Only if they believe it was a bad shoot… It’s worth having an attorney to talk to first, but it’s also important to recognize that you may need to have some type of communication with police in order for them to understand why it was in fact a good shoot.

@@tv92taylor It's tricky because the exact same case facts can be a good shoot in one jurisdiction but be a bad shoot in the one next door. Seems safer to wait for your lawyer to be able to advise you which one you find your case in, unless you have sound knowledge both of the politics of the police and prosecutor as well as the iron-clad legality of your actions.

@@joshdavis3239 - That's what Kyle did. Defended himself and ALMOST got railroaded. Yes my example works. He's free now but he was put in jail, in seclusion and required a 2 MILLION dollar CASH bail.

The greatest interrogation trick in the book is for cops to act like your best friend, to tell you that you aren’t in any trouble, and that they are on your side just to get you talking. Never, ever, ever give a statement to police or speak during an interrogation without your attorney present. Tell the police you want your attorney and don’t say another word.

Absolutely. I watched The First 48 for years and you saw that all the time. Get if off your chest. You'll feel better. Then you're in handcuffs. I can count on both hands the number of people I've see request an attorney right off the bat. Even the innocent should do so.

Keep in mind too that in at least some jurisdictions, the 9-1-1 recording starts as soon as the phone starts ringing at the police dispatch. Anything that you utter while you are waiting for the call to be answered is going to be on the tape, and can be used against you by the prosecutor. The same thing is true for anything you say while you are on "hold".

Not only are the 911 recorded but any other calls you make are most likely recorded by the NSA (yes the US government) with or without a warrant.

​@@robertyoung9589 Yes, you are quite likely right, but those are much less likely to show up in your trial for defensive firearm use. Is the prosecutor going to hear the 9-1-1 recording from the local dispatch center? Damn straight. Are they going to have access to NSA recordings? Extremely unlikely.

This is why I have U.S. Law Shield. They send you a card to carry in your wallet that has an emergency number and a written statement for the police. I hope and pray I never have to use it but it's worth the few hundred bucks a year for the service. I would urge everyone to get some kinda of coverage if you own a gun. We live in a world where the anti gun nuts want to let the criminals go put punish you for defending yourself or your family.

I really like what he said, it was actually much more you want than just, "don't say anything." He said that if you believe you can follow Massad Ayoob's advice without saying anymore, you should. To me that means it's just something else to train, because I don't believe it's realistic to actually not open your mouth. If you have a spouse or someone else, it's easier, but not everybody has that luxury.

There's some good advice here. Looking forward to seeing the not directly calling 911 after a defensive encounter but rather calling your attorney first and delegating that to someone else on the main channel. This kind of advice is invaluable and we're lucky to have it. Thank you, Team ASP!

Going into this video before watching, I always expected say something like this to the responding officers: "I plan to fully cooperate with your investigation, but I can't answer any of your questions without my lawyer present".

I'd say no more than "I invoke my right to silence and my right to an attorney." If your lawyer tells you not to say a word to the police, the police can say you lied when you told them you were going to cooperate.

​@@bwofficial1776 also something not mentioned in vid. if you start talking instead of invoking, perhaps the police will hear what you said differently than what you actually said. jurors often times will simply believe the police. by remaining silent you much minimize this great hazard. nit eliminate as they could report they heard you speak when you didn't.

Cops and prosecutors are not your friends. Do not talk to them. Keep your trap shut and talk to your lawyer. That advice goes for whether you're innocent or guilty.

Glad you brought up the judge going off on the prosecutor in the Rittenhouse trial. Watching that i couldn't believe he was bringing up him using his right to remain silent in his prosecution. I was glad the judge put him in his place!

This is great advice. Especially when compared to an OIS. My friend was just in an OIS and the aftermath happened exactly the way the lawyer said. We are in NY so they took the investigation to the grand jury so there was no perception of funny business. The combination of the calm statement from the next morning and the body cam footage lead to a 2 minute deliberation that it was justified. We as civilians don’t have body cams…it makes the calm legal counsel enhanced statement that much more important.

