Our topic today is “Negotiation” and the film segment is from “The Patriot” a movie produced in 2000 which depicts the story of an American Colonist, Benjamin Martin, played by Mel Gibson, who was a volunteer officer for the revolutionary army. He leads a band of local South Carolina militia against the British forces of General Cornwallis, played brilliantly by Tom Wilkinson.
In this scene, Benjamin Martin is taking a great risk to negotiate directly with his enemy, General Cornwallis, for the release of his men being interned as prisoners of war. In an earlier militia raid, Benjamin had acquired a wagon full of personal possessions and effects of the General along with two Great Danes, that were given to General Cornwallis by King George himself. Benjamin knew could use them in trade for his imprisoned militia soldiers.
We join them as the negotiation for the release of the militia prisoners commences.

Martin knew that Cornwallis was a man who lived by the code of being a proper gentleman. When Martin easily gave up the dogs and personal belongings, Cornwallis felt to be a gentleman in return he had to give up something also. Martin took advantage of this

The funniest part they cut off. Martin walks away whistles and those 2 dogs run back to Martin. They leave. As Hawkeye from MASH said once. " War is a lot worse than HELL. There are no innocent people in HELL. But War's kill innocent people all the time."

I think this entire scene was ultimately about, not gentlemanliness, but rather that Cornwallis saw his two dogs and some personal effects are more valuable than the lives of the 18 Continental soldiers. In return, Martin showed Cornwallis the value of the British army, straw.

Anyone notice when he said your officers targeting civilians he was referring to Col Tavington you can tell the look on the generals face when he mentioned killing civilians like he instantly knew who was being referenced.

Here is the problem: When you use subterfuge or deception in your negotiations, you squander your reputation and ability to engage in subsequent issues. You are only as good as your word. When you garner a reputation as a dishonest player, it is almost impossible to recover and negotiate in good faith. Therefore, your short term aims are achieved but long term or strategic initiatives become much harder to obtain.

Deception. That's a great word. Dishonesty and deception are definitely words which are linked. What if you yourself are dealing with deception, and you adopt deception on your own behalf to achieve your goals? If someone walks up to your house and starts hurling bricks through your window, are you going to politely walk outside and ask the assailants to stop? Word to the wise. Except the same treatment that you bestow on others. In the simplest terms. After the 16th brick has hit your house, with the windows and siding all beat to crap. You then come out with a yard stick and bust it over the attackers head, and the attacker sues and claims some sort of moral violation.

Agreed. The trickery used in the film ensured the further escalation of hostility and reprisal. In the context of the film, the asymmetry of forces appears to justify such trickery, at least emotionally. The church burning sets up a whole lot of banked sympathy.

I agree in principle, that is to say in a peaceful setting. like say politics in normal times or business dealings. however, in war things are different. a very wise man said " all war is deception" about 3500 years ago. that wise man's name Sun Tzu.

Technically, Cornwallis did via the telescope and from his point of view he saw men. Keep in mind it's not that easy to tell if they were people or dummies at that distance with a telescope. What he should have done to make sure he wasn't being deceived was ask Martin if he could send one man out also under a white flag to speak with the "Officers".

Martin ''Ghost'' lost a serious trump. In addition to the fact that there will be no more negotiations, this is a huge motivating factor for the English. It's not even about avenging your fellow soliders. The officers will now be more determined, knowing that in a fight they cannot hope to be captured and will either win or die either way. ''do you see him? This is what awaits you if you waver or lose heart. This is a fight to the death!''

I love the scene, love the plan, love the execution, but there's that niggling reminder in my head that such a trick can only happen once. Now, Martin can almost never expect to do something like this again, and maybe no one else in the Continental Army because of how embarrassingly he fooled Cornwallis.

Martin had some balls. I don't know what other way to say that. Cornwallis was not only one of the greatest generals that ever lived, he was also one of the greatest orators in military history. To walk into his fort, and demand something from him like he did was downright extraordinary.

@JT yeah but very lame written. It is stablished that the general was a mastermind, yet he just gives up the prisioners with 0 confirmation of his imprisioned officers. Mel Gibson's plan would have fallen apart if the general had said: "Fine, get my officers and we 'll do the exchange"

Recommend the movie 12:00 O’clock High with Gregory Peck. Required to watch while attending Leadership Management Training while in the US Navy. Movie depicts 3 different leadership styles with their strengths and weaknesses. Coercer, Authoritarian, Coach. A blend of Authoritarian and Coach, considered best. Still use what I was taught 30 years ago with great success.

