Today, we have 6 hearings covering a 7 month period with
a couple where dad has supervised visitation due to major
mental illness and mom’s been charged with a DUI that will
send her to jail. Dad is pushing for unsupervised visitation
immediately but he recently violated their PPO. Should he have
unsupervised visitation and how long is mom going to be in
jail?

Dad may have been chaotic and mentally ill at one point, but it’s been a year. At what point will they stop punishing him? Besides it’s the mom who’s looking at prison time for a DUI causing bodily injury.

I agree. They won’t even listen to him. He’s done everything right. They are making up stuff to put in the way for some reason. He asked , since he can’t speak to the mom directly, can he get one more visit to replace all the ones he missed because of someone else. Not unreasonable. A small child will quickly forget a parent if not seeing them regularly. Why not give him the one visit?

@@rosemaryus-ct6151 supervised visit part I get. The letting the mom make up excuses so he misses out on most of them I don’t get. If he missed that many, why not let him have a few more? The child is going to forget him and it’s not his fault. She’s taking the kid on fabulous vacations, while the kid hasn’t even seen him at all.

Mr Lawrence is right on. Mom has issues too, and Shane is getting penalized for an under control mental illness. Obviously it needs to go slow and be monitored for both parents.

I think it is ridiculous that a convicted person gets to use their children as a factor in their sentencing. The victims might have children too and easily would be impacted more than 40 days.

You're right, but in the victims situation there's no way around their child being impacted. It's already happened. Also, the child in the perpetrators life has been impacted as well and if they can save a little bit of trauma from another child it might be worth it depending on the entire situation. I hope that makes sense. I'm not really saying people should be able to use their children to get out of things, but finding alternative sentences that might not take them away from their children as long might be helpful just to avoid more trauma to more children.

"Use their children"? Please name one jurisdiction in America that has any guidelines that reduces the sentence because they have children? THERE IS NOT ONE. Certainly some judges might let thatsway them. Just the same as if someone is caring for a terminally IL parent, or any other factor in a person's life. But there is not a box to check that gives them a shorter sentence if they have children.

@@jamesrice4072 there doesnt need to be a "guideline" written. Most women NEVER see jail time behind their crimes. Men are automatically blamed in most situations even unless she's stealing or something. Even then she'll most likely get a bunch of unsupervised probation.

Dad deserves better. Mom was high and drunk. She crashed her car into someone and hurt them. Shame on her for doing this to his dad. Shameful.

How does she have so much control in their case, after what she did??? My God cps involves themselves in wayyyyyyyy smaller instances than this, but yet cps is not involved AND shes calling all the shots, wth is going on??

I lived in Washington my entire life until retirement. I've seen the courts so against fathers rights case after case. When will they understand that the Dad's are needed as much as the Mothers. It really needs to change.😢

I had a friend in Spanaway her husband was fighting for custody of his son from a previous marriage. He had credentialed evidence of abuse and neglect and he still was denied custody. Made me feel so heartbroken for the little boy. My friend just cried her heart out!

A very good friend of mine finally got custody but he had to hire a very good lawyer that cost him over $10,000 and so many court dates along with a lot of creditable people to testify against her. He finally got full custody.

Best part of mom's shenanigans is that the crash took place at 2pm and was severe enough that the other car went off an embankment, rolled onto its side then caught fire. Also, I am an attorney in Washington, where this all occurred and haven't made it to the end, but if there are serious mental health issues it's unlikely that he would get custody and more likely that a family member will be a temporary guardian. Stress can exacerbate mental health issues. They could do a trial of unsupervised visitation, and if he appears, he is stable, granting permanent unsupervised visitation and potentially moving to shared custody. I also just looked into the situation and she received a very small sentence given the severity because they gave her a Parenting Sentence Alterative so she had a 364 day sentence with 274 being suspended (so 90 days and served 30 beforereleaseit appears), then 12 months probation with random drug and alcohol screening.

