Thanks so much for covering this man. If he'd just reached out and said he was unhappy that those 2-3 seconds look similar, I'd have happily cut them. And I've tried emailing him several times to see if there's some way we could sort this out between us, but he ignored the question. (I've later found out he has a history of stuff like this from back when he ran PowerTV MCN, but that's a whole different rabbit hole). The problem I have is he immediately went to filing 3 strikes so my channel will get deleted. And while I am countering (as I have no other choice), I can't post videos while the strikes are under review, and the next step is he could now file a lawsuit. Ordinarily a creator would obviously never do that over literally a few SECONDS of footage, but he does have a history of lawsuits. And even if you're in the right it can be a really long expensive process still. Whilst I don't think my videos deserved to be taken down in the first place, I'm still willing to make whatever changes would make him happy. I just don't want to lose my entire channel. Despite the channel name this isn't some big media company, I'm just a guy making videos with a few freelance editors who help me - and this channel is my entire livelihood. Surely there has got to be a different solution here? Thanks again to everyone for sharing this, I really do appreciate it.
When writing my Bachelor's on Computer Engineering mine and a few of my peers works were flagged by an algorithm because we explained the same abbreviation. Like what the fuck do you want from us, yes, those words in this exact order is what it is?? We can't just remix the abbreviation willy-nilly??
I had a professor run essay’s through some program to ensure less then 15% was copied or plagiarized. The only part of it that got highlighted were common phrase like ‘it is.’ I kid you not, so what you’re imagining to me is a situation I could honestly see. Also the professor agreed with the program which to me was nuts. Guess we can’t write it is anymore or therefore. Then again not sure what to think on a health class professor who uses Dr Oz sites for a good chunk of the course.
I experienced something similar, resulting in a lower grade. It was just a 20 line summary and involved material used from a Wikipedia article. Contacted my English teacher by phone. We´re still best friends today, because the grade did not matter to me even though I passed. What did matter was the knowledge and experience gained from being on the course and following the course material.
@@Stanna44 Doubtful. It's really difficult to explain specific things in terms no one else has used before. Had this issue in a medical class, we had to describe a melanoma in the intro of our essay. What is a melanoma? It's a type of skin cancer, specifically in melanocytes. Do you know how many different websites have used those exact words? Thousands. It also doesn't matter how much you remix it "melanoma is a cancer that begins in melanocytes", "melanocytic-derived cancer is also known as melanoma", etc, someone out there has already done it a thousand times. You'll pretty much always be flagged for plagiarism on definitions because definitions are rigid, unless it's an abstract concept with a loose definition.
This isn’t drama. This is criminal and bullying. Alex needs to lose this and lose *hard*, there needs to be a precedent set for dealing with scum bags like him.
Honestly it just seems like this Alex A-hole is just weaponizing YTs broken copyright system to try and get rid of any channel he sees as competition to his own (well the channel he bought, not created). And since from all the videos I've seen on this topic theres really no negative repercussions for issuing a false strike so if youre morally bankrupt then why the F not use it to your own advantage. So far, at least from what I've seen, those who have been issuing false strikes to either silence criticism or to cull possible competition are the ones who are winning since the only consequence they suffer is having a few negative videos made about them. Hell if I ran a business and I could do something that's just straight up wrong or illegal to silence my critics or lessen my competition and all it would cost me is a little bad press for a week or 2 I would do so without hesitation so its not surprising that this keeps happening and will continue happening unless YT or other channels step in. What i mean by other channels stepping in is that as soon as a channel acts in bad faith and tries to take down another channel using false claims then a bunch of other channels should immediately inundate YT with claims against the channel that started it, even if they're all false as well since again there's no consequences. I've seen videos where channels have received claims from random people just trying to essentially steal revenue or get a channel they don't like taken down and, besides 1 person who pretended yo be Bungie, nothing happens to the people who filed the false claims (and in the Bungie example it wasn't YT who went after the abuser but Bungie themselves so again theres no punishment for abusing the system and imo the only way to make it stop is to let abusers know that if they falsely claim any content then a ton of other channels will collectively do the same to them). Maybe seeing literally a false copyright war break out on their platform will finally force YT to deal with this BS and increase their own punishments for false claims. Imo if a channel issues a false claim(s) thats proven to be false then the channel issuing the false claim should at best recieve the same amount of strikes they tried to falsely issue at best or just have their channel immediately taken down without appeal at worst.
Unless this is tested in the courts and someone actually does win against copyright trolls, this kind of thing is just gonna keep on happening no matter how many times guys like Muta or Charlie bring up. But if it actually comes to it, I hope MagnatesMedia is ready to fight this in court and we'll all be rooting for them all the way.
It's like how they tried to cancel Ed Sheeran just this month because he "stole a black artist's music" and sued him for millions. Then as it turns out (obviously) he did nothing of the sort, the songs were totally different, and they had no case and lost. Sheeran has been very vocal about squashing out bullshit lawsuits and getting people to change the industry.
@@MrWolfSnack bro the song shared the exact same bass line and drum rhythms, the chord progressions were very similar and so were the melodies. Not saying Sheeran plagiarized Marvin Gaye or Ed Townsend’s work but the songs share the same ingredients and sound very similar.
@@Zom13y Yes because the songs are both in the pop soul ballad grouping of music. If you're not using that very limited assortment of bass, drum, and note arrangements as those songs then you'll accidentally just stumble into an entirely different genre. Tropes in sub-genres often make songs arrange and sound extremely similarly and the limitations of those genres can be used as a false smoking gun such as cases like these. You cannot claim to own a genre-signifying collection of tropes. That would destroy the entirety of music production as we know it.
@@Zom13y Whether we can say a person or person's that CREATED a genre can potentially "own" it is a different story entirely. It should be known who created and innovated a certain genre or sub-genre of music, but saying Ed Sheeran plagiarized is very ignorant of basic music theory analysis of pop soul ballads. Or even just look at a collection of doo-wop songs. Most sound plagiarized. In fact Ed Townsend's doo-wop songs sound incredibly plagiarized to other doo-wops but its that trope of genre-defining aspects that make it sound that way.
This is psychotic, but these stories will never stop coming as long as RU-vid does their copyright claim system the way they currently do. Requiring the claimer to provide absolutely no proof of their claim is ridiculous. It would be like sending someone to prison for murder because someone else said they did it, and not have any sort of trial or evidence or testimony, or anything, just immediately send them to prison.
I mean people have gotten killed for similarly minor stuff pretty often. Killed while sleeping, killed for air fresheners hanging from the rear view, killed for picking up a bb gun in a Walmart, etc.
Because RU-vid can't fix it. If they fixed it then they'd get sued by larger corporations. It's Copyright law that's at fault that's stopping YT from being able to do anything else. It's not actually the fault of YT.
We do have to put a lot of blame on RU-vid too for allowing this system to be abused, a strike can be appealed by reaching out to the person striking but if they ignore you, the strike will stay, youtube automated this shit and now people can’t do anything about it other than try to hope the other person has some sort of soul left in them. And the fact that anyone can just spam this and terminate a channel that someone has worked so hard and long for just with the click of a button, it’s scary…

