Allegations in a lawsuit filed by a Las Vegas man that one of the biggest delivery companies in America is re-selling its trucks without disclosing the true mileage on some of the vehicles is raising questions.

Alan, that is not necessarily true but in this instance it does not look good. We contract with an auction house to dispose of fleet vehicles. We have had to ban quite a few for not buying the vehicles that they win at auction. There are also other buyers who demand special private access to inspect the vehicles and they get upset when we say no, we ban them. Everyone has to have equal access and we disclose everything that we know about the unit to everyone on the website. In these instances the odometer reading was on the PCM. It could have been easily checked by FedEx. Some older units PCM's do not record that type of information and can be harder to disclose. But a cursory check of their maintenance records would go a long way..

That's why FED X likely created the spin off company to sell the vehicles. That company can go bankrupt and then they just start another one in some one else name. But the little guy has the LLC. If you are running a small business and you are an LLC you can absolutely protect your personal finances and property. to be honest every one can get away with it at least a few times. How do you think Trump has existed for so long as a billionaire. He has no money. He has positive cash flow on borrowed money.

Except that doesn't matter here because the third party obviously isn't the ones tampering with the mileage. They may have thought that's what would happen, which is why they are pointing the finger at them, but that makes no sense in this case. The third party isn't driving them for 100,000 miles, so they aren't the ones doing it.

@@catwhowalksbyhimself The third party is definitely to try and eliminate chain of custody and liability. However, I think where Fed-Ex will lose is that they do much of their own maintenance and therefore they are the ones who are not complying with federal law to make the odometer discrepancy disclosures. I want to side with Fed-Ex as it's the numbers of people involved and where the failure to disclose comes in, but as the video shows, there must be a disclosure "permanently affixed" to the driver door jamb. I know this because I am a certified Master auto technician and I replaced many instrument clusters/odometers with used units that had different odometer readings. Nowadays most of what I do is either have them rebuilt or replace with odometers programmed with the VIN and mileage. And if I return a cluster with a mileage that differs by more than roughly 100 miles, I do NOT get my $150-$400 core refund. So if I have to replace an odometer/instrument cluster, the vehicle sits at my shop until the new one comes in, the customer does NOT get to keep driving it in the 2-14 days it takes to get a cluster.

@@catwhowalksbyhimself The third party would've been expected to inspect those trucks before and should've reasonably known those odometers weren't the original so the guy can easily sue the third party seller, not knowing the law is not a defense and they can't just play dumb selling that many bad trucks. The third party is more than able to collect from Fedex after they got sued but if he's going straight for Fedex, it's because they had an immediate economic interest because they still get a piece of the auction profit. Both of them should've been named but Fedex especially knew they were sending bad trucks to auction.

I worked for CCX and we did it right we sent out new odometer/speedometer to a shop and had the milage set to what was on our trucks at the time of the odometer replacement and the trucks were out of service until the new odometer was replaced with the correct mileage. Fedex could have threatened to stop selling their trucks with them if he wasn't banned or they could have paid off the auction house. It will come up in court eventually as to how much the ah knows about the trucks and what they do to ensure information is accurate etc.

You will never find a used UPS truck for sale. They spec them from the manufacturer then rebuild until they can no longer be serviced and then destroys them.

The ups statement is false about them not selling their old trucks. A friend of mine bought 2 of them last year.. But ups did not mess with the odometers. And the show the true mileage for the trucks.

FedEx is the biggest scam delivery service in the world. They are extremely late with every package I’ve had through them, and they often blame me saying I never scheduled a delivery, when I in fact call every time to check if I need to, which they always say, “no need to schedule, it will arrive on time” and then never does.

They aren't late with our packages, but they have recently begun leaving our neighbors' packages at our house, requiring me to get into the car and finish their deliveries _FOR_ them. Everyone on this county road has their address numbers clearly marked on their mailbox post. Yet, my address of 5201 has been getting packages for 5864 and others. Hey, FedEx. Stop using Google Maps and look at the f*ckin' addresses, yourselves. That's how I did it 40 years ago when I was a delivery driver, and it worked perfectly every time.

Good look getting a hold of anybody at ARI! We use them as a fleet management company and they are horrible to deal with. A brake caliper sticking on right front rotor and they just replaced the caliper and pads on the bad side. Wouldn’t even let Firestone replace the pads on the other side! Brake pads comes in 2 pairs per box! Who only replaces one side? ARI is crooked!

@@darkzero11ca auction only knows what ARI puts on the ticket. The mileage is verified by someone, truck/car matches ticket. Truck is shown on camera, announcer reads the rocket,& auction commenced. They move cars/trucks through there as fast as the auctioneer can talk! Car Auctions are entertaining, or at least the Fresno auction used to be.