@deedeebolen I don't necessarily agree that this is the right thing, but it's the law here, so her attorney made a good deal for her. Washington has fairly lenient rules - we have prison nurseries for pregnant women to stay with children in prison if they give birth, and they may move into halfway homes for reintegration. Keeping children with their parents is generally a high concern for the judges around here (and the legislators), to the point we'll keep kids in jail to keep them with a mother.

@rosemaryus-ct6151 that's a primary reason I don't practice family law. Nobody is ever happy with the outcome and parents who probably loved each other at one point will try to take every opportunity to stick it to the other as revenge even when that may not be best for their child(ren).

@@notsparks if they could put their kids first they wouldnt need lawyers. nearly always the hate runs deep. i dont blame u for not wanting to be in that but where would we be if we couldnt find a good lawyer? thank god i had a good lawyer. my husband quit paying the mortgage and thought nothing of putting his four children on the street.

I hate when fathers are treated like this. I think the mother is the worse of the two parents. Mother is doing pot and drinking. That is not safe for the kid/kids. Where the father is doing amazing with everything and should be able to have his son unsupervised. She sounds like the unfit one to me.

This is utter BS. This man has a mental illness that he’s maintaining and meanwhile is doing everything in his power to be a good father. Yes, he slipped up by sending the copy of an old letter to mom. But as he stated, he’s had one minor slip up in the five years since they parted. He should at least be getting the parenting time the judge allows. No one is helping him get these visits. It’s on him to find a “supervisor” for these visits and the judges just shirk it off that the supervisor isn’t reliable. The court should have something in place for this. This child needs his father and he goes weeks without getting to bond with his dad - because no one cares enough to assist. Meanwhile, mom was off drinking and getting high to the point of a DUI with injuries to 2 ppl yet gets a slap on the wrist and all the parent time in the world. Wtf

I find it really funny how as soon as that was brought into this the judge changed her tune, if not I guarantee he would still be going around in circles like he has been for the last yr of videos we’ve seen.

If anyone needs proof of his recovery; all you need to do is watch his demeanor and responses during these hearings. If he was not recovering he could not have maintained his composure time after time as his appeal for more visitation was being repeatedly turned down.

Wow! Her going to jail and him violating the restraining order even though he is supposed to be in such a hurry to see his son. The only good thing about this is their civil and not screaming at each other. The mom is a hypocrite by always saying she is worried about the dad but kind of doesn't think what she does is wrong. Mr. Lawrence is doing a fantastic job. It is a shame that dad relapsed. I am glad the judge made both parents continue to get drug testing. I hope they both get it together for their child. The mom seems like a control freak. I really don't think she wants the dad to see the son. But has no choice.

I try to bundle as many hearings together as I can in my videos as I also like to be able to watch one after the other, especially in this courtroom where nothing happens very quickly, so when I bundle them it feels like something actually happened, lol. I try to do this whenever possible so I'm not usually the channel that puts things out first, but if you watch it here you'll probably get a more complete case. That's the goal, anyway. I also try to follow up on the cases that we are watching and I create a playlist for every case that has an update as well as a playlist for every judge. all he had to do was to have some supervised visits in the beginning and establish a track record of good visits and he could have gotten unsupervised visits.

@@markc13579This! He was granted a 3rd party supervisor instead of at a center, he couldn’t come up with anyone reliable. That was literally all he had to do and he could have gotten unsupervised faster. He had all the excuses why he couldn’t get his shit together and get it done.

Shane should have spoken up and let the new judge know that his time had been cut temporarily so the mom could have weekends too. It is unfortunate that a new judge stepped in. Otherwise, he might have gotten unsupervised visitation.

So dad has been stable and doing good for an entire year and they still aren't giving him adequate time. The court system is absolutely ridiculous because it's all for the mothers and their bad behaviors and never being held accountable.

As a father who was awarded custody after my child's mom had much less severe bad behavior than this (in CA of all places), I don't think it's necessarily a problem of the court system as a whole, rather an issue with certain courts/judges. But in this case, it's absolutely shameful. I can't help but believe if the table's were turned and a dad caused a major wreck while DUI, he'd be dragged through the mud and constantly told to think of what could've happened if his kids were in the car.

