According to court documents, Jerry Hernandez, a truck driver with a history of failed drug tests who was prohibited from operating a commercial vehicle, caused a fatal crash in Bastrop County, Texas, on March 22, 2024, resulting in the deaths of a child on a school bus and another driver, after admitting to using marijuana and cocaine prior to the incident.

Since the company failed to check his history, they should be charged also. If they had checked his background, they would have seen how ignorant & half whit he is.😡

Alcohol, meth, opioids, fentanyl, cocain. No clearing house would have prevented this. Drivers ride around with 6 pks in their trucks. On the spot testing, The ability to disable a truck instantly is what is needed. This accident was not related to marijuana

Lil industry secret here from a cdla driver....its really rare to be turned down from driving a dump truck or concrete truck you have to be really really high risk much higher than him fir them to turn you away. Ive seen personally seen 85+yo drivers get hired to drive a dump truck long as you can hold the wheel your good

Damn, I take them drug test about once a year pass all of them thinking I’m doing good and all these clowns out here doing bad stuff killing people wonder why the truck driving industry is horrible right now

I own my own truck and have been driving since 1996 and it’s amazing to me how so many people in this country have a CDL and can’t speak English!!!! How the hell do you get a CDL in America and can’t speak English!?? Please explain to me

As for the calls that the company should be held responsible, most likely they will suffer as much, if not more than the driver. From another post on YT, the company only had the one pump, so they're not a big company. Which means they don't have anything else to operate with. Even if they we're completely innocent victims, an accident like this would be hard for a small company to ride out. But since the blame lands squarely on them, the coming lawsuits will greatly exceed their insurance coverage, leaving them bankrupt. They will be subject to audits that will not reflect well on their DOT authority, probably shut them down, and regardless there's not an insurance company out there that will touch them after this. I don't know if the owner will face anything criminal himself, but no way the business will survive. Not defending their lack of vetting the bum they put in the truck (I refuse to call him a driver), but wouldn't be surprised if that oversight was not malicious, but more like not realizing how important it could be. A lesson for all of us to be careful of those "it won't hurt this one time" decisions...

I worked for a cement company and you have to be at work at 1am after already working 15 hours. You would be suprised how many of these guys are on drugs trying to stay awake.
