If you’re being harassed by your boss or someone in management. First: document everything the evidence. Time and date. And the location when it happened 2nd: make sure you are right and not overreacting. 3rd: you have to report. Report in H.R every single time.they keep the records if they called you in court and they didn’t do anything about it. You won. 4th: keep documenting if you are still being harassed or bully. 5th: call a lawyer 6th: sue them.
At work not everyone is Equal, some are ABUSED while others get away with murder. People ABUSE People and that will never change until everyone in the workplace changes it. Yup, my wife is on an irritable prescription from the job retaliation from the lawsuit and now a hostile environment she called crying on the phone he did nothing boss did nothing abought the supervisor threatening my wife with written warnings. we are letting our lawyer know today.

I'm in Colorado & thinking about bringing a lawsuit against Walmart for various reasons, but main reason is a male co-worker threatened to fight me & rushed up to me, playing chicken. I have dates, places & times, not to mention camera proof & all of it is documented. Walmart said an investigation was going on, but I don't believe them. I was separated from my Dept most days & I was stressed &/or crying every morning getting ready for work. I finally handed in my two week notice yesterday after seeing the perpetrator stay, yet again, in my Dept & I had to leave. After 18 days, no resolution, no disciplinary action for my co-worker. After handing in my notice, I was terminated an hour & a half later. Now my livelihood is gone; stress & unhappiness remains, evil people keep their job & good people ran off. Can this work in my favor???

When I was working for a Care Home I was treated so unfairly and it was a hostile environment. Not only that but sexual harassment was happening to me almost every day. On top of that my fiance passed away and the owner of the company knew about everything. Fiance passing away and how I was being treated. So of course nothing was done. I decided to start making notes about everything I went through. Everyday I'd go home with something new. They ended up firing me. I'm glad I got a attorney who is willing to help me out. ❤️

And mine is true w pain and suffering via my therapist who can vouch and most importantly my physical health- which has been deteriorating rapidly and my MDs believe this as well. I’ve been in denial and it’s my medical team that are trying to help me see the “light”. I just don’t know what to do.

Had an industrial accident, management has no proper training before they put you on production floor. Accident has triggered my ptsd I had under control. Co worker involved caused a major accident weeks later plant fire. He was found to be under the influence of alcohol. I believe his negligence along with the company set me up for injury to occur. Shoulders and arms lower back injured. 165 lbs of boxes packed with corrosive chemicals fell on me.
I appreciate this video. I’m a young adult in my mid 20’s and I waited 6mo to get a promotion to manager after being promised the role. When officially offered the position I shook on a raise and accepted. This was witnessed by another manager between my GM and I. Then that GM was fired but the new temp GM, our DM, promised to move me up ASAP. Month or so later I finally am offered the role again, but now had to agree to a lesser wage. I negotiated for .25/hr (1.00 less per hour than previous) Mind you I was already passed up for manager by an employee with NO experience who started after me. Yesterday my co-manager team ambushed me with a one-sided meeting to address concerns specifically with me that were provably untrue and ripe with hypocrisy. I then tried to tenure my resignation with a two weeks notice and the newest temp GM (DM’s former boss and brother) and I was criticized further for allowing their unprofessional and completely offensive meeting to push me over the edge and try to peacefully bow out of my position. I have cited that I feel my workplace was hostile and toxic before and go out of my way to accommodate my fellow managers as well as motivate and congratulate my staff on their noteworthy accomplishments. I feel like I don’t owe this company anything anymore but I worked really hard to get where I am and pushed past over half a year of promises of growth before I got it. Lol even still, I havent recieved the proper manager uniform or the fair pay for my past experiences and time put into my company. I’ve been under multiple DM’s, several GM’s and before my promotion a sizable amount of Managers. With my experience shared, what should I do? Should I pursue hostile work environment or would I be better off walking away and attempting to find better/equal work? If I do pursue a case, based on the small amount of details I’ve shared, what is your opinion on the merit and value to doing so?

