Hello, the following page from the NVC talks about domicile requirements: travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html#aos18 You also need to answer questions factually exactly as they are now. If based on the information above you’ve determined that you’re not domiciled in the US, you have to answer that on the form. You do however have to show proof of intent to reestablish domicile (according to the resource).
Hello Kseniya, my mother-in-law (green card holder - petitioner) petition her husband and younger daughter (minor at that time) way back 2016. Her eldest daughter (which is my wife) filed I-864A as a joint sponsor because my mother-in-law income is not enough. That was a very good presentation. I have a question though with the affidavit of support, can I sponsor the principal immigrant(my wife's brother), his wife and two children? The reason is because my wife is not working anymore therefore she has no income except from what she is receiving from the social security service.
You can be a household member (I-864A). Your wife will still have to be the principal sponsor and submit I-864. I have another video specifically talking about income, so check that one out as well

I864EZ is only used if you’re using the sponsors income. Your wife will fill I864 and you will fill I864A. I have another video on reporting income on this form specifically

In each i-864, I am sponsoring only 1 person and there are no derivative applicants. So the household size is 2 in each application. Right now I am the petitioner for my French wife, we both have been living in France for a year and a half and are currently living in France, but we intend to move to the US when my wife gets her green card. I am currently using my mom’s address for my bank and credit card information. I am filling out the I-864 and I am wondering if I should write my mom’s address in the US for mailing and my spouse’ parents address in France for the physical address? Is it confusing? You have to have sufficient income from most recent year. You can’t combine your incomes from all years. If you have savings, you can add them in the “assets” to supplement your income.

For tax year 2020 I haven’t filed a return yet because I had no income and also because my spouse doesn’t have a ssn, instead I filed for an extension hoping we’ll be in the US by Oct 15. So for my most recent year I’m good, although on the form they are asking if I’m employed or not. What’s my best way around this situation? Thanks, I really appreciate you taking the time. @@elijalev588 By most recent tax year USCIS means the tax year that is due, not the most recent that you have. if you indicate unemployed, you would need to find other ways to supplement your income or find a joint sponsor. See form instructions on page 12

When being asked by NVC to replace I-864 what date should I sign with? I submitted this form with a date earlier than when I submitted, which was a later date in the same month.

Hi Tania, this is what I found on Nolo.com "Although some sources of money related to unemployment cannot be counted toward income for purposes of Form I-864 (such as food stamps, SSI, Medicaid, and TANF), unemployment benefits are in a different category. They are basically insurance payments, which you are allowed to collect upon based on your employer having paid into a federal/state unemployment system earlier. For that matter, if you are also receiving any retirement benefits, worker’s compensation payments, or other benefits that are similarly considered “taxable income” by the IRS, you can count these toward meeting the 125% of Poverty Guidelines levels required in order to serve as an immigrant’s financial sponsor. (This comes from 71 Federal Register 35731.) How long you will remain eligible for the unemployment benefits is an issue to look into, however. U.S. immigration authorities may consider this in assessing your ability to maintain the necessary income levels over time." I'm very confused with Part 4 of i-864EZ where it states: Add together Item Numbers 1.a-1.e and enter the number here. "This is your HOUSEHOLD SIZE for the purpose of this Form I-864EZ." .. If i add together my number would be 3 because on question 1.e if I have any dependents listed on my most recent Federal income tax, I enter 1 because i have my little sister who is here in the states and i have her as a dependent. My immigration NVC document got to the stage of approval, Eveything was approved but on the I-864 form was rejected. It says we were suppose to fill 12pages of paper, but they on have 10pages on there. This is so draining and confusing. And does it matter if the one I found carries a old expiring date? Talking about the I-864 document, will it not lead to denial?

Yes based on the information you've provided, you can submit I864EZ. And you are only required to submit most recent taxes (2020), the other two years are optional

on Form I-864, I have a question on Part 6 Question number 7, My current individual annual income is not up to the required 125% Poverty level guideline requirement, can I add the amount in my bank account to my annual income to meet up the requirement as long as I can prove it through my bank account statement when the time comes? For example for 3 people I'm expected to currently make $27,450 but I made $13,377 but i have $15,000 cash to meet up, would this work according to the question in Part 6 question number 20, and part 7 question number 1-4 ?

Hi Kseniya, why do you think is the intending immigrant who is not the spouse nor lives in the USA being asked to furnish 1864a for the beneficiary. In this case what does one fill in part 2 section 1. Neither a b or c is applicable to this primary applicant/ beneficiary. Thank you for your help.
