Advantages of SSDI Over SSI

As you may know, Social Security offers two different disability programs - one is called SSDI (Social Security Disability Insurance) the second is called SSI (Supplemental Security Income).
As I discuss in this video, there are several significant differences between these two programs, the most significant being that 99% of the time you will get more money under SSDI than SSI. SSDI also makes you eligible for Medicare as opposed to Medicaid for SSI.
Generally you will be eligible for SSDI if you have worked and paid Social Security taxes for five out of the past ten years - but eligibility can vary. SSI is generally available only to applicants with very low income and assets. Here, too, eligibility may vary. That’s why I advise my clients to apply for both programs when they start the disability process.

You are extremely knowledgeable in SSDI & SSI. A year ago, I turned 30 and was making an immense living as a model, which I loved so much. On that same year, I had a mini-stroke that resulted in numbness on the right side of my body and now I use a cane to keep my balance. I applied for SSI because I knew I didn't qualify for SSDI and I didn't earn enough work credits and didn't reach retirement age at all. To make it short, I got an awesome lawyer to handle my case, got the notice of decision in the mail, the ALJ found me fully favorable and now I'm getting my SSI benefits (although I miss modeling so much and now I can't do that anymore). The current maximum amount of SSI is now $771.00 a month and I'm perfectly fine with it (I'm also getting a lot of back pay, but due to the amount being so large, the law won't allow them to give it all in one lump sum, so I'll get it in installments, 6 months apart).

Penalizing someone for being married is cruel. A sick person on ssi needs their benefits which include medicaid. They are disabled same as those on ssd. Why does spouse income count for ssi but not ssd. It should not count for both. I have heard people talk of killing themselves as a result of this. This has to stop.

3:50 Hi Jonathan; not to nitpick as I understood what you meant but I think you misspoke about it being $733 x 5 for a total of $3500 per month vs. $3500 total for the whole 5 month period. Thank you for all the good info you share.

Thank you for clarifying the concurrent SSI/SSDI approval situation. I just recently got a fully favorable decision and have been told that I qualify for both but nobody can explain what that means in a way that I understand until now so thank you for the clarification.

I also apply for both because my SSDI is so low but because I get SSI too I assume I'll never be able to invest or own any cash value over 2000 dollars which is usually not the case with SSDI usually you can have over 2000 which is depressing because I would like to try to invest 50-75 dollars a month in a stock of sometype.its so confusing.

I am 55 y/o, and I worked many years as a certified public accountant after my diagnosis of Multiple Sclerosis at age 26. My disease progressed, and I applied for and was awarded SSDI benefits in August 2018 at age 54. I did not WANT to apply for SSI because I was aware from the beginning I would not qualify for SSI due to my 401k balance, but unfortunately my local social security office applied for SSI on my behalf anyway. As expected, I received my denial letter for SSI within a short period of time. I just don't understand why SSI was able to send ME a rejection letter early on in the process, but now SSDI is withholding payment of my retro benefit until they can verify I NEVER receive any SSI benefits. I will receive my first monthly SSDI check in 15 days, but no word on when I will receive my back pay. Hmmmmm, I just don't get it. I know I will eventually get paid, and for this, I am truly grateful, but the additional delay is silly in my humble opinion. As a side note, I filed for SSDI without the help of an attorney, AND I won my level 1 appeal without the help of an attorney. I probably will not hire an attorney at this point even though I am certain an attorney could handle this minor issue more quickly than I. In the mean time, I just WAIT and WAIT and WAIT until the left hand can talk with the right hand at the Social Security Department. SMH :(

Dori, it took me almost four years to get approved for my SSDI. I have a traumatic brain injury and most of the time I look and sound normal but I am far from being a whole person. I had to prove my case and exhausted my 401k. It is a process but your medical records and the depth that you have tried to stay employed carries all the weight.

@@LouMontana-wc7nrHere are further details on my case. I finally did win approval for SSDI, and the associated back pay. It took me about 20 months to finally get my case settled. I received my retro pay about a month before I received my back pay. When I inquired about the back pay, their rep said they were withholding the pack pay until they could verify that I had NOT been receiving SSI payments - 🙄. I had received an SSI denial letter over a year prior. Lucky for me, I kept that SSI denial letter and drove it over to their office, and the released my SSDI back pay within ten days.

@@dorib82, I am proud of you. You still have a very good brain. It took me me nearly five months to get my back pay. All because of the name of my credit union. They are owned by another company and all official business must have their name instead of the local name.

Prior to the car accident I made a very good living. I had been single for ten years and owned several very expensive collectible cars and motorcycles. My neigbors hated me. They were very pleased to see me sell my cars and most of my bikes. That money carried me through the four years of no pay checks. When I got my back pay a close friend of mine, who owns a body shop, painted a very nice 2010 SUV for me. Now I am the ultimate welfare pig in their eyes.

