My spouse has a child but she doesn’t claim her on taxes, the father does because the father pays child support and the child’s welfare, should I add the child as household income?

I brought my husband and file I184. And i m married . Now i my applying my mom dad I184. So on part 5 do i skip no 3 and put 1 in no 5. Or do i put 1 on no3 &5. I m confused.

Hi Kseniya, It's great to see someone like yourself sharing your experience and helping others in the immigration process! I have a comment. At 8:16 you were mentioning the total income from 1040 should be entered into form I-864 part 6 line 2.a but the I-864 specifically says "my total income (adjusted gross income on form ...)" which is a few lines below total income on the tax form. So if the sponsor just has one job as an employee, their total income may be the same as their adjusted gross income. But if the sponsor is self employed such as a contractor, then they may have some adjustments and that results in a lower adjusted gross income than their total income, FYI. If they enroll in retirement plans with their self-employment income, the gross and total could differ significantly. My guess is that USCIS is looking at the total income that the sponsor can use for day-to-day expenses so whatever is adjusted down such as money they put in their retirement plan that they can't take out for day-to-day expenses can't be included.

Hello, it doesn’t matter self employed or retired, they only care about total income. They specify AGI only if using form 1040-EZ which no longer exists.

Hello, me and my spouse have a small business we are partners but when it comes to spouse income is it legal for them to have an income even if they dont have a social just yet. should i just state the income as it is all mine? thanks for clearing that up

Thank you for your help! FYI my spouse is the petitioner and he makes enough money alone. HOWEVER, persons at CEAC is still asking me to complete I-864A. We can't get an interview until I do this 😔 the rules are not set in stone.

Hello Kseniya! I have a question for you: My wife is petitioning both of her parents. My wife is not working and I'm the spouse don't make enough But we have a join sponsor make enough income. Question 1: Does my wife need to report my income or not? Do I (spouse ) need to fill up form I864a or not? Basically we just want to use all the income from a join sponsor. Thank you.

I have a question about my Joint sponsor who filled out two separate i-864 for me and my son. The Joint sponsor has two forms 1099 and 1099R, and they also receive income from dividends, and the wife also has 1099. He and his wife are retired and filing taxes jointly. I have a work permit so we want to put my income as part of the household income. Im the intenting inmigrant. So i guess I have to check box 22. Hi Kseniya. Thank you for your video! I have a question: My spouse is a US citizen but we didn't file taxes jointly. He is my sponsor and the only sponsor, and I am the intending immigrant, our household size is 2. We are not going to use my income at all, so we just put "N/A" for questions 8 through 19 in part 6. In this case, do we need to check box 22 and put "N/A" where it asks us to provide a name? Thank you!

Hey Kensiya, firstly thank you for your videos, they have been very helpful. How many forms do I need to apply as a Canadian citizen who just got married to a U.S. citizen ? As far as I know now ( 130/131/1485 & the work visa) do I need to apply for the i864 as well ? And most importantly is it true that I have to wait 6 months from the day I entered the u.s. in order to file these forms ? I heard it is recommended to wait otherwise it will look suspicious for some reason

Thank you Ksenia! A lots of super informative videos from you. Have a quick question that I got confused with. My wife is a US citizen and she does not work for past 5 years. We are married and have 2 kids (born in US of course living together) I'm assuming that I have to file form I-864A in this case. Or will it be enough to file just this form and attach all of tax return evidence(for past 3 years) ? And I dont have any other dependents that will go with this case.

As the petitioner sponsor , my income (expected income for the year of 2024) falls below the poverty guidelines which is 25,550 , however my income is 15k . 1-Are they referring to the total income in my tax return for the year of 2023 or my expected income for this year (2024)? 2- if they are referring to my expected income for year 2024 , the difference between my income and the poverty guidelines is 10,550 . Hopefully you figured it out. But from what I know, you'll need to open the pdf in a adobe pdf reader and not in a browser, otherwise the household size won't be counted correctly

I also have a child and my husband is a sponsor for her. Our taxes weren’t jointly last year. I am going to be a sponsor for my child and for myself because my husband’s income is not enough. Hey Kseniya, my Wife and I file our taxes married jointly, my Wife is the beneficiary on this case, we also have two US born childrens that we file as dependents childrens on our taxes, are they considered accompanying dependents? they are already citizens and will no be immigration to the us? I am a joint sponsor for my moms husband. I am currently SEPARATED with two kids. I claim one and he claims one on taxes. So for household size would I just put myself, one child, and the immigrant? Total 3. I make the required income for support. Just want to verify I do not need to add EX or my other child to household size since I do not file with them on tax return?