That's toooooo bad. When I worked in San Francisco, California, I was physically hit in the head by my supervisor with a folder, fell back and was caught by an associate. I had two witnesses and, at that time, no one would help me because the company was a fortune 100 company with lots of lawyers. After I reported it to a department in HR, I was fired two days later and told never to come near their company. This happened after successfully handling a payroll issue and getting lots of congratulations. I have always remembered this incident. This is why I have NEVER banked with BANK of AMERICA or any of their associate businesses. America and her continued abuse. WOW, looks like nothing has changed. While you have time, FIGHT BACK!!

Great question. Generally, the answer is yes, in part. New wages offset your economic losses from the unlawful act of your former employer. But it only affects one type of damages (economic damages). Emotional distress and punitive damages are unaffected. PLEASE TAKE NOTE - If someone are offered a comparable job and they turn it down (because they are trying to maximize their lawsuit settlement) the jury/arbitrator can decide to aware him/her zero damages. So, the moral of the story is, people cannot sit at home eating potato chips and refuse to look for a job. They need to get out there and find a new job, or show that they are earnestly looking for a new job, in order for the Court to award full economic damages.

@@braniganrobertsonlaw I have the Gout and I had the Gout / got fired from the job I had/ filed a complaint with the EEOC and I had went for race, discrimination, and disability, so it's 180 days that it takes for the EEOC to do its part/ I was fired on 10-14-20 and hired on 10-28-2019/ so I was in a hostile work environment, in my opinion/ I was target against, I had 2 doctor note and I still got fired for having the gout/ I was lied on and blame for 12hrs of down time and no work plus no production was because of me; because I had the Gout and I came to work with a ankle boot on. I was the assistant operator and the operator refuse to do his job and fix the machine and I had no knowledge and was never train to know or do the operator job. So the operator is buddy and friends with the operator he lied and cover for him and he left work before I did and I was sent back home at 7:22pm because the team lead said I could not work with the Gout and with the ankle boot on and before he got back the operator had left and clock; then I got blame for it th r next week on 10-14-20. I was told and suggested by the doctor to wear a ankle boot or medical metal ankle brace to support my Gout swollen ankle. What all can I due for? Defamation of character? Race, discrimination, disability, I was DENY FMLA, I had well over 2350hrs of WORK time / but in stead I was offer Short Term disability/ I was told by the supervisor that I did not qualify for FMLA but gave me card about Short Term disability and a paper form/ I've been out work since October 14th 2020/ plus my unepmloyment was suspended/ and HR had lied to the unemployment adjucator that I was the cause of the machine being down for 12hrs and no work and no production was done because of me/ the hr did not tell them or show them I had the GOUT/ just need to know what all type of law suit and claims I can go for and get ??? Race, disability, slander, Fraud because the hr did not show my doctors note I had the Gout. And lied to them about what really happened and falsey a LAW of uneployment against my claim/ Discrimination/ retailation/ hostile work environment, 3 people lied on me the HR, THE SUPERVISOR, AND TEAM LEAD

What about if you work for a company and they demote you to a lower paying position after the complaint? Do you think a lawyer would really take that case if there isnt going to be "bigger" payout?

@@LilBlazar Thank you for that. Before you hire a lawyer, make sure you trust the lawyer 100%. If he or she doesn't make personal time to speak with you, understand your concerns, and explain the process, don't hire that lawyer. On the other hand, if you feel great about the person and you are confident he/she will fight for you and has the time to do so, then I recommend you move forward. Lawyers and lawsuits are not fun, but achieving justice is usually worth it.
Can you sue for workers spreading lies about you? I have rumors spreading about me. New workers are greeted with rumors about me. One rumor is that im having sex with a man in the job. This has gone on for over a year.
Totally! You can even sue if someone looks at you wrong! Or, if they don't even look at you at all, you can sue! Then again maybe you've heard of the First Amendment - ya know freespeech and all that stuff