@@dorib82, We live in very strange times and no matter how bad your heakth issue is your neighbors will always tell you they have had it worse. I worked two jobs for four years to payoff my daughter's medical bills. I always kept track of my hours on calendars. Several years later I found those calendars in a box. I counted my days off. One year I had four complete days off. The following year I had six. I was a city patrolman/cop full time and I was a full time aerospace technician and I contracted cement work and remodeled and sold houses. I also promoted a patent. I did not count the twenty years of having my remodele business. I paid cash for most of my kid's college and I live in a debt free home. I mow ly lazy conservative neighbor's lawn because I hate to see our street go to hell. Still I am nothing but a welfare pig!

SSI is harder to get , has restrictions . You can not have more than $2000 in a savings account You will be penalized for any extra assets and as of 2020 the amount is $783 a month .A pittance

Yes, it is a small pittance but its all many people will ever get, since they don't recognize real knowledge in this society. You can have more than $2000 in assets, but you have to be able to justify lying to the fascists!

SSI asset limits are ridiculously unfair. Waiting 2 years for medicare on ssdi is killing people. I was stage 4 cancer. My ssdi put me over the limit for medicaid. If it weren't for family members chipping in to buy me an Obamacare plan, I would be dead. I also qualified for compassionate allowance but they fumbled there and had to wait the full six months. They did not care. That was 5 months of payments I lost and quicker access to Medicare. My cancer had grown into my skull by the time I was able to get to treatment. They seriously need to overhaul their system.

College degree, 6 figure career in operations management in the oil and gas industry, big suburban house in the highest property tax area in my state, but as soon as I got sick and lost it all, that was that. Savings were gone in 4months. I had stage 4 cancer and not a penny to my name, but because I didn't have children, wasn't pregnant, and not a drug addict, I didn't qualify for medicaid. I can't imagine what I paid in through out my career, but when I needed it, it wasn't there.

I got the hearing today and I got denied in the spot. But the ALJ was so nice and explained to me why he denied me. He said that I have no enough work credit. So instead he told me to apply for SSI and my medical records says enough that I’m disabled and can’t work. So, you mentioned in SSI if the husband is working you got no benefits. In my situation my husband is retired and we’re not leaving together, we’re separated but he pays the rent where I am staying and he’s not getting a lot of money from his retirement. Do I have a chance to get the SSI benefits? By the way, I watched all your videos many times and thank you.

My SSDI was approved in 6 days because I have a cancer diagnosis and met their criteria. I filled out the application by myself. It was tedious but easy. The doctor cannot say you are disabled--medical records are reviewed which is the determination. You have to wait 5 months after what they determined you were disabled (last day you had to work and go on FMLA). They do not backpay during that wait period and you get your first check in 6 months. I rather be working but I can't. Even after a 11 hour surgery I'm getting daily radiation and chemo. Cancer stole my life and I never drink, never smoked, kept my weight down and rode my bike daily for years. I still got cancer. Life can really suck, but at least I won't go homeless with SSDI.

The Judge at the hearing for SSDI ended up changing the dates of my disability therefore making me eligible for SSI......my attorney is appealing it. It's just nonsense, I dont quality for SSI.

Hi Jonathan, I just watched your video on SSI and SSDI. If a person becomes disabled and hasn't worked since 2009 does that mean they can only file for SSI even if they worked all their lives?

Hello Johnathan, I was injured and put on disability now that I am at FRA I wish to apply to SSI, Iwas told that I would get the same amount of benefits as on Disability, My AIME is at $39,368.00 I don't think it is fair that I paid so much into SSA and be reduced because of my injuries.

I truly appreciate your videos Mr. Ginsberg! In Georgia there is a program called "Ticket to Work". The program allows you to work, if you can, on a job that does not do further harm to your disability. What should one be aware of with such a program? Of course this is part time work or seasonal work. Thank you in advance.

Yes, Crystal, Ticket to Work is one of the work incentive programs. Another is the Trial Work period. I would not hesitate to try either or both. SSA is putting more effort into cutting people off so (1) if you can work, you protect yourself and (2) if you try but can't that is good evidence of your good faith efforts. I am in Atlanta myself, although these work incentive programs are national in scope.

