Alec Baldwin , depended on others for gun safety . How would he know there was a live gun. What about the other woman that threw all the other pullets and the man that sold the pullets , he had a mess on the home, so how you trust a man s home then he cleaned all the pullets. What can you do when you think others are doing their job to prevent accidents, but they do not do their job cause then there are excuses . who fault it is. Alec Baldwin, is not a murder, he would not kill a fly.

@@corinaalvarado2649 They are arguing that because he was a producer on the film, he was responsible for hiring the people in charge of overall safety, including the armorer, and for making sure that the New Mexico regulations were being followed because, as we’ve learned in this case, those rules override the film set ones. Sounds like they’re not allowed to do that now (argue with respect to him as a producer) so that may be a moot point now. He can still be found guilty of manslaughter - the whole point is that it’s an accident, not intentional.

I thought the prosecution did a good job in the Gutierrez Reed trial and the outcome was just. I look forward to hearing the evidence in this trial. I do believe Kari Morrissey often has too much an adversarial and condescending tone to her remarks. It’s so off-putting.

@@ATChick All guns loaded with blanks can never be aimed at people - real actors have died from believing that blanks wouldn't kill them. The blanks don't contain explosive material, but a blank is still a high speed projectile. Alec must've known this, it's common knowledge in the movie biz.

Actors do not check the gun. They have gun experts that do that because most actors are not knowledgeable about guns. The gun expert checks the guns before they are handed to the actors and the actors do not check it again. It is the gun experts job to check the gun. So those saying he needed to check the gun again...no he did not need to check the gun again.

"Producer" is a fluff title. Normally there are one or 2 actual producers that manage the business of the film set. Actors like to be called producer because it has certain perks on the back end. Better residuals, if the film gets sold you get a bigger cut, things like that. It's like getting an honorary doctorate. Any sensible person wouldn't think a man with an honorary doctorate could actually practice medical procedures.

Let’s hope the jury can see the truth. They get to decide. But the judge decides punishment. The way she seems to be swaying towards the defense already I bet she will go easy on him. My heart goes out to all involved. It was not intentional but negligent and therefore manslaughter.

That's funny. There is something about her that really rubs me the wrong way; maybe it is her voice?! Her antics are annoying too, though. She seems bratty to me. Like 'a know it all and I know it even'. Or an 'I'm always right and never wrong' kinda person. Even if Gutierrez-Reed and Baldwin were assumed to be responsible, they are not villains or evil. She speaks down on them and as though they are beneath her.

He didn't come there to kill, he didn't anticipate to kill, had not behaved in the manner that would cause the deaf of this woman, he enacted the scene from the script or improvised, whichever . He had no idea that someone has weaponized the pistol. Had he known, we agree, he would not shoot. This, I am sure traumatised him as well. It must have been devastating to shoot your colleague, with whom you work, create, have fun. It easily could have been Halina shooting Boldwin or just anyone else. In Europe where people are not wearing guns all day long it is clear that in US you have normalised the pleasance of weapons that it is likely you get blanks and those in real in your pockets mixed up. This wouldn't have happened elsewhere. Those who handle weapons for art purposes do not mix them with real bullets to which they have no access. He is not guilty of her death. It was a tragic accident due to the recklessness of armourer . If Baldwin is guilt of anything, it may be as a producer for not vetting armourer properly. US government and entire society is guilty for glorifying guns, making it an every day, accessible item and accepting distribution as a legitimate business, where guns don't have any secondary use, but they are made for killing.

Are the producers paying off the judge? How can she blanketly not hold them responsible for what happens on their set? They hire and supervise the set - to the contrary, which makes you wonder about the validity of the court

That's because Producer don't really do much, what do you think a producer do actually? Producer, apart from executive producer, deal with artistic side of things. The exec is the people who do the hiring because they are the one that come up with the money. Producer can be a runner, (deal with location) or can be sound (sound mixing producer) being a producer does not automatically make you become a boss on set, being the department head is. And in this case, unless we are saying Baldwin was in charge of the Art Department, which was what Armorer is under, he has NO SAY on anything about the gun and gun safety.

The Production would be sued and be responsible, which would be the producers. They are responsible for everything that goes on the set, including hiring the armorer . But if they have a lot of money and are politically connected, they might pay off the court system..

The judge ruled correctly. The prosecutor must show that Baldwin knew of a substantial risk of harm under the circumstances KNOWN TO HIM. The state tries to avoid that burden by showing circumstances that reflect on Baldwin but show little, if anything, about his awareness of the actual level of harm his gun handling presented at the time. Baldwin's knowledge of firearm safety rules does not satisfy the state's burden because rules, though relevant, are not "circumstances."

