Josh has always only cared about himself. He cheated because he enjoys sex, he abuses his wife because he likes to feel in control, he murders his wife for damaging his pride with her affair, and he tells the cops what they want to hear because he'll get the best deal. Emilia is not innocent but he threw her under the bus to save himself and I believe that she'd be afraid to come clean when the threat is someone with a history of domestic violence and murderous over jealousy.

I actually think Josh has 100x more remorse than emilia. The part where he is crying and says "I fucked around on her and she didn't kill me", he sounds very remorseful and broken. He is an absolute piece of shit, but I totally believe Emilia planned this and was the one who truly wanted it done. He clearly loved Heather more than her, and she knew they would get back together and leave her in the dust over and over until she was dead.