I was ill 9 years old with panic attacks,and agoraphobia,homebound by agoraphobia at 15 years old. I filed in 1975 at age 18. My records of 5 years seeing a psychiatrist was sent to them. I couldnt leave my home,and only could find a physician to come to my home. I got refused .they saw my doctors records. My father supported me,i never worked. He claim me on his income tax .i filed again at age 27 years old,i was thrown on SSi.They lied they said they didnt see my doctors records. the doctor is deceased,and his records destroyed. I was thrown out of school at 13 years old,due to my illness. I believe i was put on the wrong program. Believe i belong on SSDI,under my father earnings .is there anything i can do? I receive $800 a month,and can not pay rent ect with that amount. Its not enough.Im still homebound since 15 years old . And have other physical health problems now.

That is a common problem. However, on SSDI you would have to pay medicare premiums. The most important thing you can do now is make sure your father sets up a special needs trust for you.

Medicaid will supplement what Medicare doesn't and also pay the monthly premiums.

The company I work for, offers free long term disability checks which are 60% of what I make. Would I still be able to get SSDI with that? 60% would be 1,500 every two weeks before taxes

I'm 58 disabled for some time now I never married and I was under the impression that I could possibly claim benefits off my mother's Social Security I haven't worked in a long time and I lived with my mom for 12 years she had to wear and stayed for cancer for three of it and she was worried about what was going to happen to me which passed away and she was right to worry I'm just suffering so my question is is it possible for me to claim survivors benefits from my mother she worked hard all her life and made a lot of money and she she only claims benefits for 3 years or maybe no she works like 2 that's 3 years she had over encounter actually she only she only claimed benefits for 1 year so all that money she paid in I'd like to claim it I'm her daughter the baby of four and she would want me to have it?

In the event of a divorce a disabled person will then be left not only sick but homeless with no income and no insurance. If the marriage is abusive the spouse will be at the mercy of the bread winner. Dealing with illness and abuse at the same time, is that right? This is America?

My disability may be related to a military incident. I have won my SSDI case after a 5 year struggle. I would like to know if I also win my VA disability if it will affect my SSDI payment amount? Or is a veteran allowed to receive both military disability and SSDI disability payments?

There is no simple answer to this question. There is the trial work period issue and the substantial gainful activity limit issue. Here is a recent video I recorded on this subject: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-orenDPq6GIU.html. There are no dental benefits with SSDI.

I had Aneurysm open heart surgery, Kidney tumor tye 2 diabetes, A fib Was denied SSD, They said my illness was not life threatening, Live in a broken down car 😢 A 19 year old goes in with his mommy, Healthy and told the case worker he was leaning disabled and he couldn't sleep and his tummy hurt, He got approved will be going jet skiing playing video games and going to spring break, He will be getting 2000 a month, I will be going to my early grave ⚰️ 🪦

I believe you look up the info in Google. The full retirement age is 66 if you were born from 1943 to 1954. The full retirement age increases gradually if you were born from 1955 to 1960 until it reaches 67. For anyone born 1960 or later, full retirement benefits are payable at age 67.

I am 45 I am an ESRD patient on Medicare and Medical. After about 3 years of not being able to find a job because of my circumstances always in the hospitals doctors, and dialysis I finally applied for benefits the ss office took my application for both SSDI and SSI apparently I qualify for both. What's the pros and cons of taking both?

When you apply for both it is called a "concurrent claim." SSDI is usually higher so it will offset SSI. However, sometimes you can get SSI during the 5 month waiting period for SSDI and in rare instances the SSDI amount is below the maximum SSI amount and you can collect both up to the SSI max.

At your full retirement age ssdi just turns into ss retirement. The money stays the same, actually you're getting fra money right now. That's all you have put into the system

I was approved for SSDI with enough credit for a little over 2K a month, but weeks later, I received another letter about being approve for SSI as well! I have an upcoming phone interview to determine how much benefit, according to my updated income and resources. How does it happens? I don't want to loose my SSDI benefits. can you advice? SSDI will offset your SSI. Since SSDI is usually higher that SSI you will likely end up with only SSDI. YOu may be eligible for a few months of SSI during the 5 month waiting period for SSDI.

Yes SSD is by far the better SSDI is 3 * your Social Security you write Boston they'll write you back and say if you went today yes Social Security will be and your SSDI will be and all the time the SSDI when I got on Social Security was 400 back in 2009 SSDI was 1200 and it's going up to 1631 so I was sitting with Social Security is like 550 so SSDI is three times its Social Security and Social Security Boston will write you a letter and tell you did your Social Security will be and your SS ID I will be and it's three times your Social Security right

That is correct most of the time. Generally SSDI is higher so after the 5 month waiting period the SSI will usually be totally offset.

I get 1,317 in SSDI been kicked off twice but only for a month than they put me back on SSDI . Plus SSDI we can move out of the country to a place that excited social security .

