The plaintiff says she was a great tenant and can’t understand why the defendant is withholding her security deposit for no reason. She’s suing for her money back. The defendant claims the plaintiff and her kids destroyed the apartment, and he’s countersuing for additional repairs.

Alot of ppl are commenting on her appearance. I had to check myself cuz it was almost entertaining...until I realized what may have caused that could happen to me or anyone for that matter. We as ppl must remain grateful and humble and not be superficial. 😔

I've never understood why ppl comment on ppls body appearance. Even laughing at someone's style is juvenile in my opinion. Adults are worse for it and I believe adults are why children bully other children. It's a vicious cycle of learning at home and continuing to pass it down from generation to generation.

My Dad had a rental maintence clause in his contract/rental agreement. Once a month standard maintenance and a yearly clause and inspection. If costs to repair, replace found damage was over $100 I. Materials and labor, the tenant was charge for the bill to be paid in 30 days. If not paid they get a warning..then 2nd warning upon3rd warning and eviction notice was sent .

The landlord went in prematurely, I'm surprised he was allowed to keep any money. It would have been very easy to argue that the tenants were going to finish cleaning before the actual move out day.

I'd be a little reluctant to withhold anything from the plaintiff. She looks like she can handle herself. How do you live in a place and never touch anything or scuff the occasional wall? I think landlords should be required to paint over minor scuff marks and have the carpets professionally cleaned before they can re-rent an apartment. It's just the price of doing business.

Most landlord laws are supposed to clean the carpets, replace blinds and re paint the walls after each tenant. Yet this is never brought up in her court. Normal wear on rugs and walls are to expected!!! She gives the landlords to much credit.

It's simple... if they would have had their complete month of cleaning up, they could have taken care of everything. It's not fair to charge them for clean up, when he moved someone else in asap and didn't give them a chance to clean up.

exactly! i said the same thing. he moved someone else into the home on their time, so they didn't get a chance to finish cleaning up. They could have saved hundreds of dollars by cleaning up in a couple days.

@@guineapig4701 I think she’s actually had some sort of impact injury to her face and had bones put back together again. The skin looks fine aside from the scarring (could be from cuts and/or where pins were, too-lacks the “melted” look and fusion of burns), but the shape beneath is off, like a surgeon had to reassemble broken jaw, eye sockets, nose and cheekbones but didn’t get them quite right. ETA: Just got a look at a clear surgical scar across her jaw and I’m even more convinced someone very good reconstructed her facial bones at some point.

"tHE placE waS comPLeTELY trashEd!!1!" says every landlord ever. Then you actually look at the place and its a few scuff marks on the wall, some stickers on a fridge, and some stains on the carpet. Landlords act like every tenant is supposed to pay to completely renovate the entire space after they move out.

Actually, there is. If they’ve damaged the property, or gone beyond normal wear and tear, a landlord shouldn’t just have to absorb that cost. Some tenements abuse properties, and when they do, they need to pay.

You expect brand new carpeting every time you move into a new place? No, it’s not typical for landlords to replace carpeting or professionally clean hardwood floors between tenants. It’s also not typical for landlords to completely repaint an entire unit between tenants. Yes, they might do some touch up work here and there, but if we’re talking all walls and trim need to be repainted, that’s at the previous tenants’ expense (or the previous tenants do that work themselves before moving out). The rental property might be new to you, but if it’s not a completely refurbished unit, you get what you get.

@@naturalbluti6823 maybe a regional thing, but I assume you’re talking about carpeting and not a rug. Wall to wall carpeting in an entire house is going to run thousands of dollars. No landlord is going to replace that out of his or her own pocket every time a year lease is up.

Unless the carpeting is completely trashed or over a certain number of years old (depending on what state you live in) no landlord is going to replace carpeting between each tenant, especially if it's got a high turnover rate.