Hi Kseniya, I have an urgent question as I have been looking for its answers everywheree. In part 6 of this affidavit, when the petitioning sponsor checks off item 22 because the immigrating spouse's income is combined and mentioned in the form, whose name goes under that "name box" if the form is being filled out by the petitioning sponsor?

Hi Kseniya! I have a question, I got an email from NVC saying that I need to add my husband as a Household member of Me, as a correction on his I-864a how do I do that? I’m the sponsor and I’m counting my husbands income fully since I’m not working, I’m applying for both of my parents green cards. They also asked me to fill out individual I-864a forms for each of my parents (we first only filled one for both) which I can now fix that cause I watched your video on how to fill the I-864a correctly. But I don’t know exactly what “add your husband as your household family member” means because we already said that he was my spouse and a household member counted on my family size.

@@jheffpalaypay7593 Hi once you logged in you’ll see your name under the lists of things you gotta upload, it says “add household family member” underneath your name and that’s how you add someone. That’s what we did. Also me and my husband fill taxes together so I uploaded the exact same document under both of our names for i864 and i864a

I was wondering if you knew what I should put as the total income on the I-864A for each of my parents who file their taxes jointly and they are both combining their income with mine to sponsor my husband. I have the same question! Each of my parents individually makes significantly above 125% the poverty line for their household of two, and both agree to co-sponsor, but they'd have a hard time going back to figure out who made how much individually from last year's taxes.

The total income line does NOT include income such as the tax-free part of social security pension. In many cases this is the entire amount and can be the majority of income so that without this amount the income will be insufficient. Does this amount get counted so that I don't have to include all my assets?

What about tax exempt incomes? They are not getting reflected to the IRS forms. Tax exempts are like, IHSS providers in CA who are living with their recipient in the same house. Or, if you work with the United Nations.

Unfortunately I don’t have an answer for this but I do know that USCIS flags and automatically sends RFEs if nothing is reflected on taxes

@KseniyaInternational That is true, my wife is a tax exempt IHSS provider, and it seems her income determined not qualified based on the RFE we just received today. However, we had submitted her 12 months paystubs, bank accounts, and the IRS 2014/07 regulation which confirms her income being exempt all together in the package at the time of application.

I have a question that I hope you could help me out with. My husband( U.S. citizen / the petitioner) and I (Philippine citizen beneficiary) are filing concurrently online. We have (130, 130A, 485, 765) forms and bonafide evidence ready. His tax forms and recent paychecks were already part of the requirements online. Do we also have to file/mail the I-864? Along with the 485 & 765?

Hi Kseniya I have a question. I made a mistake while applying for tax for 2021 and My Tax Return Transcript from the IRS is showing $0 for my income. Now I correctly file it with amended 1040X but the Tax Return Transcript form IRS is still showing $0 because it is not updated and it is taking forever. Can I file AOS with Amended 1040X + W2 or Tax Return Transcript is required document for AOS for NVC ..

After combining my income and my husband's , total income is less than What I earn. Ma’am Kseniya, Other people said if the joint sponsor is married and filing tax jointly with spouse, it’s automatically that the spouse will need to file I-864a. I’m so confused. As I’ve said on your other video , Only my joint sponsor will sponsor me and his wife will not. Will they do RFE if spouse will not fill out form I-864a?

Hello, I am petitioning for my mother. I and my husband are US citizens, and I have been a housewife for the past three years. My husband and I file taxes jointly. I am filing I-864 and my husband is filling I-864A so that I can use his income. My question is, for the I-864 in Part 6, #24a- 24c (re: My total income as reported on my Federal Income Tax returns for the most recent three years), can I include the total income on our tax returns though technically it is only my husband who earned this? Asking this because from what I understand, since we file jointly, the total income on the tax return is also considered my total income even if I did not work because we filed jointly, hence I can write it on Part 6, #24a-c. Is my understanding correct? Thank you .

Hello, please an important question! My wife she filled taxes jointly but I'm not even in the us or having a tax number or a social security number! But she put for me that I'm not making anything, and just her income! It's gonna impact our case on the I 864 and taxes?

Hi, how do I find out if I did sign the affidavit of support? How do I seek a copy of it? This was nearly 10 years ago and I'm going through a divorce with the spouse I sponsored. By the time my divorce is finalized it will be just over 10 years since she got her green card through me (I'm a US citizen). However, the date of separation was 2.5 years ago. Also, am I required to pay her support equal to federal poverty level? Thanks

hi. all your videos have been helpful. i just have one question left to get my form submitted. i hope you reply please. since i am the petitioner but i have 0 income for past 3 years, husband and i married filing jointly for tax. do i have to check the box that says im not required to file income tax on my form i 864? if yes, what evidence should i put? thanks again.

