FYI you lose your license for 6-12 months automatically if you refuse a breathalizer. She will probably need to have one installed in her car afterwards as well, which she will have to pay for both the installation and a monthly management fee. The new ones take a picture of you when you're blowing into it, so you can't have someone blow for you.

This is all handled by the state and not the feds, no? So everything you're saying is just what your state legislates and other people's laws will vary within the US.

@@xravenx24fe Pretty sure there are minimum required by the feds. For example, a state isn't technically required to have the BAC limit for a DUI at .08, but if they change it to make it hire, the feds no longer will help fund their road infrastructure.

You can keep your license in many cases with restrictions. Usually an ignition interlock device aka a car breathalyzer..

Each state is different, but DUI's where I live have high fines; often at least $10K to the court, add attorney fees, usually $3K to $5K just to retain them, then there are monthly fees to pay for probation services, substance abuse classes, and u/a tests, not to mention the cost to install a car breathalyzer, which won't let your car start if they have alcohol on their breath. Points vary by each state, but 6 points is a lot to lose. Most of us get one point taken off if we get a speeding ticket, however, we can keep the point if we go to a class provided by the police dept.

Not sure what state that was but if she refused the breath or blood test she automatically lost her license for a year. If she would have taken and failed she woulda obviously got the dui but it being her first one she woulda been able to keep it.

In most Us states, there is a limit to the percentage of tint allowed on the windshield and the front driver and passenger windows for exactly the reason you thought.

Technically, he should let her call a lawyer. The lawyer, if she gets a hold of one, will tell her she needs to take the test.

Amanda doesn't understand that she wass not entitled to a lawyer at that time. The laws are specific, it's called "implied consent". If you drive on a public road, you have already consented to testing if alcohol or drugs are suspected. Every state has different laws.

Everybody loses their license for a certain amount of time. You lose it longer and longer with each DUI. There are quite a few consequences for a DUI in the USA.

it's to gather extra evidence (as breathalyzers aren't always accurate) so they can get a home run in court. Some states you can refuse a breathalyzer as well.

I get where Dave's headspace is at about dealing with the drunk girl at beginning. I can't stand when everyones 2 cents they wanna throw in is something along lines of "She shouldn't even have been driving to begin with." Like, no s*** Sherlock, that could be said about anything. That random person that died in a wreck the other day wouldn't have if they just didn't leave the house that day.....duh, wtf? But once you are in a scenario, like this one, you and whoever esle, is already in it, so why not do everything in our power to attempt to DE-ESCALATE rather than continue an obviously failing approach?
