Officer Mccabe just has little to no presence and doesn't command authority when it is needed, in not being decisive and assertive, it just gave raise to the escalation when it didn't need to happen.

@@kylemendoza8860 yea we don’t know this guys post orders… so it could have been reasonable to assume his orders are to report any and all suspicious activity on the property after hours to local law enforcement. But personally I would likely have approached them to strike conversation after monitoring them for a while. Most likely the security guard was being lazy.

Qualified immunity is only able to stand as long as police officers aren't properly educated. The establishment of a regulated education system, whereas officers are required to know the law would dissolve the need for Qualified Immunity.

A federal judge in Mississippi, recently also denied qualified immunity to a cop. I hope this is a trend that continues.

It's a nice first step, but until lawsuits that do stick take money from cops' pensions and not taxpayer money, they still have no real incentive to do the job properly.

the fact that the district court originally said that a reasonable but mistaken officer could have believed an officer believed that failure to produce ID constituted a crime is a justifiable reason to arrest the citizen is absolute insanity. That judge basically said that the officer has no obligation to know the law but just because he believes he is right he can violate the law. This is absolute insanity and it is very fortunate that the federal court overturned this absolute failure by the judge to adjudicate the event in accordance with law instead of opinion. This is very chilling to see that the district court is willing to allow officers to violate the law just because the may have thought they were justified.

the lowest levels of district judges are literally just drones of the blue line gang. even when there is case law in THEIR OWN DISTRICT, they continually dismiss cases like this because "poor widdle cops cannot be expected to know the law and do their jobs correctly"

Just let the cops do whatever and comply... You can always take them to court later. It may cost many thousands of dollars and be a decade later, but you might just get a small win if you don't get too many corrupt judges.

Local courts across the country are notorious for misapplying the law in their rulings to benefit the cops & prosecutors. They damn well know that there are multiple Supreme Court rulings about not being able to force someone to hand over an ID card or DL, except as a driver during a lawful traffic stop. Its the same in all 50 states. They do this in hopes that the person suing doesn't have enough money to file an appeal, which does work in their favor much more than it should.

Aside from the mental gymnastics needed to even bring up arguable probable cause is the complete ignoring by the local court of Supreme Court precedence related to demanding physical ID under threat of arrest. Its common knowledge and the judge who granted QI should be removed from the bench and disbarred.

​@jennym007 I was unable to find out if the two cops were actually fired, but probably not, unless their was a long documented history of similar behavior. But they undoubtedly carry insurance provided for them at taxpayer expense to cover lawsuit awards in cases where their qualified immunity is stripped. They may also have protected their assets in other ways. It is highly unlikely that they lost much at all, which is why this behavior continues, a total lack of personal accountability.

Australian cop here, 20+ years. When i went through training back when, it was drilled into us to know the common laws and regulations that we were most likely to deal with on any given day. And to know what powers you had and didn't have. And when in doubt, get a second opinion (senior officer). It's not foolproof, but it will definitely serve you well. On saying all that, some people are just stupid and/or don't have common sense.

I remember a deputy in my parish stopping a 15yo intoxicated female who was walking the roads at night. Instead of getting ahold to her guardian, he took her to his house and slept with her. The Livingston Parish Sheriff Office gave the deputy the most horrible punishment a Louisiana law enforcement officer can get.... They fired him.

Just because someone makes a phone call doesn't mean (1) their call is legit or truthful and (2) the cops get to violate your 4th A rights while they do a supposed investigation. Automatically putting people in handcuffs while they investigate shouldn't be allowed either. If cops are going to put someone in handcuffs, there better be an arrestable offense. Someone working on a car isn't against the law, so detainment in handcuffs should be considered a kidnapping.

@@dougaltolan3017They aren’t even entitled to an ID. The did not have Reasonable Articulable Suspicion of a Crime, even with the call about it. They had perhaps an Articulable Suspicion of a Crime. But it was not Reasonable. And they made zero attempt to address that lack of Reasonableness. Those men gave an adequate explanation, and their behavior was not consistent with criminality. Further dispelling Reasonableness and Articulableness. They could have attempted to investigate further in order to determine if they were or were not actually working at the request of the Owner. Instead. They attempted to immediately demand ID. Which they did not yet have the appropriate level of Evidence for. Then upon just refusal, they went to Arrest. Which requires actual Probable Cause, which is a higher standard. Which they had nothing approaching, and made zero attempt to obtain either. Instead they began with Obstruction, which is only applied after either RAS or Probable Cause is obtained. Then further more than mere failure to obey immediately. Or even mere Passive Resistance while attempting to discuss the Investigation at hand. Under no Rubric of Lawful and Constitutional Use of Force are they Justified. Pretty straightforward if you know the Law as it Stands, and why it exists as it does.

Because the federal government does everything it can to keep our rights "out of reach". They even abuse their own authority and CREATE laws that, in effect, hold our LEO's to be ABOVE the law. Things like Qualified Immunity. The Supreme Court has the responsibility to interpret the law, NOT create law. They knew what they were doing when they made it. And they knew it wouldn't stand up indefinitely so to further obfuscate our ability to prove any violations of our rights they "invented" the oh so popular "well established rights" condition to our rights. They know this also won't last indefinitely so I can't wait to see what their next rabbit out of their hat looks like.

Security guards don't get paid enough to deal with suspected car thieves that might have guns. That's why cops were called. Don't blame the security guard for what is essentially the cop's responsibility. And yes the cops screwed up big time, but they are supposedly trained for these kind of situations, security guards have few if any training.

Because that would have been not only LOGICAL, but good police work, ie: do their investigation. They're lazy and an arrest "looks good" for them. Nevermind how it impacts the souls these cops swore to serve and protect.

Because security guards are often cowards whose only solution to anything is immediately calling the police. They need to be trained better. Just because someone could be out there committing a crime doesn't mean they are, and they are in fact most likely not. Furthermore, just because someone might be committing a crime doesn't mean they're going to have a weapon, and even armed criminals aren't all that likely to attack a security guard for merely questioning them. If you're that terrified of confrontation, look for a new line of work. All of this could have been prevented with a simple conversation and phone call to the mechanic's client. The crooked cops here simply made a bad situation even worse.

I can see obstruction as an individual charge but it should be narrowed as the police have just been using it as a catch-all. Resisting, on the other hand, should not be a standalone charge.

The district court's first pass on the case basically amounted to "a reasonable person might not know better, so we're not going to hold them accountable." So ignorance of the law IS a reasonable excuse for breaking the law, per the court.

That guy just wanted to waste the officers time. He was fully willing to comply after being arrested yet before it was "I don't have to show you my ID muh rights I'm big I'm strong" then he folded like a wet paper towel when his convictions about "I don't have to ID myself" was tested. Next time he's gonna comply.

​@sackeshi you may want to read the 4th Amendment. Also, when the law states one doesn't have to ID unless they have committed a crime.... they don't have to ID. The reason most people don't ID until threatened with arrest is to preserve their 4th A rights so they can have a basis for a lawsuit against the cops.

Qualified immunity made sense for certain things but blanket immunity breeds this kind of "excellence". Not having that immunity would make officers more reticent to just throw people in jail.