Errr....no, because then you would have given up another officer. In this type of negationation, you don't get to verify. Martin had already given up much at the onset, as planned, so Cornwallis could not have expected anymore - including the option to verify.

Brilliant scene and brilliant film. This compensates for the artistic license taken with this fictitious scene. Although eventually defeated, Cornwallis would not have engaged in the buffoonery in this scene where he trades prisoners for straw men without making any effort to verify their identities. He could have easily held Martin temporarily while a scout under flag of truce rode out the few hundred yards to verify the "prisoners."

The dogs were the key. Without the dogs the general would have held Martin for proof. The real risk for Martin was what if the general hated those dogs.

Also, the ranks of captured officers and the fact they didn't give their name should have raised suspicion. If three Majors and a Colonel were captured, not only would word have gotten to Cornwallis asap, but there would be active efforts to negotiate with the Continental Army for their release.

The only problem is that 18 officers is about the complete officer compliment of a regiment. I'm pretty sure Cornwallis would have known if that many of his officers had been captured.

Interesting observations but you've missed a couple opportunities, especially in a scene like this which is packed with subtle nuances of the exchange of power between the two characters.

I loved the movie... and as for the negotiations being real, well it was a movie, however the sub-titles brought you to the poster's points. Those that can negotiate do so daily...those that can't, usually make silly comments on RU-vid....BTW...Nice Video.

I cannot believe Cornwallis did not know the Colonialists did NOT have 6 or 7 British officers as prisoners and that he just took colonel martins word. I thought the clip of the dogs was just plain corny and detracted from the seriousness of the film. But as to the examples of tactics of negotiation and the advice printed on the screen--that was excellent and I look forward to more lessons! I can think of lots of gangster movies that have great clips of life and death negotiations.

Cornwallis was given only the rank of the man not his name. It was not until Tavington arrived that he was made aware of his name. But by then he had already agreed to the terms and as a gentleman could not go back on his word.

A lot of these things used in negotiation appear to be only usable if the person requesting the negotiation has some advantage. However, negotiations in general is tough to do as each step seen here is a calculated risk of pull and push. Plus backstabbing in negotiation means the person will be forever considered untrustworthy to negotiate to.

The Patriot was loosely based upon the life and times of Francis Marion, the Revolutionary War hero from South Carolina, nicknamed "The Swamp Fox." The film's narrative, however, avoids the fact that Marion was a slave owner (and not a particularly nice one) and the fact that while Marion's actions were brave, they certainly weren't as noble as they were portrayed as being.

You should read his entire biography and you'll see that your interpretation of "not a particularly nice one" is not entirely correct. John Oller is the author. Its on Amazon. My family is from "ground zero" of Marion's ( and Banastre Tarlton, aka Tavington) Revolutionary War exploits. His "actions" were indeed both noble and brave. How would you react if another country invaded, and in the process, burnt your home to the ground and murdered your family? It happened.....countless times sadly. I visited Marion's grave site just last week. Beautiful spot and the remoteness of the place will give you pause.

I LOVE THIS SCENE! Ole General "Stuffy-pants" Cornwallis was taught a very valuable lesson here. Not only was Col. Martin able to get his Men back, but Gen. Cornwallis soon found out, that his "Officers" that had been captured and released, were dummies, that were stuffed into British Uniforms! He lost both ways...and he deserved it! Every single bit of it!!!

This is a wartime negotiation, so subterfuge doesn’t matter. It’s not like Martin will be back in Cornwallis’ office over and over. It’s a one-time deal so using all the deceit and trickery you can is entirely appropriate.

He knows the future. He knows without those men his unit can’t fight anymore and he’s as good as dead. He knows if they lose the war he’s as good as dead. And he knows that if they win and he survives he’s Ok to live free. In situations like this, the actual future may not be known (as it never is of course) but the possible futures are never more clear that when arms are taken up.

General Cornwallis was one of the Englishmen s best generals if the day. He had serve time under general Wellesley in Spain and elsewhere.

I really like this movie, because it is consequent with its story. He lied to get his men back and then they ha to deal with the consequences. Cornualles, knows, He cares about civilians, so he retaliates.

I doubt the general would fall for this trick. Easy to order 2 men to ride out on horseback and check to see if those officers have actually been captured.

I know in the modern sense, this is seen as some kind of one-up to the British but this kind of move, especially at the time, is extremely dangerous. Sure you may win back your men but you forfeit the lives of any and all in your army who get captured in the future. Reputation and goodwill despite opposing ideologies are extremely powerful tools. To throw those away for this tiny “victory” was exceedingly foolish.
