I think it’s most likely a genuine inability to comprehend all but the very simplest questions and concepts. I’m not advocating for him for a minute. But is it fair to put such people on the spot, on the assumption that they have a remotely functional IQ, if they simply don’t? Throw the book at him, but don’t go through the charade of pretending he will ever be able to provide a direct and coherent answer to the types of questions Boyd was asking here.

I spent only 1 semester in criminal defense in law school and the anxiety I would get when clients would take pleas is one of the reasons I didn’t become a defense attorney. Clients will just agree and say they understand their deals just because there’s a chance of a lower sentence. It doesn’t matter how many times you explain it or how simple you make it. As soon as a defendant facing 20 years hears that they could get 2 years they get tunnel vision, then this happens. I’ve seen this play out in front of me and they ended up with the 20 years. This defendant got so lucky it was only 4 On a more positive note Judge Boyd is absolutely killing it as usual today. Plus that scorpion broach and black handbag combo is immaculate

In asking to be released prior to sentencing, you lied to the judge by promising to show up and absconding. When asked why you didn’t show up, you lied to the judge over and over with excuse after excuse: you had “problems”, your daughter had a baby, you were sick, you had coronavirus, you have documentation from your doctor, you sent the court documentation about your illness, your daughter went to a hospital… Ridiculous. It’s quite possible the judge was on the fence about his prison time, hinging on his being truthful with the court. Instead, however, he takes an oath to the court and perjures himself, so the court reciprocates the courtesy in kind by way of 2 additional years in prison. FAFO

He doesn’t have anything to argue with, if the defendant had Covid and sought medical treatment, he would have paperwork from the clinic or ER, prescription receipts etc. All he had to do was notify his attorney and the court he was diagnosed with Covid, emailed or faxed-whatever the documents to attorney and court. A reset date easily issued and he appears at the new date.

If he really had Corona, he should have submitted that paperwork for court. That said, even with Corona, he doesn't need to be in isolation anymore, not to mention that had he communicated, perhaps Judge Boyd could have (emphasis on "could") approved a sentencing hearing via Zoom.

You think this man that won’t show up to court on the day where his sentence would be increased to 20 years if he didn’t show up, was showing up for school? Sometime, no matter how much help you offer a person, and trust me, he’s been offered help, because he’s been on probation before, and in this county and most others they offer and most times order people to participate with resources to help them, like mental health treatment, addiction services, parenting classes, housing, all sorts of resources to help people turn their lives around. Some people don’t want to be helped, you can’t blame a persons choices on everything else - that doesn’t help them nor anyone else.

I would have shown up even if I DID have COVID. His pregnant daughter is going to have to take care of herself while he is in prison! The judge should have given him the 5 years that the State asked for and he should have said “thanks for not giving me 20 years “

Shame on you, Judge Boyd. You want to hold this criminal accountable for not upholding his sworn word to return to court. You verbally and in writing told him, "Show up or 20 years". Now, your word is not any better than this criminal. He stood in front of you and lied, under oath, again. No wonder crime is so high in our nation. The criminals break the law over and over without repercussion, and the Judges join in by not holding a grown man fully accountable. Shame. You can and should do better.

Don’t other countries tend to avoid this problem by always having a prison term start immediately after sentencing? So you can go to court not knowing if you’ll be going home that afternoon, or if you’ll be mercilessly whisked away for several years without even a chance to say goodbye to loved ones. It’s quite the binary outcome. (Of course, this does provide a potential incentive to abscond on the assumption that you’re “getting bird”.)

I’ve watched dozens of these, and I can tell you this - when most clients say they “understand” or “agree” every time she asks a question, they have no idea what’s going on. They are just saying what their lawyers told them to say. Assigned PD lawyers, no matter the case or the situation, do not have the time, the energy, or the ability to explain what is going on to most of their defendants. It’s not the lawyers’ or the judge’s fault. It’s because most of their defendants can’t or won’t understand what is going on. If you never finished high school, which is the situation in most of these cases, do you think you would understand all the legal terminology and procedures in your case? Definitely not. Sad but true state of affairs in the American legal system.

the these poeple speak and act is incredable!every one i watch.have to turn on the sub title....they and none of them know s how to express themself or to propely speak!that what texting all the time do to the younger generation.they dont interac whit each other anymore...and him..i think he doesnt even know how to text!

I so wish the schools would teach kids to stand up straight, make eye contact, and speak clearly. It would make a world of difference in their lives.

No, his attorney negotiated a plea deal for him. The suspect violated the plea deal by not showing up in court when he was scheduled to do so. The attorney is trying to talk the judge into three years versus twenty. He’s doing his job- it’s not his fault if his client goes off the rails.
