James Garfield. Easily the smartest guy to ever hold the office but literally nothing interesting happened during his presidency until a guy who had showed up to the White House begging for a job went nuts when President Garfield told security to GTFO this fool out of my house. Nutty held a grudge and a couple of months later came back and shot him. Technically speaking though it was his doctors that finally killed him by screwing up trying to dig out the bullet not that dissimilar to Lincoln but because there was a lot more of President Garfield as he was rather rotund it took him a lot longer to die. not the lasagna loving Monday hating orange cat

I honestly think it's just a little sad that so many people know so much about half the presidential assassinations in US history but the other two are never mentioned in schools, relegated to wikipedia and relatively obscure youtube videos. Let's be clear here: When Wilson was "indisposed" and his wife was essentially running things, the whole system of the VP and Cabinet declaring the President "inable" and taking over was not created yet as the 25th Amendment was not ratified until 1967. My interpretation of the bumping problem would seem like it was meant to describe if a higher entitled individual was out of commission but not dead. Say the governmental disaster that was mentioned put the secretary of the treasury in charge and left the Speaker in a coma. The Secretary of the Treasury would take over until the Speaker has recovered enough to take over. It reads to me as if it's meant to apply to the original line of succession not any replacements that might be put into fill it out
@JackFlysCA
@JackFlysCA 2 года назад
This is precluded in the same section. "the removal of the disability of an individual higher on the [line of succession] or the ability to qualify on the part of an individual higher on such list shall not terminate [the acting President's] service." (3 U.S. Code § 19 sub. D) So they cannot bump by virtue of their disability being removed. However the video is still wrong about how it would work; because the bumping provisions "shall apply only to officers appointed, by and with the advice and consent of the Senate, prior to the time of the death, resignation, removal from office...of the President Pro Tempore" (3 U.S. Code § 19 sub. E). So it seems to me the bumping is for, as an example, if the President through PPT died, and the Secretary of State was unreachable (but otherwise qualified), the Secretary of the Treasury could take over. Upon the Secretary of State becoming reachable, only then would they bump. But a new Secretary of State wouldn't bump them because they were not in office prior to the death of the original President Pro Tempore. (And for reference, the President Pro Tempore is the official cited and not the President, because they are the lowest official that bumping doesn't apply to).
@alex_zetsu
@alex_zetsu 2 года назад
That would make sense, however the "unless a prior entitled individual" line is ambiguous enough either your interpretation of Grey's bumping scenario could be correct. One is a terrible idea, but if both interpretations are constitutional (courts generally try to interpret a laws to prevent them from being struck down if possible), then the one that courts think the lawmakers intended takes priority, not the one that makes sense. So we could have the nighmare of bumping.

There's currently 435 members in the house and 100. They would basically keep appointing a member of house to be speaker of the house and then the president. They they'd go through the cabinet members and each new president can just replace the missing cabinet members. But let's just say all of the members of the house and senate and all the cabinets are dead. We have like a thousand high ranking military leaders generals and the such. Pretty sure one of them would step up before a postal worker was made president. Nice thought exercise though.

Alright so in both of the “up to interpretation” scenarios, here’s what I’m hoping happens: A) It is “Vice President and (Cabinet or Congressional Committee)”. The committee is only used when the president it unable but won’t give up their powers and will fire anyone in the cabinet that tries to stop them. It’s a plan B in case Plan A fails. B) “previously entitled” is chronological, and so if say the VP is incapacitated but not dead, once they become able to assume the powers of the presidency after weeks, the acting president (speaker of the house) gives the position to the VP. If VP is dead, Speaker is acting president until the end of the term.

Fun fact: Chuck Norris went back in time and stopped the Kennedy assassination. He deflected the bullets with his beard. Kennedy was in such utter shock and awe, that his head exploded.

However, the head of Homeland Security clearly wasn't doing his job if such an event were to occur, so he really shouldn't be put in charge of everything.

One small thing: the "designated survivor" often isn't in a secure bunker far away. Often they're just at home, sometimes even in the DC area, watching the state of the union address on tv. So if a "government decapitation event" happens the "designated survivor" could end up "rolling 7s" as well.

The "bunker" shown in the video is colonial one from battlestar galactica in which the secretary of education become president because of an event similar to the one discribe in the video

Its like if someone manages to put a giant bomb in Congress during the state of the union address and kills most of the cabinet, probably most of the Congress which could also lead to a change in which party is in the majority in each house without an election, and kills the presiding officers, and possibly most of the supreme court which is supposed to rule on matters of this.

If they nuke DC then yeah the government is probably done.
@PencilSticks
@PencilSticks 3 года назад
Obviously it would be nearly impossible to nuke DC, but if a terrorist organization or foreign government pulled it off, they would kill the designated survivor as well. If this was done during the State of the Union, every single member of the US federal government would die.