The entire jury will know that Alec was an exec producer on the film regardless of whether this can be included for consideration. They will find it impossible to overlook his role as producer and the culpability that goes with that given the haphazard conditions on set, staff quitting etc..As exec producer, how would Alec not know about the safety issues on set and an accident waiting to happen. There was more than one accident. The media has informed anyone that could wind up on that jury. Still this is a big win for the defense already if this supposed lack of "disclosure" can not be addressed is cross exams. It's the elephant in the room, that sticks out like, well, an elephant. Michael Mann shot the film Heat with more gun fire perhaps on any film in history, no injuries or death. Granted Heat had a higher budget than Rust, right? If a film can not be produced safely, it should never be produced. If there is minimal budget, don't do films where firearms and saftey will be a concern. They add an element that argueably prevents a so called low budget film like this western to produced in a safe manner. Unless only props that can't fire are used using CGI for flash etc.. No bullets on the set, period.

Knowing what I do about trials. Only evidence is allowed in if it’s RELEVANT. Then the judge has to weigh each piece of evidence and if it is deemed relevant, they have to decide if it could possibly bias a jury too much- in an unfair manner. So him being a producer is apparently not relevant to the charges. Whereas Hannah’s job title was because her entire job duty was to provide knowledge and safety around the gu-ns used on set. Whereas a producer literally just helps get the movie made. It’s not in the producers job description to ensure g-u-n safety, so I’m thinking that’s why she tossed it as “evidence”. As much as I h@te AB, I agree with her decision. If she were to allow it in and AB loses, he could easily appeal the decision and get the verdict tossed. So this decision protects the verdict too.

The reason the Judge wouldn't allow in the fact that he is a producer is because he is being charged with reckless "handling" of the gun in that one instance of that one shooting and not the overall safety on set. If they want to charge him with that it would have to be a separate charge and they would have to charge all four producers.

Do you know there are 110 different "Producer Roll" in an A-List movie, which producer are you talking about? Producer in charge of a very niche thing, usually your own department, in some case it's artistic (character development). It does not mean every producer will know anyone else's job, there are different department on a movie set for a reason, it's like saying the regional manager of McDonald in my area is the one that responsible for getting my coffee wrong on my local McCafe because he is a McD's manager.........

Movie sets have gun experts to check the guns because most actors are not knowledgeable about guns. The actors are not responsible for checking the firearms and therefore they do not check the guns.

Taking aim and pulling the trigger, which the evidence clearly shows, is an absolute NO-NO in the industry because blanks have killed actors multiple times. He must've at least assumes that there were blanks in that gun, even if he didn't know it was live ammo. So, if he believed the bullets were blanks, then he is liable AF for aiming and firing upon a human being.

If you pay him, he’ll say the lines if you do not, he’s not gonna tell he’s not gonna say what you tell him to say. As far as everybody around the world knows he has told everybody he doesn’t know guns he doesn’t know the mechanics of it. And he doesn’t know how to hold guns properly. He doesn’t know how to fire guns properly and most important. He’s probably never been taught how to check a gun whether it has a live round in it or not he probably not supposed to before in fact, you’re not even supposed to point a gun at anybody in the first place unless you are going to use it. That is a huge victory for Baldwin. As Producer on set he was calling all the shots. There were countess videos of him directing and instructing the crew. Including rushing the armorer to re load his weapon after a shooting scene as she nervously complies.

For those who don’t understand this- the reason why the judge ruled that his title wasn’t relevant to the case is that it’s not. Hannah was the ARMORER. So her title is directly linked to the fact that she didn’t do her job and someone died as a result. Alec’s job titles don’t call for g u n safety so it’s irrelevant. It’s like trying to say that because he’s a man he’s guilty, or because he has gray hair. If “evidence” isn’t actually evidence then it can’t come in as it would unfairly bias a jury. So they won’t even be allowed to MENTION that he had a producing role. Just as they won’t be able to mention that he’s a man with gray hair. Silly comparison but that’s the point- irrelevant is irrelevant. And you may THINK it’s relevant but it isn’t, and the fact that you do think that is why it won’t be allowed in, because a jury might make that same mistake. Unless you can find it in his job description that he was in charge of safety on set- it’s totally irrelevant to this case. In deciding this, the judge is preventing a successful appeal later on.

If it's the actor's responsibility to ensure that the gun is "cold" on set, then what is the point of having an armorer and a director in charge of safety? The guilty parties who were responsible to check the gun before it was handed to Baldwin have been punished, why charge Baldwin for trusting the armorer and David Hall to do their jobs? IMO Baldwin should never have been charged. This was a tragic accident that could have been avoided if Hannah had not brought LIVE ammo onto the set and if she had shaken all of the bullets individually. If she had done her job correctly then Halyna would still be alive to raise her little boy.

The reason the Judge wouldn't allow in the fact that he is a producer is because he is being charged with reckless "handling" of the gun in that one instance of that one shooting and not the overall safety on set. If they want to charge him with that it would have to be a separate charge and they would have to charge all four producers.

And those were fined And again, exec producer is the one that take charge of daily production duty, along with the Line Producer. Every one else basically just mind their own department.