RU-vid needs to add a requirement of proof of rights holdership before a strike can be issued. Some sort of positive proof before a dmca strikes can be filed, and manual review
Recently, Nikokado Avocado also copyright claimed and TERMINATED popular meme RU-vidr Kracc Bacc. He terminated him for using scenes from his videos, even though Kracc Bacc followed Fair Use (he transformed the videos more then most meme youtubers would), he still had his channel taken away for months. It was a very similar situation, and it would be great if you could cover it.
i love how false copyright strikes have been a problem on youtube for years and years, its always over looked but it can genuinely ruin someone's career.
youtube should... idk check the strikes by requiring to send the striked's content, the strikee's content and what's similar, then proceed to compare the 2 and see if they are truly similar before adding a strike to the channel, improve the copyright system so this doesn't happen again
RU-vid has to finally change their claims system. It consistently rewards those who abuse it - even monetarily (!!!). That they haven't been sued over it is crazy to me
What RU-vid needs is a 3 Strike Policy for false claims. Why should the people who use lies to harass, steal from, and attempt to shut down valuable content creators be allowed to stay on this platform?
It's crazy how much this is overlooked, RU-vid had always had a problem with false copyright strikes but have never did anything about it. This makes me genuinely upset for some creators.
Looong time ago, you could contest fake strikes with much more success. I had done it before because I received false strikes from some nobody company. That was several, several years ago, however, and it's nearly impossible to contest anything being done to your channel now.

