You need to pay more attention to how Billy words things. He didn't actually admit to anything, and how he qualified his statements leaves a lot of wiggle room. Nor has the lawyer caught him lying. A decent lawyer will shred the idea that Billy played on that cabinet. There are only photos of him in front of a cabinet, which Billy does say looks like the one he played on. But he also tosses out that he would not play on a cabinet with a red joystick. Ergo, if the cabinet had a red joystick, he did not play on it The pictures definitely hurt his lawsuit and credibility, but it isnt a slam dunk. Calling him a liar is a bad idea without solid proof he is lying. Lying implies intent and the knowledge of what you are saying is not true. Misremembering or getting facts wrong does not automatically mean he lied. Unless there is a video of him saying that he definitely played a cabinet with a red joystick for his record, it would be near impossible to prove he is lying. I will also point out people's memories are horrible. Eyewitness testimony is one of the worse forms of evidence out there. People change, alter, forget, and make up new memories. They also see, hear, and think something happened that never did. Billy may actually believe the joystick was black. His memory of the cabinet could very well not be what the actual cabinet looked like. I hope Billy loses the lawsuit and is forced to pay attorney fees for the defendants. But this deposition and the photos do not guarantee a win and do not prove he was lying.

Honestly this is a pretty open and shut case either way cause Billy has 0 proof to back up his claims. Where as Twin Galaxy has multiple submitted peices of evidencw and cort records of Billy lying. Any decent Judge will look at the case and dismiss Billy, and if its a bad one it will just be appealed anyway.

All subjective feelings and nothing definitive that any good lawy can say are just confuicion due to time (and how unreliable human memory is - why witness testimonies are kinda worthless on their own). That is not admision of the cabinet being the one he played with UNLESS is it established this is the only one on that convention. I'd be willing to bet he is probably sitting in a jail cell somewhere. The fact that he had no remorse in stealing other peoples money, and wrecking others lives, I doubt he would have stopped at credit card fraud. He was the sort of person who would have felt justified in his actions. To be fair, VanBuren20 recently released a video denouncing Billy and said that he is sick of being lied to and will no longer support him. The straw that broke the camel's back is when Billy tried to get VanBuren20 to to copyright strike this very video because Karl included footage of him per fair use.

I looked far an wide and the only photos I've seen of Donkey Cabinets that had that joystick was the Billy Mitchell photos. I hope they somehow find that cabinet in the photo and are able to prove if it was an 8 way joystick unless Billy Mitchell and Walter Day attempted to destroy the evidence (they probably did.) which would make it far more difficult to prove.

@@nolife6013 Finding the cabinet in the present day doesn't prove anything because such a joystick could have been put on at any time, by anyone. The only evidence that could possibly matter is witness or photographic evidence from the event itself--which they have, in those photos.

Even when it was revealed the joystick was red, he didn't deny that it was the machine. Just that someone must have changed the joystick. So he's not denying it's the machine at all.

It's like with any other form of cheating, it's all about evidence. They had incontrovertible evidence he was playing on non-standard, non-original hardware. And they have him, on the record, professing he did not play on non-original hardware. None of his supporters can effectively argue this.

They have other evidence, but it's a lot more technical and there's a risk a jury wouldn't understand it properly. But "black joystick = original hardware, red joystick = not original" is so simple that it'll be the strongest evidence at convincing the jury. That's why it's important.

Nintendo 4-ways really do have a surprisingly unique feel. I own a DK cab myself and it's amazing how much stick movement it takes to go from left to right or up to down. It's a one-of-a-kind feel for sure.

The difference between pre-JAMMA, wild-west joystick and button configurations and post-JAMMA is night and day on some cabinets. Nintendo joysticks are one of them. Pac Man is another.

If you've watched the West Wing (TV series) this was in an episode. One of the characters is being prepared for a deposition and the lawyer says "Do you know the time?" and she looks at her watch and says "It's 3:30" and he says "Don't do that", explains this and then says "Do you know the time" and she says "Yes".

if they ask you to explain something explain it in as little words as possible and as close to the question as possible for example if they ask you "how did you do this?" or "how would one do this?" best to answer "it is done like this" and zip it, no Id do it like this but ive seen people do it like that, just "its this" and zip

I am sure Billy Mitchell's lawyer did the same. And the lawyer questioning you knew you had been told that. But it is far easier said than done. For example, the "just wait after the initial answer" strategy is done because it works. People do not like silences in a conversation and they naturally seek to fill them so they will often add context without thinking. On top of that, note that the deposition was well over two hours long. And they raised this topic just before one hour and went back to it more than two hours into the questioning. By the time they ask Billy these questions he is likely tired and stressed, which weakens anyone's self control against their instinct to fill a silence. And a talker like Billy is more susceptible to that. And there is likely also a good deal of overconfidence from him believing he could not possibly lose at anything so he doesn't take it seriously enough.

Until you get the yes/no question "Have you stopped abusing your partner?"... (the answer is no, but how it would be construed is another story...)

Also what Nightdare said, a large chunk of people have had those 15 minutes or longer yet we still move on. I've played out of my mind against streamers with thousands of viewers and held a couple world records yet here I am on an alt. The best part is his brilliant response to the clear evidence he's wrong is "Maybe [it was changed] in the photo." He would have us believe that the Florida Mortgage Brokers Convention staff took an original Donkey Kong arcade cabinet, swapped out the original black joystick for a red one, and had Billy pose for multiple photos in front of that same altered cabinet, all without Billy knowing or caring. Sure.

That's the part I don't get. Going for the : "Nope that's not the machine I played on." Instead of the rambling about the previous statement, wouldve been so much better for him.. Unless he really released the photos himself and had a clear plan on the narrative he wanted to go for with them... That would make sense for his approach but it's still weird..

So either he's lying and been lying or his memory is unreliable, and both are terrible for his case.

Real Donkey Kong cabinets with 8-axis controllers have never been tried...

@MrBollocks10 Just in case this isn't a troll, the color of the joystick absolutely matters. The Donkey Kong arcade cabinet comes with either a blacktop or whitetop joystick, indicating 4 possible directions a player can be controlled in. A red joystick, as Billy says during his deposition if I'm not mistaken, indicates the ability to control the character in 8 directions. Since the Donkey Kong cabinet comes with a 4 directional joystick, this means that the red one is indicative of modified hardware instead of original hardware, which is what Twin Galaxies is attempting to prove.