I don't expect a landlord to replace the carpet but it should be a RED FLAG if the landlord DOES NOT paint or get the carpet professionally shampooed in-between tenants!! That is just veil to think a landlord is that cheap that he would NOT do that! When it comes to building apartments it is MANDATORY to do so! So when landlords rent apartments in houses they shouldn't cut corners because that is how possible infestations can start and the new tenant may want to bring a case! I'm from NY and I've seen it happen with my neighbors.

I don’t get it…if a tenant stays one day in a month, the judge says they owe rent for the entire month! But here the landlord locks them out for half a month that they paid for and the judge prorates it and only returns half! What happened to “what’s good for the goose, is good for the gander”?? hmmm…

You must not watch a lot of these episodes. It's pretty easy to figure out. Most of the time tenants move into a place on the first of the month. It is uncommon for a lease to start later in the month. Because of that, when a tenant stays a day late it makes it much difficult to get a new tenant to come in for that month. Although, if the landlord does get somebody in partway through the month they can only charge the previous tenant for the amount of time that apartment was vacant. And in this case, the tenants only got back half a month because they were still using the place for the first two weeks and locked out the second two weeks. You still need to pay for what you use. Courts make you whole; they don't exist to give you free rides

In PA, when tenants move out an apartment the walls must be painted and carpets must be replaced automatically. Those are not items you can sue for

The owner needs to repaint and repair everything...even cleaning...has to plan on WEAR and TEAR of each apartment. To get money for painting...which EVERY landlord needs to do anyway is unacceptable...the JUDGE was wrong in this case....and I usually think she's RIGHT!!

Landlords are not required to repaint between tenants. If you leave an apartment in need of repainting, expect the landlord to charge you for it.

@@mikesteele05 Hi Mike! I would NEVER move into ANY house, condo or apartment that wasn't freshly painted. It doesn't concern me now but in the past each and every dwelling was freshly painted...and the landlords did it automatically....they felt that their new tenants DESERVED the ENTIRE place to be as new as possible....if it wasn't painted then I wouldn't move in! Didn't know landlords could get away with NOT painting the place. I also had brand new carpeting in EVERY place I rented! No paint and no new rugs meant...."DO NOT RENT"!! Thanks for this info!!

@@joannekaczan6615 this will not happen in the vast majority of instances. You must be moving into newly refurbished places, and you’re paying for that. New carpeting for an entire house is going to cost upwards of $10,000. If you move out of a home after your year lease ends, do you think the landlord is going to rip out that year old carpet and spend thousands of dollars to replace it for the next tenant?

Just watching past cases it’s interesting to me if a tenant stays past the time they are suppose to be out even if it’s by a day they have to pay rent for a whole month. But if the landlord locks you out and you paid for a full month u only get a prorated amount back. 🤔

So I'm confused there is such a thing as normal painting and wear an tear when you move out of an apartment. I've heard this Judge yell at landlords that they don't get to keep security deposits for normal wear and paint. So why is this case different? Smh

Because in civil court all these decisions are up to the judge's discretion. Unlike criminal court where the judge has to follow strict legal guidelines and protocols

Normal wear would be something like if the carpets are 15 years old and are just generally worn looking and need to be steam cleaned or replaced. That’s how long carpeting usually lasts, so it’s expected that they’ll be worn looking. So that type of routine maintenance is up to the landlord. The landlord will want to clean or replace the carpeting in order to maintain or increase the rental value of the property. So that’s not a previous tenant’s responsibility. But let’s say there’s a giant stain in the middle of the carpet from where a tenant spilled something. In that instance, it’s not normal wear; it’s just a stain due to the tenant’s negligence. The landlord is essentially forced to clean or replace that carpet in order to make the space suitable for renting again. In that instance, the previous tenant is responsible for paying. When it comes to painting, there’s not cut and dry criteria. A landlord isn’t going to be able to justify repainting the entire apartment at the cost of the previous tenant simply because the tenant leaves one scuff mark on the steps. But in this instance, it was clear that the steps and interior of the entryway needed to be completely repainted, because the tenants had thoroughly scuffed up the walls. They may not have done it purposely, but it was enough damage that a landlord would need to repaint in order to rent it out again. So it’s really up to the judge to determine if a landlord is justified in keeping a security deposit.

