I helped my son purchase a car in California last year and I am now trying to help him negotiate a titling mess.The California owner that he bought it from did not give him a title, only an application for a Duplicate title or Paperless title for California. The name listed as the registered owner was the previous owner from Texas not the California owner that we bought it from. The California seller never titled the car. The title application has the paperless title mark checked. There is a notarized stamp and signature from wells Fargo for release of the lien on the application. My son signed and dated the New owner section with sales price and market value filled in. He paid cash so there is no Lien holder on his end to deal with. He is being told that because he does not have the original title from Texas in his hand that he can not register or title the car in his name. He bought this car 1 year ago and has not been able to drive it. He pays insurance on it to sit in his driveway. He has contacted Texas and San Diego and Wells Fargo and can not get any answers. He can not get the California guy he bought it from to answer him back. He can not find information on the previous Texas owner to be able to contact her. the VIN number does not list the car as stolen. The California license plate that is on the car pulls up the owner as the TExas owner not the California owner that my son bought it from.If any one can offer guidance on how to get this car titled and registered in California we would be in you debt. We also have family in Utah, Arizona, Washington, Colorado,, Idaho, and Florida if there would be an easier way to do it in any of those states. Thank you in advance for any help.
I purchased a vehicle from a company that came with a 30 day warranty. The dealership suddenly closed down 2-3 weeks after I purchased the vehicle so I was unable to contact them about all the issues that were going on. They never notified customers they shut down and filed bankruptcy and apparently pulled their surety bond and fired all employees within a 24 hour window. Again, they never notified anyone I only found out due to my own research. They sold my leased vehicles contract to a debt collector. I filed a complaint with the TN Dept of Commerce and Insurance and filed a claim with the surety bond company but I’m wondering if you can tell me generally if they consider it a valid claim, which I assume they would based on circumstances, what would the expected outcome be? Would filing the surety bond claim provide a settlement that would be enough to cover repairs? I have no idea what to expect because I’ve never been in this situation.
What happens when a defendant doesn't have the money to pay a lower court judgment and then decides to appeal and realizes the only way you can get a stay is by paying the amount of money that he already doesn't have?