Why did it take until last visit for Mr Lawrence to bring up the fact that the mom was just as much at risk as the dad was?! He had been stable for 2 years as regards to his mental health concerns, from the sounds of it, at the time that she got in the DUI crash severely injuring two people. So even at that point she was more of a risk to the child than he was. Seems like the court made Shane jumped through fiery hoops. I think the biggest problem was when the judges switched. I think the first judge would have given him unsupervised visits at the court hearing where instead, a newfemale judge stepped in The new judge evidently didn't do inadequate review of the case. In fact I think the dad would have gotten unsupervised visitation even before, if only he hadn't texted the mom, there by breaking some form of productive order. I think that most of the time the court system works okay, but in this case, they failed the child and the dad by restricting him to reduced hours visitation for way too long, just because the mom wanted weekends also.

the court asked for some supervised visits, once he did that he could have gotten unsupervised visits. He held up the process.

Hopefully you will be able to provide the February hearing for us to watch. I think there’s a bunch of us cheering for dad. I was a little worried about Mr Lawrence’s up until this last hearing due to I felt he was against the dad getting unsupervised but yet mom wasn’t being punished when she had almost as bad of an issue going. If she hadn’t had the wreck when she did then the dad might not be to the point of finally getting unsupervised visits. I also agree with you that the mom is probably lying about how often she’s using drugs and drinking. I’m wondering if they use to do weed together. Praying dad continues to stay on the right track with the restraining order.

Honestly speaking, I feel that it is a bit concerning that he is pushing SO HARD for UNSUPERVISED time. In my case (just personally speaking, but in my case and in my opinion) if the other side/parent pushed THIS HARD about UNSUPERVISED time, the court would LESSEN the time if he did this or pushed this hard. Bipolar disorder can flare or flip at ANY MOMENT!! I think it is a red flag that he wants alone time so badly?? ****I will add that I still am 40 minutes from when this hearing ends from when I wrote this comment!!****

IT IS ABOUT TIME!!! I wholeheartedly agreed with Mr. Lawrence about Shane's rights!! I was a daycare director for 27 years and I saw some of this type of situation. Shane was being raked over the coals when he'd done EVERYRHING the courts asked of him!! He was humble and compliant and still they didn't insist on his time with Abel!! Finally, at about 1 hour and 20 minutes into the video Mr. Lawrence started to nail it down!! Were they volalating his civil rights!?!? YES and YES!!! You go dad!

So I kind of got the mom’s concern in the beginning but after hearing, after hearing where dad sounded completely reasonable, compliant, coherent and willing to do anything the court wanted to see his kid, (drug testing, more doctor visits, etc.) and the court let the mother have input while she was currently charged with drinking and driving and smoking weed that caused an accident that injured 2 people and was facing almost a year in jail, I almost lost it. Then while she was in jail, they couldn’t make changes to parenting time bc she wasn’t there bc SHE WAS IN JAIL! GTFOH!!! Who is she to make some morally superior opinion like she’s some saint??? And every time the dad asked to make up parenting time, she “already had plans”. Sorry, but out of both parents, she comes off as a bitter pos with a vendetta. I don’t think dad said one bad thing about her, did everything the court asked and offered to do more. He deserved his unsupervised time with their child way before it was finally granted. Shame on the court for dragging this out. And shame on mom for being a bitter jerk. Just know that one day, your kids will grow up and they’ll recognize who was being the shitty parent. It’s easy to manipulate toddlers, but not so much when they grow up and can see the whole picture. Stop being childish and put your kids first bc you look so gross to reasonable people.

*FATHERS DESERVE THEIR RIGHTS* just as much as mothers do. Fathers always get shorted in court, even if the mothers are trash. Too often kids get tossed into foster care rather than giving their fathers the ability to parent equally or totally. Fathers pay child support, carry insurance, pay for supervised visits, even sometimes paying transportation costs to see their child or children. Mothers don't get ordered to pay these things as often and purposely make it hard for the fathers to get equal time. It is DISGUSTIG!