@@mikesteele05 this case was unusually short I didn't hear her ask questions like how long did they live there, did they receive a letter stating what the damages were and what the deductions were for deposit within 30 days. At first, I assumed she didn't ask any of the questions bc the landlord violated by locking the tenants out early, and bc of that the case was an automatic win for plaintiffs. The walls didn't look terrible, painting is considered sanitizing and is required where I am from bc of that, and in most cases, I've watched the judge deny money to be allotted for painting. Even when there were swiss cheese walls in some cases bc ppl are going to hang pics, decor, and electrics. In my opinion, the walls didn't require a loss of money for renters. Now the carpet yes. However, there is usually a process the landlord has to show they had it cleaned and the stains didn't come out and so now it needs to be replaced. I didn't hear her ask for receipts for carpet or quotes for paint or for hiring the painters. It was an unusually short case. I commented that myself. Maybe they ran out of taping time or maybe I missed those questions.

@@aprilpinkelton4385 my guess is this information was all in their written statements. The judge generally asks questions to which she already has the answers in written statements, just so the cases make sense to viewers. You notice that a lot of times, she’ll ask a question, someone will begin the answer, and then the judge will finish answering to speed the process along. I’m sure in the written statements, both parties confirm how long the tenancy lasted. As for the painting between tenants, it’s not legally required in the vast majority of instances. When it comes to keeping spaces sanitary by repainting, that’s really only in regards to kitchens and bathrooms, and repainting isn’t the only way to ensure that the walls are sanitary (it’s often just the easiest). But yeah, if you put holes in the wall to hang things, it’s your responsibility to either appropriately patch and repaint those walls, or the landlord can withhold some of your deposit. The judge won’t demand that the walls look brand new, but they need to be properly patched and painted.

Tenant should do a walk through before moving out. That way, the landlord won’t charge for stuff, because he’ll be afraid the tenant will stay and he’ll have to evict. Now the landlord can charge for whatever he wants, for whatever amount he wants. However the tenant, if they overstay, risk losing their reputation.

To remove stickers get a hairdryer and warm it up first (warm not hot) They peel off quite easily afterwards.

Why why can no one take pictures before you move in and then when you move out. This have saved me soooo much money moving out. Everything should be in writing and never ever verbal.

Hmmm, wait a min where do they live?? Bc in most cases unless there is severe damage to the walls and carpet they don't allow the landlord to keep money from the deposit for walls and carpet. I didn't see any real damage here. Secondly, they locked them out and so that should have eliminated him keeping any monies. Also, was a letter sent within 30 days stating why they were keeping their deposit? This case in my opinion wasn't handled properly and she went through it quickly. I am curious as to why rant out of time? If nothing else this is entertainment so for that purpose asking those questions or the plaintiffs putting a better fight for their monies would have been a good idea.

The defendant should have assumed responsibility for all charges considering the fact that a lock box was placed on the property before the end of the term. That prevented any repairs from being made.

Carpet cleaning and painting is natural wear and tear who’s going to move into a home with dirty carpet they would have had to clean the carpet for the next tenants anyway

Stickers are EASY to remove. Had they used a hair dryer to warm up the glue. The stickers would've lifted off easily. Then any minor residue would've come off with Goo Gone or even a simple alcohol wipe. I would've used a wet magic eraser to clean the wall & baseboard markings.

I'm confused 😕who takes a video of an apartment half-way through them cleaning it. The tenants had me so confused first they said they were not done moving then they showed a video to confirm they were moved and the apartment was clean.

I'm disgusted that the judge didn't just let the plaintiffs win the whole case when she was told they were illegally locked out of their home and forced them to pay for "damages" that is everyday wear and tear... literally she went from a decent judge to Judge matthias with the way she talks down to people and intterupts them when they are answering her questions

Maybe the laws are different from state to state or landlords have different rights but let’s say she only stayed one day in the month of November he would be entitled to the entire month of November’s rent so why should she not be entitled to all her rent for November back.

