That is what I was thinking, aren't GYM's PRIVATE PROPERTY and thus you need the GYM OWNERS permission to film and what you can and cannot film will be decided by them? Completely depends on the local laws and culture. @@baraka629 the law about photos and videos (in most western country) says that you can make images in public space (exept military buildings or critical infrastructures) but you cant publicis it without the permission of the person from who it was made. People really don't understand what is consider public space. A building that allows people to come in without being an employee of the building does not mean the building is public space. It is still private property. A gym is private property. A library is private property. A shopping mall is private property. However, these are open to the public (as in you don't need to be vetted to go in)

Gyms are not a "public place" (unless the government is the one providing the service), they are a privately owned establishment by a person that charges a membership to earn money. We don't know if the gym has rules against filming inside and/or other people, but usually they are against it if the person doesn't consent.
Imagine finally gathering enough courage to go to the gym and improve yourself, just to have someone like her re-affirm your insecurities by going like “oh, afraid of being judged? Then go home!”

In her corner of the world you can be smacked into face for acting like that unless you are atractive woman that will be protected by other man in the gym. And Russians have plenty of insecurities, the only consolation for Russian is the fact that every posible type of pathology is the norm in Russia and no one pays attention to it. Last video about Russian gym i saw few weeks ago -> a changing room for professional athletes(real ones) with such a fungus on the walls that you will definitely not see anything like it in the USA...
there is a way, a better way she could've handled the situation: saying "I'm sorry, I bullied that kid and filmed him like a creep, I realize now that the way I treat people needs to change and I'll do better in the future." but her pride and lack of self-reflection got in the way.

I heard the argument of shopping malls being public spaces because they are open to the public. However, this is the first time I've seen someone defending the idea that the gym is a public space. Even saying that you are free to record people. Some people do live in Disney Land.
You can tell someone had no real grounds for their behavior when they go on a long response that repeats things, claims one thing (it's all fine, they are cool with it, they weren't upset about it) and then say the opposite (it's not a big deal, it's only a little mean, you should expect it, grow up), and try to turn it on you (I'm not toxic for judging him, YOU are all toxic for judging me!). Oh, and say they don't care... repeatedly.. in many long muti-paragraph responses (clearly does care). Actions speak louder than words. If you are confused as to the definition of a public place, here's a good shorthand method to guess; if someone besides the government is paying to keep the lights on, it is private. As such, law-breaking in absentia, you are to abide by the owner's rules if you want to continue using their facilities. This can include a blanket ban on recording others.

Let's take her word for it and say she knows him to some extent and by definition he knows her to a degree as well. Just because she is a good athelete doesn't mean she has a professional attitude. Having achievements that most people don't can make a person think they can do no wrong since they're so good.
If she had just said the first part of her explanation about knowing the kid and the context being that she feels like doing the exercises half-assed on a Monday morning, that would have been the end of it. If she'd said that to Joey, he wouldn't have posted the video in the first place. Her toxic nature isn't that she was harassing the kid. It's that she believes that even if she had wanted to harass the kid, she has every right to do so and everyone watching should "lighten up" and just let her bully anyone she wants should she ever choose to.

Wow, she posted a whole essay because 'she doesn't care what people think'. If she really didn't care, she wouldn't need to post any sort of response. She would just move on. If she does actually know the kid, she would tell the kid about the video and ask him his opinion of it. Then if he doesn't like it then she can apologize to him. And if he is fine with it, then ask him to post a video about it so she can link to it. I think a gym (like any business) is questionable on being 'public'. Yes, anyone can get a membership to get in... but the space belongs to the gym company. That means they can deny you access if they deem it reasonable... which means it is their private space that they are allowing you into. Basically, recording people in a gym is like visiting someone's home and meeting other friends of the home owner... and then recording those people. You aren't in public. ----- It gets more complicated if there are big ol' windows facing the street... because visible to the public. But then does that mean if someone's living room has a big ol' window they are publicly visible and therefore considered to be in public, or can they expect some discretion of being in their house they should expect some degree of privacy? Big long rabbit hole that basically requires some lawyer looking up law and case history to try to estimate the interpretation. ----- Anyway, a person in their own home who puts in reasonable effort to stay hidden from public can expect privacy to the point of going full birthday suit at home, if they so choose. Technically, a gym could be a birthday suit only gym, so long as they put in the effort to ensure their visitors are only exposing themselves to each other... no big ol' windows to the public street, and straight up rules against recording on the premises. However, I would recommend against a birthday suit gym... clothing helps keep the dangling bits from getting caught by anything.

Not trying to defend her or anything (would need to look into that particular situation more), but I do have a feeling that particular part of her reply is more of a "lost in translation" case. The correct way to say it would've probably been about the kid neither being disabled, nor sick, but just an average healthy kid. That would be more of a difference in Russian and English languages in that case.

In the clip itself she did notice the kid doing the exercise wrong and the right before Joey appeared indeed said she adored that kid or some like that. It's a bit hard to tell, because the cut in the clip is right as she finished the verb. "Обожаю" (obozhayu) basically means "I like/love(not in romantic way obviously)/adore" depending on the general context. Also tbh people here (kids included) (in former USSR countries) generally tend to be far less sensitive towards many things. Besides, professional athletes often train in gov owned gyms on certain hour and it's kinda possible (not saying that's what happened (would need the full clip for that), but just that it's just possible) that the kid indeed was fooling around not feeling like doing the exercise properly and she just filmed it finding his lack of effs given funny. And trust me, the zero effs given part is very plausible, since I've been a teacher and a homeroom teacher at a state school most of students in which do sports on a professional or semi-professional level and most of the students from the class I was in charge of wouldn't give a damn about something like that (I'm not even kidding, as I at first myself was suprised at how little they'd care about things far bigger than what was in that clip)
A far as the whole "public space" thing goes, most people have no idea what constitutes actual public space. A gym, shopping mall, or ANY place of business is not actually public space. There is a term called "Quazi public" which means the space is owned by someone and the public is allowed to be there, however they must follow the rules that are set by the owners of that space. Too many people assume that they can do whatever they want, but those places are owned by someone and if you do not follow the rules, you will be forced to leave, or sometimes even get arrested.
I don’t know the particulars really of what happened or didn’t happen other then what I’ve seen, but what I do know it when you come out and talk down to people and say everyone else is wrong and tell them to lighten up it doesn’t do anything for your case. I might have listened to both sides of the story if she responded in a civil manner instead of how she did.