1) he's bipolar so there's a safety issue. 2) he has supervised visits because there's a safety issue. 3) he just violated a protective order. no one should be rushing to hand the child over to him. the circumstances are dictating what will happen. that being said, u should know that my son got primary custody of his small daughters when he got divorced; one was an infant and the other was age 2. he got very good terms in the divorce. court is not ALWAYS against a father.

She got a slap on the wrist and hardly an eye was blinked about her having care and control of the child. My dad raised me after my "mother" split when I was 9 months old in 1972. Even then he had to fight to keep me when they divorced. The court was going to just hand me back to a woman who abandoned me while my dad was at work so she could go out with her boyfriend and get drunk and high. She lied again and again in court then kidnapped me. Her father faked a heart attack so she would show up at their house and my dad could take me back. She did not ever visit me and barely ever contacted me until I was 14yo. Even then she tried to lie about what went down 13 years before. I have been a witness for several of my male friends in custody cases. The courts favor mothers even when evidence shows how drunk, high, or mentally delusional they are. One of my male friends was in court every 6 months or so for 6 years trying to get full custody of his 3 kids because they were being left at friend's and relatives' houses for weeks sometimes. During this time my friend didn't know where his kids were often and missed out on his time with his kids. The courts didn't seem to care that these kids were missing school, being shuffled around like pets and not seeing their dad. She was arrested 8 times for DWI, DUI and assault. She was jailed 5 of those times for more than 2 weeks each time. Still the court was telling him to jump through fiery hoops and balance on needles paying child support to a woman who did not care for her kids at all. My friend finally got full custody and his kids needed intense therapy to learn how to recover from all the neglect and cruelty from their mother. One of his kids took his own life when he got to college and was stalked by his mother. She is currently doing jail time for that. Fathers RARELY get equal rights in the court system. Your son got lucky.

The courts that I have been watching really upsets me with the “primary” caregiver issue. The parent that was able to be a stay at home parent because the other parent worked a lot shouldn’t be given primary custody based on being home while the other parent worked. Both parents should be treated equally and the stay at home parent should get a job.

As the judge pointed out in no less than three of the hearings, Dad wasn't making progress in large part because he was failing to file the right motions even after the judge directly explained that he needed to file a motion to place the issues he wanted addressed before the court, and that she literally *could not rule* on the issue he wanted unless it was actually before the court.

Pt3 of my comments on this Case 6 Good on Dad for getting in this paperwork. Now keep on this track dad. Again, dad you're doing great, of course this BMT is not going to agree with what you want. She is in this for control. She wants to control everything you do with this child, and how to control your mental health. Thats right it takes time to get meds right, when dealing with mental health. However, there he is clean and sober, mental health is being cared for, and has not had a relapse. He is doing everything as required and again this should not be a problem any longer. This BMT should have been in jail for the entire 16 months. GAL is doing a great job here. Great to hear the ADA being brought up. This is very well could be a major problem for the mom and her family as well as the court for violations of his civil rights. Have that information sent and served on each other or through the court. Dad stops doing things for the BMT. You do them for you, stop going backwards to appease this horrible controlling woman. Dad go out and get a small toddler bed for your little one. This is a big thing for the courts for the child to have their own bed. Now on the BMT I'm going to tell you this, she is going to disagree with everything, as she would be losing control, and she does not like to lose control or be in charge. Yes, you were in jail, and you can do your own research. Good then testing should be a problem for you to show this to the father. Continue the connection only if she can control it. So, she meets with her probation officer, and gets a UA. Show these tests the HFs are very expensive to do. Meth and coke can only be tested by blood, not a swab. Time to move into the future. Judge time, good on the judge for the granting for the father. Good steps in the right direction in all of this. Awesome Un supervised visits. Every other weekend is a good thing, and daytime visits as well. So it should only be sent to the GAL not the mom, and the GAL is show it at the next review. These test needs to be random, so she cannot prep for it.

