Very information! We just filed an i-485 / AOS packet for my step brother, who arrived in November 2023 under the humanitarian parole program for Nicaraguans. He had an approved underlying i-130 filed by my mom. We have informed NVC that he was here and that we intended on adjusting status but we received a confusing email from NVC asking us to log in and pay fees. I was under the impression that NVC is to process IV for someone outside of the US. Is this accurate or is this something that we must do with NVC despite him receiving a visa via i-134A?

This is misinformation. Can parolees adjust status based on an employment-based petition? NO under INA §245(c)(7), an intending immigrant is ineligible for adjustment of status based on an employment-based petition under INA §203(b) if not in lawful non-immigrant status at the time of filing I-485. Parolee is NOT in a lawful nonimmigrant status.