Exactly! Yeah judge Judy would have never had them charge for paint. Most places you have to repaint every three years anyway. And if they were locked out they weren’t given a chance to clean they still had a week left to clean the apartment.

lady do you know carpets on a rental house only are supposed be 6 years? paint also need be done when new tenants sign a lease, the paint on the stairs is very normal to be marked, again if there is no holes they cannot charge for paint, you should consult with a contractor before those judgements

The tenants provided the proof that allowed to him to keep it. I didnt hear her ask how long they lived there. The carpet is ruined. Not every landlord repaints

I a my self a landlord and I would never make them pay for those things, if they stayed 3 years at least

They tried to withold a deposit on my Brothers flat when they moved out because it "wasn't vacuumed", despite me personally doing a full carpet clean (with professional chemicals), my Dad remarking on how much better it was (he used to train cleaners and check the cleanliness of schools and other council properties in the areas and has a degree in cleaning so it somewhat an expert), and the carpets were significantly better than before they had moved it. Turns out the estate agents and their "independant inspector" were different parts of the same company, and a strongly worded letter written by his parents was supposedly not read by them as they were not the renters yet they got their money back pretty quickly after the letter. I would have loved it to have gone to court as I would have thought that any evidence they claim proves their point would be easily rebuked by someone who was not only a professional cleaner but who has been an expert witness due to cleaning issues in the past. "well our expert has had some generic training to inspect houses", "Well I was a professional cleaner and have a degree in cleaning". I know which one I would trust more on cleaning matters!

if I were a landlord I wouldn't have white risers on the stairwell. No way. I have light coloured risers and they may as well be black. My husband wears slippers with rubberised souls and they are forever kicking at them. He can't help it he has bigger feet.

Those marks on the carpet are not stains. It is more likely a spot where the person left the vacuum running while they moved something out of the way. And the vacuum left those marks in the carpet. I have been a cleaning lady where that happened to me, & seen it happen to others.

If I ever rent out any of my properties everything will be in writing and signed,there will be a contract wich will include stipulations on security deposit, they need a notarized letter from previous landlord and 0bk round checks. Nothing in text or call if it's not face to face in writing or recorded then no. Sorry but renting and being a landlord or tenant I'd do this way so I know if there's ever any issue I have proof and ways bring a person with u for walk threw before and after the move and always ways take pictures of everything like everything before u sign the rent agreement and after so u get deposit bk. Be smart cover your butts on both ends,landlord or tenant

I used to really love this show and I really liked Judge Milian a lot, but the last few years she's become increasingly rude and disrespectful. She assumed that the Defendants were married, and when he corrected her and told her that they were brother and sister she said 'that's weird' and 'Game of Thrones' under her breath 3:25 - 3:35, as if to imply they were incestuous. I really don't get why she's so rude sometimes.

It is true that the Judge at the beginning of her time on this show was more calm and polite. She would listen more and explain especially with Spanish expressions to get her point across. Too bad that somehow she thinks she needs to behave this way.

Well said Davies and Tom because its so true, I feel she has changed so much and she has such a smart smug mouth now, her character and how she behaves is of low character and I find in a lot of the trials she gets it wrong! I know she studies the cases the night before and makes her ruling however I believe if she comes across someone she doesn't like, she might change her ruling on the day of! The lady decided to move out halfway through November so even if he started painting & changed the locks they still allowed her to go in and retrieve things and take photo so she either should get nothing or I think he should only pay back one week rent not half.

Before they even moved out, the landlords were going to paint anyways...That's the whole reason why they entered the place earlier when they were supposed to... So why do they have to pay for the paint?! And like someone else said, maybe they would have cleaned up better if they had the whole to do so. And the sticker on the fridge.. the landlord said he tried everything to get them off.. but the picture shows the stickers barely even touched.. I'm surprised the judge didn't say anything about that.