I would suggest being careful about any delays to 911 if there are injuries that need to be treated. Even the bad guy. Good idea to have someone else call, but I would argue that calling a lawyer or legal aid before 911 can probably be used against you later. I would also try to render aid if needed once the situation is safe. That will also help later and can be used to show your state of mind at that time.

I had a couple cats that would occasionally wrestle/fight with each other. One of them oftentimes instigated the fight. The other one was bigger and would always win. Though once he got fighting sometimes it took a lot to get him out of fight mode and calmed down. I imagine that can happen with some people. The things they say after a self-defense situation might be interpreted with a poor level of understanding by most people. Remaining silent seems like good advice.

I'd like to see a follow up conversation with the attorneys about the consequences. Say we still get taken into custody because of other evidence. Bond will be, possibly, in the tens of thousands because of the seriousness of the offense, we will lose our jobs because we're in jail, we will pay thousands in attorney fees / retainer. And if / when we get out after trial, we have lost 9 to 18 months of our lives in jail. I'm not trying to be snarky but there are also situations where defenders have spoken to officers and are released on the spot - occasional with their firearm as well. How do we hedge our bets to the one outcome and not the other?

I hear you, but (not my words) even the best, smartest, most amazing lawyers know _that they don't know_ every hook, crook, and trick that the prosecutor/law enforcement will use. Thus, they themselves, remain silent. So, it's okay to be humble; you must think that you can't possibly know all the legal intricacies either. So, defaulting to silence is the safest choice. Sure, you _could_ get lucky. There's videos of murders (later found out) who talked their way out of a police interrogation. There's also a video of an _experienced police interrogator_ (a woman) failing to outsmart an interrogation for murder (she was convicted). Consider 20 months in jail, then being free and starting over. Or life in prison. Being silent gives you the best chance of the former.

Thank yall for this. It is a tough subject because there are respected experts like yall on both sides of the fence on this giving opposite opinions. Andrew Branca and Massad being the two most notable for talking some with responding officers. I guess you just have to know yourself.

That's fair and it's good to have these perspectives. Massad is going from his law enforcement side while defense attorneys are vying for their clients. I'm under no false impression that the law enforcement is going to go after me as a matter of design, regardless of individual intent, so I'm going with the defense attorney advice.

@@latetotheparty7551 yeah, on Massad that is true but Andrew Blanca is a defense attorney that specializes in self defense. He wrote the book on it. Don West, National Trail Council for CCW-Safe, also recommends a limited statement to the responding officers. All of them also point out you have to know yourself and IF you are capable of the limited part of that.

Great video. Good advice, so with all do respect, 3 points. 1. He agreed with Massad, just thought there was a risk of talking too much. 2. I would rather not go to court. If you don’t at least let them know they are investigating a self defense incident, not a murder that could be a problem. 3. Cops are told to shut up and say nothing but they are already going to be assumed to be in the right. If you can’t stop yourself from running your mouth too much I don’t think it’s too much to say one sentence. “I was attacked by him with that screwdriver and those people saw”. One sentence. Yes if you can’t keep it to just that, don’t say anything.

I don't know. I've heard so many times that you want to be the first to call 911 to win that race because the first called is perceived to be the victim. Also, the perp may be injured, not dead and may have unarmed friends or family nearby. Anything THEY say as well as your perceived demeanor can also be used against you. I'd like to know how the lady who recently used her CCW weapon to drop a shooter in Charleston, WV handled it. The cops came out immediately in her favor.

yes I've heard same. Be the first to call 911..... on this channel no less. So I think it's a gut feel. If you sense that you had no choice whatsoever but to save your life with lethal force, I think a short, quick call to 911 quickly and a brief, informative, factual report to responding cops then deferring to your lawyer is the best option. Other than that, like a case where there was some back and forth, alcohol involved, etc..... call the lawyer first. One of my friends had a small party at his house a few years ago when one of his acquaintances stayed late drinking with his wife. The friendly acquaintance became drunk and indignant and was much larger than my friend. My friend had been drinking as well. One thing led to another and my friend shot his friend/acquaintance in his home. Only his wife was the witness. His wife called police, my friend was arrested and was locked up for a few weeks before his employer hired him a great lawyer who got the county prosecutor to drop the charges due to self defense just before the grand jury met. My friend said he was crapping bricks 24/7 until he was cleared.

