Unfortunately, from the sounds of things, such a lawsuit would likely just end up costing Mr. Jobst even more money. If Billy Mitchell loses his many lawsuits and is saddled with paying for court costs and his opponents'' defenses, he will likely be bankrupted. At that point, it doesn't matter how much he is ordered to pay. If he doesn't have the money, he can't pay the money.

Slimy con men like Billy are also the people who we elect to government positions who make the rules. They will never do anything that could possibly harm them.
If he does this repeatedly, he could be listed as a "vexatious litigant" and barred from filing lawsuits without judicial review, though I believe that is a very high (or low?) bar to meet, depending on jurisdiction.

I work for a UK tech publication and wrote an article about when Guinness banned and then spinelessly reinstated his record. I had an email within 2 hours, claiming to be from a representative of Mr Mitchell, demanding that the article be amended or removed. I actually disagree. It should never under any circumstances "destroy someone financially" to pursue justice. Nobody should have any judgement in law leveled against them because of an inability to pay, let alone pay hundreds of thousands of dollars a year. This simply shouldn't be possible in a civilized society, one that even pretends to value law or justice. I don't think someone should "go to jail" for doing it, I think they shouldn't be able to do it in the first place and the fact that it's possible is indicative of a fundamentally broken system.

I can't help but wonder how does he still have enough money to keep suing people. Sure, he doesn't expect his victims to resist (because defending yourself is expensive no matter how in the right you are), but lawyers aren't cheap even for him. And if any of these lawsuits does go the distance, he'll have to cover the legal fees of the winning party as well, which, evidently, is in the six figures. And, for that matter - how devoid of meaning your life must be for you to spend so much money to, at the end of it, "defend" your achievement of a video game high score record? I think it's nice of Billy to watch every single one of your videos. He seems to never have missed a single video you've put out, even those that aren't about him. So while he's clearly a bit too much into the legal system and his lawsuits, he seems to still love your content and keeps watching it. I’ve heard other victims of frivolous lawsuits describe them as “the process is the punishment.” it takes so long for a lawsuit to wind its way into court, then takes even more time to continue within the court, that ordinary people get bankrupted by the whole thing. it’s so unbelievably scummy. keep your head up Karl.

Yeah, some people have filed frivolous lawsuits and saw to it they never reached court, just to drain the funds of the one they're suing. Basically a case of 'capitulate to my wishes, or lose all your money in legal fees that go nowhere until you are forced to capitulate anyways.' It essentially becomes a war of attrition where whoever has more money wins.
Kind of reminds me of being pulled over by the cops in a strange way here in the states. They sneak their way in Just try to find evidence for court or to settle for money for the city.

@@jordanbabcock9349 it's because it's changing it from USD to the Australian currency. My bank only allows USD charges. I had to call the fraud department to unlock my card and they said they could open it for a one time purchase while i had them on the phone, but by that point I had already donated via the RU-vid thanks. (My card didn't get frozen until about an hour after I tried to donate via gofundme and PayPal.) And i didn't want the headache of it potentially locking my card again. It's really annoying.

What's truly insane is the fact that a man in his late 40s or early 50s cares so much about a pointless video game score (one that isn't even possible) so much to the point that he presses changes against people. Hang in there, Karl.

I attended Kumite in Tennessee a couple weekends ago, and a retro gaming con sharing the exhibit hall with therm hosted Billy Mitchell's booth pitching his book, his hot sauce, everything. Kids still show up to play the Donkey Kong cabinets he brings. My friend who took me read my body language and just said "Billy Mitchell isn't real, he can't hurt you." It's kind of insane that he doesn't realize that by doing more and more lawsuits he is in fact bringing more attention to himself and making himself a larger target for the internet to make fun of as a whole.
It's probably because he knows the jig is up, but isn't willing to admit it. So in desperation he's throwing everything and the kitchen sink at the problem in order to bring it under control. Of course, we all know you can't put the pin back on the open sodacan, which is why his attempts are futile and bound to backfire horribly, both financially and publicly. This is why we need a "loser pays meritless lawsuit fees" clause somewhere. People do this sort of thing all the time to tons of people, usually when the person being sued doesn't have the kind of money needed to defend themselves in a long court battle.
Then you'd end up with a bunch of further back and forth about what is meant by "meritless", which could easily end up hurting people who put in, for example, good faith medical negligence claims or employment law claims which turned out not to have legs. It could end up discouraging people from making reasonable claims in the future because there's a risk of this clause coming up if things go particularly badly. More importantly, it also weakens the negotiating position of people with legitimate grievances by slightly strengthening the hand of whoever the other side is.