If you filed jointly with your spouse even if you made 0 income it’s still considered as filed taxes.

Thanks for the detailed information, I filed taxes married jointly and my income is sufficient to sponsor my mother. Do I need to file 824A and use my spouse's income because we filed taxes jointly? or I don't have to use my spouse's income in part 5 item 8 and no need for Form 864A?

I need help My husband is self employed, he didn't pay taxes for last 3 years due to some financial issues, now we are gonna add joint sponsor, my question is that he will fill the i-864 form, but what about tax returns section? What should he fill there he doesn't have records? But our joint sponsor paid all current taxes .

Hello Good day, Is it necessary to put those 3 taxes on i864 form? My husband 2022 and 2023 met the poverty guidelines tho. Should i necessarily include the 2021?

I also filled for my parents in 2016 and they are no longer living with me and living out of the US and not planning to come. Do I have to mentioned them as well when my case is on Affidavit of support stage? Thanks in advance

Hello Kseniya, this question is in regards. to what you said about filling form I-864a, you said that what we put in the tax returns for previous years must match what the sponsor puts on his 3 most recent years tax returns, but we just got married and it is the first time we are filling together so we only have one joint tax return and I have my own separate income from past years. as i am filling the form I-864a should I put our joint income from the most recent year and just put my own income for the past years even if it does not match what his form (I-864) says?

@@KseniyaInternational we just got married and filed joint tax this 2022. Do I need to summit the W2, 1099 from him and his ex from 2 years ago because his tax transcripts from 2021 &2020 had his ex name on it

I have a question, since I’m petitioner /sponsor for my parents and my income ($15k) is not enough to be so sponsor, I will use my husband as household member to help sponsor my parents i-485 application. He already signed I-864A and provided 3-year W2s ($100k+ annual income) and 3-month pay stabs, My question is do I still have to provide all my W2s and 1099s? I mean I want to focus on his annual income. Also, does he still need to provide his 1099s and part time job W2s. Thanks so much!!

Can you please help me I have the same situation you had I’m using my husband income to reach out the requirements income while we doing jointly taxes but my husband doesn’t have the w-2 for last years because it was Covid he was not working he was receiving Unemployment is he still available to help me out

I did the form i-864a for my wife already but, in this form i-864 what should I answer in page 1, part 1, 1d and 1e. Does my wife has to complete this form as well, added to the i-864a? Thank you!

The primary sponsor/joint sponsor must complete I-864. If you’re a joint sponsor for someone’s green card case, you answer 1d. Your spouse only signs I-864A

My wife completed Form i 864a because we need her income as well due to our household size.We filled our tax return as married filling joint. My question is if my wife has to complete the form i864 too as a secondary sponsor. Because I know you said the second sponsor cannot combined income. I am a bit confused on that.

Question... I fill taxes with my husband but all the income in the last year of taxes. It's all his income. Not mine, It's going him to be considered a joint sponsor does he need to sign anything or fill any application? This is so confusing. I am sponsoring my mother but not working right now...

hi, me and my spouse filled our taxes together for 2023. he is the US citizen who is sponsoring me. does he have to send our federal income tax return? or the state return (we filed this separately)? im here on a f1 visa and my job is an internship. we dont want to include my income, just his to be safe.

Good day ma'am. Please I really need your help. We submitted our NVC document. And everything we approved except the FORM I-864 AFFIDAVIT Of SUPPORT. And the error was that it was suppose to be 12pages to be submitted but we only found 10pages. Please what do we have to do, do we have to go obtain the remaining documents and how do we get it?

Hi Kseniya: USCIS has sent out RFQ to resend I-864 along with I-864A as I clicked line 23 while filing. Can I resubmit by excluding spouse(without I-864A) as my income is 125% above poverty line? Also, can I make changes to remove assets(Part 7) to avoid confusion? If I submit I-864A along with I-864, I think I need to put both combined taxes that were filled with IRS on line 24a. 24b. & 24c. Am I right? Thanks in advance your videos very helpful. I wish I had checked before.

I believe you can resubmit a new form with evidence. Yes lines 24a-c must include info exactly as listed on taxes.

Good night quick question, my sponsor didn’t make the required income in 2019 but for 2020 and 2021 he did, i’m trying to file this year by the way. Will that be on issue? Meaning does it mean he can’t sponsor me?