I’m going to assume it’s the same answer essentially, as a 911 call but feel it’s worth asking this question. I have enough security cameras at my residence such that any criminal activity would be recorded. Any responding officers to my residence would surely notice and likely ask to see the recordings. Should I oblige them or once again respond that I’m waiting for legal council? Legal proceedings would likely require I produce the recordings and any resistance to that request which surely present the perception of guilt, would it not?

I'm no attorney but I'd say speak to yours first and have law enforcement go through the proper channels. The prosecution side of the stat always looks to prove guilt so that's baked in.

Speak to an attorney. Your recording will be evidence and IF you're prosecuted, it will be used against you. The only way it wouldn't, would be if it were stored on, say, a server in a foreign country where a court order would _explicitly_ be ignored. Or, if it were technically impossible through, say, an encryption scheme in which you couldn't be legally compelled/threatened with contempt of court.

Standard, Default Lawyer Answer: Say nothing until you attorney arrives - I give the same advice. The issue is that is not reality. First, most of you DO NOT have an attorney. Secondly, most states have a rebuttable presumption that you acted properly (feared for your life) in your home or vehicle. It is critical to establish some BASIC facts like this is YOUR house or vehicle and that is a bad guy who was trying to do bad things. You CAN absolutely talk yourself OUT of handcuffs (every self-defense shooting does not end in arrest). The issue is that people have questionable shoots so, guess what, the police ask questions.

No. All of those things will be established later. It is not worth taking the risk that you will say something stupid just so you can clear the air right then and there. The cops aren’t the people who you have to answer to it’s the jury and the judge. So trying to justify yourself to the cops and risking saying something that will jeopardize your freedom in the process is just not worth it.

What you say is the difference in going to jail for the night or having a detective call you in the morning. I can tell you from experience that not all self-defenders are arrested. For instance, if you are the homeowner at 2am and the officer makes a preliminary determination of who is the good guy (home owner) and who is the bad guy (guy with crowbar and gun in your living room) you will not necessarily go to jail if everything else looks above board. Same for a Quiki-mart or PCS mobile store owner/employee. So you really need to give basic information to establish who you are and what rights you may have.

How about "I am too shook up to talk right now."? (I learned this from an LAPD officer, top person, that that is what the LAPD tells cops to say. Then in trial that will come up. The jury will see you as someone scared and "shaken up." but no additional info. The opposite of someone "out looking for trouble" is someone who was too shaken up to talk. It is very hard for cops to dispute this. What are they going to say, "no, you are not too shook up to talk?"

A friend and I were camping out on his friends property which was above a neighbors house. The neighbor called the cops on us to see what was going on. My friend could not shut up because he was so nervous. After the cops left I told my friend, look, just answere the cops questions and shut up. We were not doing anything wrong. He should have talked to the neighbor and told him who we were and what we were up to.

As an attorney I have always prepared for this situation by rehearsing what I will say... which is "officer, as an attorney I am going to give myself the advice I always give to clients, which is I'm not going to give any statement about what happened without first consulting my legal counsel." I encourage everyone to go this route. You can just say "I heard a very wise attorney say to not give any statement without first talking to counsel. I am not trying to hide anything or be evasive. Rather, it is just the wise thing to do." Thanks John. BTW give fasting a try ... like a 72 hour fast... for health, spiritual wellness, and physical wellness.

Here is where you’re wrong on ONE THING. the prosecutor in that trial did a GREAT JOB WHEN HE POINTED THE GUN AT THE JURY!!! Why? Here’s why: the prosecutor is the rep of the “state” and he is ti be a “zealous rep for the state”. He was extremely zealous when he out the jury in the eyes of the person being shot at by Mr Rittenhouse. That’s his JOB!!! He overall is obviously a horrible lawyer but he did an excellent job on that one portion. He wanted to scare the jury and he did. That’s what he’s supposed to do!!!