It solves the greatest issue right now, which is giving a single company a monopoly and sticking by them no matter how awful it becomes. People just need to learn to budge.
These are good points of interest, Ty for brining this story to light. I am a RU-vidr myself and I wouldn’t want to get shut down over bs. All those reactions videos are constantly using other ppls footage to comment on, they even react to music too and it gets them lots of views and subscribers. If they are going to strike down bs claims like that they ought to strike down everyone who does reactions videos too.
Hey Charlie, lol. RU-vid is crazy man. I streamed my first stream on here the other week and got a strike for being a "scam" and "deceptive practices". Then I was banned from streaming. I won the appeal, but still. This stuff is nuts. I hope the channel gets justice on this issue. Cheers. 💩
Technically it is, but unfortunately copyright abuse isn't something the government particularly cares about, so there aren't a lot of clear laws regarding it.

It reminds me of my yrs elementary school, up thru high school, when the wannbes claimed false attacks & made up malicious gossip about others they didn't know. Ridiculous is good word for the false copyright strikes. I got banned from social media site Truth Social because I refused to friend & chat with a false profile account. It was a female's name but the photo with the name showed a middle aged man. When I asked about the difference between the female name & the photo of man, the person got angry with me & reported me for "whatever." Honestly, I don't care as I stay off some social media sites as they are now garbage dumps of the mentally ill attempting to destroy the sane educated intelligent last people in the world.
MagnatesMedia was the last RU-vidr I was expecting to get into any drama. But jokes aside, Magnates is a great and underrated RU-vidr. I hope nothing bad happens to him.
RU-vid is mainstream now. The empire has taken notice. The puppet masters are controlling some creators. There are research black ops going on constantly now. The drama looks like a well orchestrated scheme from those aristocrats behind the curtain of fancy technology. It's constant and edgy. I used to think it was still organic. But the way the barage of it is hitting so perfectly makes me doubt things are accidental anymore. Gone are those days I'm afraid. The backlash frenzy effect and the social justice machine we see here is also a force to be reckoned with. But rest assured there are people benefiting from all this who are completely invisible on the platform.

That type of claim abuse should even be punished, you shouldn't be able to falsely accuse someone, legally threaten them, and when proven wrong get away with it like nothing happened.
As with alot of things in life. The problem is that there are no repercussions for the person claiming copyright strikes on someone if they are found to be false. There should be a review board at RU-vid that looks over DCMA strikes and if, by arbitration of parties involved, find the claim to be false, the claiming party should have a resulting strike against them. There is nothing like this now and I can see why... RU-vid doesn't want to waste time or money policing the platform. I get that... but in that case have an appointed board of volunteer veteran creators be the arbitrators.
Nothing a content creator understands more is to not false copyright strike another channel. It’s about time RU-vid started to take action towards the false strikers.

@Broseph Broman While I definitely think Google has a political bias, they don't need to false strike channels to get rid of them. They just suppress the ones they don't like or outright delete them like they did to Alex Jones for example. They don't fiz the problem because they don't care about it because it isn't directly costing them money and to try and fix the issue would open them up to an insane number of potential lawsuits.

Magnates Media is literally one of the only channels I've been heavily invested in since I came across it, I love the content style and in-depth explanation of various businesses and companies that he puts out and now I feel this is just such a low blow to a content creator that doesn't deserve this at all...I hope he gets justice for his channel coz I'd definitely hate to see his channel go, it would genuinely infuriate me seeing one of my favorite YT channels getting terminated for no reason. And Charlie, thanks for covering this topic. Please, RU-vid, do something about this mess!!