Meth and coke can be detected using a mouth swab/saliva test, and actually stays in saliva longer than blood... Cocaine has a detection period of approximately 1 day for blood, 1-3 days for saliva, 3-5 days for urine, and 90 days for hair. Methamphetamine has a detection period of 4 days for saliva, 1-3 days for blood, 3-5 days for urine, and again 90 days for hair. Mouth swabs and blood tests are mainly used to determine recent drug use, but to determine long term use, a weekly UA or hair follicle would be the most reliable... That or a drug test patch, which would show 24-48 hrs prior to application, have a continuous testing period of 7-10 days, is tamper evident, and is difficult to dilute, substitute, or adulterate.... The results of drug test patch have also been upheld by the Supreme Court and is used by many courts around the USA.

Not that the dad in this case was perfect either but it felt like he was really working to control his disease and do what was best for his child and he only got viewed as someone with a black mark because of his illness

Having known a few people with major mental illnesses who had legal problems, the concern of the court wasn’t the mental illness, it was the fact that most people who are diagnosed mentally ill go off their medication several times as adults for various reasons. This means that should the father choose to go off his medication, the court would have placed the child with a parent with major mental illness. There’s a real concern for the safety of the child and the liability of the court. I’m not saying right or wrong, I’m just speaking to reasoning. This concern was reinforced no doubt when father was given more time with his son and his reaction to that was to break the no contact order with a love letter. It shows that any deviation from a rigid plan immediately throws him off course/balance, and since children’s behavior is not rigid, this is a genuine concern. And for what it’s worth, I think mom and Mom‘s family are playing games. She works in a per diem industry but she doesn’t have a phone? Her mother doesn’t know how to reach her, even though her mother has the child, and she lives with her mother? The child is almost always sick on the father’s weekends but well enough to enjoy outdoor activities on hers? BS.

He obviously can’t even get his own mother to help supervise consistently and stepfather has a restraining order against him. He lives in a sober living center and thinks it’s good for the child to sleep. That’s gross!

Dad could probably have had the full 36h per month with his son if he had looked for additional supervisors and then used different ones for different days. But he didn't want that, because he thought that complaining about the current situation would get him closer to unsupervised visits. There is something about his single-mindedness on this issue that I find disturbing.

I am so happy for Dad!! Mom still acts like she is perfect, but she is not. The same way she wants her mistakes forgiven, he does too. The impression that I get is that she's afraid. It's hard to believe the person in this sort of dynamic has really changed, because promises to change are part of the dynamic. The existence of a protection order is a bit of a red flag, but _the first time he has her phone number, he messages her a photo of a love letter?_ Mom obviously has her own stuff going on, but this is the sort of thing you really have to look out for. If things turn out fine, no one thinks about it again. But if Dad decides to punish Mom using their child, this is the sort of thing that gets pointed to with everyone angrily wondering how this fell through the cracks.

Wow! Here is a dad who's there and trying, and the courts have more concern for a mother who shows little to not initiative in life!! The courts are wrong in this case! It is obvious that the court he is dealing with has no respect for fathers, and than she cuts him off like his fight to do better means nothing. I think she does not want him to share his stability. Shame on them. Not only does he suffer, now you have ruined a child's relationship. You have assisted the mother in severing the bond between father and son. Shameful

Father should agree to allow child to stay with moms parents and continue integration. He has issues, goes a long way in agreeing to keeping child in the home he’s been in, and quite frankly the grandparents have been the only consistent an stable people in child’s life

Oh my goodness! The dad never gets anywhere. How in the world does she get to say what happens with this child while being sentenced for DUI and dad does EVERYTHING to make things right and he gets nowhere! This really isn’t justice.

The courts have bent over backwards for mom and taken time from dad for no good reason. So she keeps the child business but then he's sick when it's dad time. Dad needs to find someone reliable for visitation. Mom seems to think that anything she does is ok and forgivable. But not dad.. why isn't mom being drug and alcohol tested? Why is the judge taking away more time? The system is messed up.. she had no issue committing the crime as a parent. 40 days, are you friggin kidding me! So mom got more than 40 days?