Yes I have applied for social security disability because I have work from Junior high and tell graduation and was still I apply for social security disability next thing I know they was giving me SSI and I did not apply for that I feel that I'm getting ripped off I have had caseworker tell me that I can get my retirement because of the time I have work what can you tell me about that and I have all the paper that they denied mean social security disability

I was hurt on job in 2013 in 2016 three knee surgery later received a medical retirement from state of md after knee replacement in 2016 started my own business pilot car driver now been off work for 4 months was in auto accident working now have 2 herniated disc and with my knee replacement not in good shape do u think I would qualify for ssdi I'm in therapy for disc and have had 4 injections plus I also have spinal stenosis

You can but you may be asked to explain how you had the capacity for this type of excursion if you are disabled. Plus you would bee foregoing medical care for a year, resulting in a gap in your medical record.

ive been on ssi and ssa since i was 18. i started working part time and in a year or so i should qualify for ssdi.. the only thing is.. im scared.. im only making like $400-$600 a month.. if they base the ssdi off my earnings would it be possible that the ssdi monthly payment is less than the ssi one? i dont want to break my back working so i can get ssdi, just to find out they will give me less each month...

I just received SSI for another 3 years, but yes we're quite limited. I received 733$ but now 780$. Although with cuts on EBT, because of the slight increase. But the bad news is every year I have to find a new doctor, because the previous one let's me go, because of my insurance. But also, we're limited on seeing certain type of medical physicians yearly and Walgreens doesn't accept our insurance anymore, so now it's only rite aid. Oh, the 2020 Stimulus package ssi isn't going to receive any money, unlike 2009 when we receive a one time 250$. Lastly, Trump authorized stricter restrictions on social security to be reviewed from 2020-29 so folks are going to be monitored like never before and that's why you're recieving reevaluations starting this year

But I'm gonna use the programs they offer like vocational working program. So I think we all should once we're able to be mobile, by not limiting oneself to low income living for longevity.

SSI is better because you don't have to pay medicare premiums and copays. You need to find a good medical institution you can stick with. SSI people did receive the $1200.

you can work part time and get ssi.. ive been doing it for almost 4 years.. i recommend that you look into other gov programs as well.. Affordable Housing is great as my rent is only like 350 a month.. there is a program for cheap utilities.. salvation army will even pay your utilities if you show them a shut off notice.. you can also get scollerships for school and they dont count against your ssi im pretty sure.. and i used to eat free church food when times were harder..

Tis ironic, one can get the same amount of Social Security Disability Insurance aka SSDI as one can get on Social Security Retirement. The difference being is SSDI is not considered income, while Social Security Retirement is considered income. If both were to receive for instance a thousand dollars a month, the one on SSDI would be entitled to various state and local programs because they legally have no income. Where the one on Social Security Retirement may qualify for some programs, they are dramatically reduced. Assuming both are single, If the one on SSDI were to receive more than $1,016.67 a month, they are not mandated to file income taxes. If the one on Social Security Retirement were to receive just eight cents (0.08) more a month; They would be required to file income taxes. And because they fall into the next tax bracket, though it would be little, owe taxes. Thus in addition to the availability of state and local giveaway programs and the fact that anyone on SSDI is allowed to make a wee bit of money which is considered income but because the amount is so low, they are not required to file income taxes. Makes out considerably better than one on Social Security Retirement whom doesn't qualify for state and local giveaways and if they do are limited as to how much of the program they are eligible for; And cannot make any more than eight cents a month without being mandated to filing income tax; In which case would have to be paid from their monthly benefit, thus reducing their spending ability. Hence the reason, the number of individuals receiving SSDI is growing exponentially larger and larger every year. Tis ironic how I'm listening to numerous individuals on SSDI weeping about not getting a stimulus check until long after everyone else got one. When unlike an employed person whom is no longer employed and doesn't receive any money, the person on SSDI still get their monthly benefit check on time. Thus making a stimulus similar to extra icing on a slice of free cake.

Most welfare programs are determined by means testing, so the source is irrelevant. If you are retired and over 65, you become eligiable for these programs under Old Age status. The assets of people receiving SSDI will usually put them over the eligibility.

I don't want to sell my house, which I spent 20 years paying for the day that I do not have to pay for anymore, spend all the money on rent and then when I'm broke apply for assitance. Because if I own my house, it has value. And thus I don't need any assitance until such time as I have nothing of value.

Lots of people lie to get SSDI. To my understanding, SSDI is disability. You have to say you can't work due to physical, mental disability. This does pay more. But if you reach the age of 65 and you want to draw your social security they also go by income but the person gets very minimal.

Yolanda, you don't get Social Security disability based on what you say - you have to prove to a judge that you meet SSA's definition of disability (see bit.ly/2sQvtat). Retirement Social Security is based on your age and the amount you receive is calculated based on what you paid in during your work life.