I hate how RU-vid won't protect their creators from false copyright strikes like these. Imo no action should be taken before a thorough investigation of the claims and counterclaims have been performed. Malicious abuse of the system is rampant at this point, both from trolls and abusive companies.
RU-vid is not the arbitrator of what is copyright and what is fair use. The judicial system is. Google is just playing by the rules US Congressmen and women made.
RU-vid only focused on the favors of advertisers who are overstaying their welcome with their scams instead of supporting the creators. Considering that the YT Team barely fixed everything (from letting the bots loose to removing the dislike numbers) says a lot about capitalism.
I hope this lawsuit changes the legal ramifications for this behavior. Way too many copyright trolls out there. It should NOT be a business model. It hurts EVERY business.
Deregulation would allow for more freedom of speech. Less legal ramifications would allow people to choose instead of forcing companies to censor out of fear.
RU-vid really needs to start having some type of penalty for these false copyright claims. The channels doing this should be permanently suspended if it’s shown that they are knowingly using this to destroy other channels hard work. Most of my favorite channels have left because they can’t speak freely anymore and they clearly are pushing small channels out when they built this platform into what it is.
Honestly, I feel really bad for this guy. I have never been a big youtuber, but I had a channel with 1500+ subscribers that I was looking to Monetize and build something off of. I was hacked (in the same way Linus was hacked) and the hacker imitated an existing brand with my account. While I was in youtube's long recovery process, they terminated the account from zero strikes for trademark violation. I had no information on what the hacker actually did, I had to try and file an appeal and they would give me no information on what happened. After making me wait for four weeks, despite confirming that my account was stolen, they refused to return to me my account. It was a year of work I put into it, and it was gone in a flash, and RU-vid / Google couldn't have been more apathetic to what happened. Business Casual is a monster for hitting him with the intent to destroy his channel like that. His abuse only works because of how automated and hands off google is, he knows there's no real reason for him to be doing what he's doing. When I lost my account, I lost a year of work and will never allowed to be monetized again, I can only imagine what Magnates is going through with all the effort he's put into his content. I wish him all the luck in the world through his appeals. Nobody deserves to be subject to going through this process with how miserable, agonizing, and little chance for recourse there is.
@@LeHazy long story short he downloaded a virus thinking it was related to a sponsorship, in this case it would be downloading the same virus due to another reason
My friends and I had 5k subs way back in 2010 and we lost the account because on the one who posted our vids on the channel got hacked through his xbox account so I feel your pain.
What would be great is for a bunch of big successful youtubers like Charlie, Mutahar to band together and offer to fund any legal action required to smaller channels against assholes like this. They could reclaim these costs by counter-suing them once they inevitably win. I think I remember Muta already offering to do this before for someone which was awesome.
You should 100% do more videos on upper echlons content, he's one of the best journalists out there and a lot of the topics he covers are things that most people just never even thought had ever existed. They're very entertaining too, he does a very good job at making these topics engaging and easy to digest without skewing anything or making changes.
RU-vid really needs to update the copyright strike rules. A few weeks back, Vlogging through History received two copyright strikes from CPG Grey for seemingly no reason. The nuclear option should not be available until after some kind of mediation process.
Terminating a channel for 10 seconds of suspected copyright in a 1.5 hour video is like shooting a guy for walking on the far end of your lawn next to the road in front of your house.
Copyright law needs to be fixed not YT. YT can't do anything more unless copyright law itself changes. If they do then YT is opening themselves up to potential lawsuits from large corporations.

Usually happens to smaller creators… and even when it’s bigger ones the amount of money it would cost to to take it to court wouldn’t be worth it. What really needs to happen is for youtube to get their shit together and fix their broken ass system…

I found magnates about a month ago and binged the entire channel immediately. Some of the best stuff on the website. Seeing everything blow up the past couple of days and now Charlie addressing the problem is just infuriating. Maybe this will wake youtube up to fix things.
I had a problem like this in highschool, except it's even more stupid. A language teacher gave my class an assignment that requires us to read like a couple paragraphs and we have to choose/underline which sentence in each paragraph is incorrect/irrelevant to the entire paragraph. Our teacher accused our class of working together just because we all chose the same sentence in each paragraph. Like it's OUR fault that we're individually smart enough to be able to tell which ONE SENTENCE is incorrect. Then the teacher gave us another homework to make up for it like it's OUR fault HE gave us an easy assignment. I don't even remember if that work was graded and/or even made it into our raport.
I keep hearing "you're copying meeeeee" like we're all in grade school- what the hell? If you're THAT insecure, maybe content creation-or the internet in general-isn't for you.