It may not cost the plaintiff much to file the suit, but it costs the defendant a truck load to prepare their defence. The plaintiff may not care that they have little chance of winning, it's just a tactic designed to make the defendant give up after they are financially exhausted - or before they get to that point.
In my country there is an opposite rule called the presumption of innocence - a person or institution is considered innocent until it is proven otherwise. This means that if you want to sue someone, you must be the first to show evidence of that person's guilt and only then the accused begins to defend himself. If you do not have any evidence of someone's guilt, the accused does not have to defend himself and thus does not bear the costs of the trial - in other words, the prosecution is invalid and can be used against you. Using the judicial system for your own benefit or to harm someone is prohibited by law, so when you sue someone without showing evidence of their guilt, you become a criminal. In addition, the loser bears the costs of a trial, hiring a lawyer and gathering evidence from both parties (not all costs, but a large part of them certainly).

Slowly by slowly they will expand the definition of "words are harm" until either the SC actually makes a ruling or the public actually decides to stand up and protest that it's gone too far. This is one of the first of many frivolous lawsuits, that will come out of people reporting something, regardless if it's a fact or not. As someone who's been sued in a frivolous lawsuit (by my own sister no-less), I know something of what you're going through. I'll spare you the details, but ultimately she lost. Nobody won of course but the lawyers. It's terrible being sued for something when you did nothing wrong. It might not help much, but know there's others out their that have some understanding of just how difficult this can be, and the time and energy it just sucks out of your life.
@dumpertron 22 I'd rather not get into the details in a youtube comment, and it's not really all that relevant to this story. Possibly more relevant is I quickly realized how horrible the civil courts are. It's not really about justice or truth. It's largely concerned about who has the time, energy, and money to throw at lawyers. That's why you see so many people give in when the other side has no case. They lack at least one of those three elements and the other side has more.
Thank you for doing everything you can to keep frivolous lawsuits from winning out; cases like this create precedent when tried, and are the fuel for change (even if slow). Be careful, though - he may not have the money to actually pay out if/when he loses the lawsuit, so don't make any promises about what you will do with any payments from him. This is exactly what a desperate person would do - if he's intelligent enough to know he can't win, he's going to burn as much down as he can on the way out, to make sure no one wins (or force a settlement and actually still win). Hopefully this concludes and the precedent will be enough to fuel more preventive measures against frivolous lawsuits, should someone with the proper legal knowhow lead the effort.

In the US a person can be declared a chronic filer of frivolous lawsuits (I forgot the legal term) where a judge needs to review the lawsuit before it is officially filed to declare that there is a valid legal reason for the suit. If this is possible in Australia you could ask your lawyer to file such a motion on your behalf.
We do have laws about vexatious litigants, Mitchell may not have reached the threshold. As Karl mentioned in the Video - we do have laws in Australia that means the losing side has to pay court costs to the winner. Sometimes when these proceedings reach the court, they can require the litigant to deposit a bond to cover the court cost in case they lose.

There are anti SLAPP laws in America to try and mitigate this but the problem is they aren't universal across states and I think you can just file a lawsuit in another state to get around it.

So instead you'll just get a judge sanctioning him for frivolous lawsuits and making him pay his targets' legal fees, and I think often further damages if the judge really comes to realize what a scumbag Billy is. That said, if you take the position that Billy believes he's defamed, there just ain't anything illegal about slinging around lawsuits. His lawyer should be getting a bad reputation for what he's doing.
If I remembered correctly, the episode of _Regular Show_ predicted Billy Mitchell's cheating allegation after Mitchell himself sued Cartoon Network for a lawsuit for "using his likeness without his permissions" until he got his true color exposed.