If they were going to base part of his guilt on being a producer then they should have charged all the producers. The prosecuters own gun expert armourer in the last trial stated that the actor doesn't always check the gun before, they can but its the responsibility of the armourer and first AD. It'll be a tough sell to hold Baldwin criminally responsible.

What gets me is that most courts dont allow "character testimony of defendant" but can victim blame. Cant put forth past acts as it may "inflame the jury.' Cant say AB was a producer even tho he was and still is. Cant discuss current bad acts by defendant as it is prejudicial. Cant discuss the victim as it will inflame the jury. So sick of protecting the effing defendant before a trial begins. Let the jury hear and let the jury decide, hence, a TRIAL!!!

Not exactly. Seth Kenny was the head armourer on paper and supplied all the ammo. After the shooting, Sarah Zachery, Kenny's girlfriend and Hannah's supervisor destroyed all the ammo evidence. Both were given total immunity from any charges ever. So something smells fishy.

Criminal negligence (recklessness) would have been Baldwin using the gun after checking it or knowing the armorer didn't check it. Trusting the armorer and AD limits Baldwin's actions to ordinary (non-criminal) negligence. Some things in law can be remedied only through civil action.

The 2 biggest things that would help the state win include the way Alec was behaving during filming and rehearsal and that Alec was a director. The defense has important evidence and filing for testifying and arguments, which include Hannah being the one responsible for loading the gun and Halls giving Alec the gun after inspecting it and claiming it was safe.

If it was a stunt car and he went forward 100 feet and the brakes worked fine. Then he reversed back to his starting line and is told to drive 300 metres and for those who aren’t metric around 18% of a mile and yeah he’s told to go that distance in this acting scene and the. Brake hard at 300 metres. Then he does this and the brakes don’t work and he follows through much further and hits and kills a cameraman. Is he liable or should he be ? Should have he checked the brakes properly? Slightly different of course and some would say entirely different but would he be viable ? I’m guessing not.

Wow, it sounds like the judge is already in the bag for Baldwin. I wonder how much that costed Baldwin. It's crazy how the judge can rule that his role as producer isn't relevant....especially considering he has a say in who's hired....as in the armorer. If he had a role in her hiring and continue employment it makes it relevant AF when you consider the armorer might not wanted to piss her "boss" off by forcing some issues related to gun safety on set. That ruling about the videos is also appalling if he has a role in employing the crew. Who's going to argue with their boss about rushing safety stuff?

Videos of Alec trying to get things moving on the set are not relevant to what happened. Every set has this going on. A filming schedule for a movie is grueling. It's someone's job to try to get things on track so people can go home at the end of the day. If the video doesn't directly involve the situation in question then it's just prejudicial.

You're right in that Alec is the only 'one' with the gun in his hand for the 'one' 'instance' of a reckless disregard that led to a death. The "charge" is for that - recklessness - manslaughter. It is not for "lack of gun safety." I'm just trying to explain the correlation between the 'charge itself' and the 'person charged' for that charge specifically. E.g. there are no charges for a lack of gun safety on the set (or any other safety). They could have done that too, I presume as a separate charge in which case it would fall on all the producers. Similarly in plane crash blame - they look for airline errors or pilot specific errors. Don't worry, the movie itself is being sued separately for wrongful death.

This is going to be one to watch. Without the producer angle it’s going to be just an actor trusting the crew. There’s key info not going to be shown so it’s going to look like just an actor trusting the crew. My question would be, did he know there was live ammo on the set. Did he participate in the target shooting. I would think a smart guy would check that they didn’t mix up the ammo, if he knew they were on the set.

This case has brought me to tears many times. I have cried for the loss of a beautiful life, a young boy has no mother, a man has no wife. It’s a tragedy but Alec Baldwin is not a killer. It was a tragic workplace accident. He trusted the armorer as he knew her father was a gun expert. Alec has to live with this the rest of his life. He’s only guilty of trusting the people around him. It’s all sad. He would never hurt anyone and it’s just a tragic accident. 😢

Terrible that the judge won't let evidence in as a Producer. He was in charge of safety as a producer, At least in my opinion. And the whole poor me look with the hunched over bewildered and glasses does NOT fool me. He yapped his mouth after the incident and doing a reality show still??? That seems really disrespectful. He shot the gun that took this poor woman's life and he should be held accountable!

Wow, just watching him try that cross-draw gives me chills. It is amazing that that discharge didn't happen earlier. Here's someone who rarely ever handles a gun acting like he does it every day. In all the shots of him practicing that draw he has his finger on the trigger EVERY TIME. That's scary AF considering how little pressure it takes to pull that trigger and the weight of that revolver coupled with the inertia of swinging it around it is amazing that it hasn't happened more. That takes some considerable muscle control to keep from pulling that trigger. I would NEVER attempt that with that heavy of a gun.