If you do call 911 give the basics (description of your, you are the victim of a crime and to send ems(if they didn't run away) then hang up and reboot your phone to call your legal team whether it is FLP, US Law Shield or USCCA. Phones lock for a certain amount of time after calling 911.

Not to mention, if a cop says "did you shoot the clerk" and you respond with "I shot the clerk?"...Your response might not come off as a question and then they have you telling them that you shot the clerk. Yes, I stole this from the movie My Cousin Vinny lol

True. A crazed speeder (with an extensive rap sheet which included speeding) hit my vehicle from behind (I was in front). The police CLAIMED I said, " I thought there was enough distance when I pulled out in front of her." I was ticketed. My attorney said to me, "You almost convicted yourself." Sort of lost the case. Case was declared "mechanical failure." It's even more unrighteous, but I'll spare you the details.

Same as majority of life. It depends. Few things are absolute. You should never shoot your spouse - unless they are actively trying to kill and you see no other reasonable way to stop them. So even then, it depends.

First time I have heard to Call your ¨Self Defense Insurance¨carrier first. Think this is right, if call 911 they will keep you on the phone, if you hang up, they will call back. Have someone else call 911, good advice.

Never think talking to the police will get you out of being arrested, your mugshot permanently online, awkward job interviews, etc. If you're a lucky shop owner who has a camera system that clearly shows what happened, you might _not_ get cuffed and thrown into a cell. Still say nothing. For most of us, assume you will be arrested and booked. Sorry. Talking is more likely to hurt than help.

I’ve talked to an actual individual who shot an intruder. You have no idea the number of bad decisions you’ll make after a shooting due to the adrenaline dump. Do not say anything to the police. You aren’t going to be the same individual then that you are now reading this.

Adding to the other good observations here: when a cop shoots and/or kills, he isn’t allowed to give a statement to investigators until his union reps are present and he has been debriefed and prepared for questioning( and it’s pretty common for any evidence or video to be leaked to the cop or his representative too.) Why should our response be any different? If that’s the policy for cops- it should be the same policy for all citizens. Don’t say a damn thing until your lawyer shows up and takes over. The cops are not your friends anymore than the DA or the judge ( note: John please pay attention to your audio quality- great content but this is poor quality audio.)

If you shoot someone in self defense and the person is still alive, if you call FLP or your attorney to before calling 911, and that decision leads to delay which causes the suspect to die, you could be charged just because you delayed calling 911.

Cops in on duty shootings don't have to answers after a shooting until they speak to reps and it can be weeks before they make a statements. Just tell them you were defending yourself or another and nothing more.

Remember that the 911 operations center is at the police department so they are de facto “state representatives” so you can also tell them you want an attorney. That way it’s the same as telling an officer because their employers are the same people: the government.

i'm with mas on this one, of course the lawyer wants a clean slate to work with but i'm sure there are many examples of being uncooperative having negative consequences.

Not speaking is not being uncooperative, it's exercising your right. I'd be interested if you could find one example, let alone many examples, of negative consequences for doing so. It's not even about the lawyer having a clean slate, but the prosecutor finding holes in your testimony to discredit you. The state's only purpose is to build a case AGAINST you. Why give them more fuel?

@@IncrediPaulAZ I'm just using critical thinking and trying to look objectively at such a situation. I suppose if you know you're going to be arrested, then keeping quiet makes sense. if you can stay out of jail by cooperating, then that's better, I think. Certainly once you're under arrest, it's time to shut up, no doubt. I'd like to avoid being arrested.

I can’t imagine just saying “I feared for my life” or “I acted in self defense” could get me in trouble…? I have USCCA legal protection and would call the number and keep silence or do as directed by the lawyer, but can saying “I acted in self defense” and nothing else get one in trouble?

@@benhmn the context is early on, right after the incident, so as to not be jerks with the cops, and at least give that statement until lawyer arrives, however long that could take. It’s hard for me to imagine such a statement could prove to be an issue, but then again I’ve never been in such a situation.