If the listing says “LOW MILES” and list another amount of mileage far lower than what they claim, that is done so with the intent of deception. Plain and simple. There is a reason why odometer swaps without disclosure is against the law. Because it is done with the sole intent to mislead and defraud the end buyer of the actual mileage and therefore stated condition of said vehicle. Just because an auction sells “as is”, doesn’t give them a free pass to violate the law and straight up lie and defraud people. I hope this guy wins and wins HUGE! And that the companies involved also end up with massive fines in the end. Along with an order to “cease and desist” this criminal practice!

I don't think that's what's happening. Fed Ex hand off the vehicle to their contractor, ARI, when it hits X-Mileage. ARI are then running a workshop scam and swapping out the odometers, and then sticking them in auction. ARI profits are boosted. It sounds bizarre, but Fed Ex are being scammed too, but instead of losing money, they're making it, but only because the contract with ARI is a profit share. I bet dollars to donuts that the court rule in favour of Fed Ex. It's ARI that need investigating, at a criminal level.

@@Jin-Ro Well I don't think that's the case as it appears that fedex has already shown documentation that the vehicle's odometers were changed while 'in service' by FedEx fleet services,... And that ARI is simply the 3rd party seller of vehicles through auction determining a price and profiting from the amount above and beyond the estimated value that FedEx expects to get for the vehicles. It's simply appears at fedex was negligent by missing a federally mandated step of documenting the fact that the vehicles mileage is not accurate anymore since their fleet services didn't actually adjust the new odometers to reflect the actual mileage of the vehicle or apply a simple decal to disclose the fact that the existing odometer doesn't reflect the actual mileage of said vehicle. All title/pink slips on motor vehicles have the question and an area to disclose what the known mileage is or if the mileage is unknown that requires a signed acknowledgement from the seller to the new owner of these facts.

Don't go thinking that FedEx is too reputable to be doing such things, remember its all individuals making decisions, and if it helps them get their bonuses, they'll do it. Its FedEx doing the swaps no doubt, and that's a very high failure rate for odometers too, that also makes me suspicious.

Love how UPS was willing to throw a jab at FedEx with that statement. I hope this guy wins and includes the auction house in the lawsuit. I also hope this gets the FBI involved and large fines are issued to both companies. This is all the more reason I like UPS better than FedEx

The auction house represents the vehicle they are required by law to disclose anything they find the buyer does not get the right to inspect anything beyond the visual FedEx has violated federal statutes and continues to do so defending the two companies involved is misinformed at best.

@@HobbyOrganist Thats beyond the point though. The point is, by law, it needs to be disclosed. Falsely representing vehicles, regardless of their condition, is FRAUD. Fraud is illegal. It doesn't matter if they were run into the ground or cream puffs. The lawsuit isn't about the condition of an AS IS sale, it is about the negligent misrepresentation of said vehicles. While you bring up some good points regarding condition, that is up to the buyer to investigate prior to sale. Odometer fraud however should not be up to the buyer to investigate, which is why these laws exist.

Most of these ground trucks are owned by independent contractors, not by FedEx themselves. I drove for “FedEx” but technically I worked for a small business that personally owned about a dozen delivery vehicles. It’s confusing. Express and freight is different because they are run directly by FedEx

The red “Ex” on the FedEx logo on truck body is FedEx owned... The trucks that have the green letters “Ex” of the FedEx logo are independent contractors? Most of the step vans in the big cities have the green letters.

@Michael-D Smith The ground part of FedEx is owned by independent contractors the independent contractors buy either used or brand new from a dealer. Express and freight and office trucks are through FedEx owned and operated.

If FedEx knew their partner was breaking the law and did nothing, they can still be held liable by turning a blind eye. After all they are the ones profiting the most from it.

Odometer tampering is outright fraud. One of the big three got caught doing this to their own executive fleet cars being sold as new back in the 80s. All my cars have had legit low mileage but people never believe me because of all the scammers out there. I just don't drive often or far.

That's true. They should be as liable as any professional seller down the chain who sells any vehicle. They must surely have OBD2 meters to check for vehicle problems, including the odometer. The computers of modern vehicles record the true mileage. All mechanics should know that and so should all vehicle sales people.

@@jublywubly the auction houses usually don't get the time to do a check over by mechanic as the cars/ trucks usually come in to a hold yard then shipped out to the sales floor all within a few days with 100's of other items. the auction houses rely on the word of the third party dealer in this case ARI to have the correct details and have in their legal documents that the auction house has no liability over said vehicle

@@gore1978 You're right. It's a long time since I've been to an automotive auction. I forgot that most of them act as third party sellers on behalf of other people. There is one dealership near me that sells cars in their retail dealership, but they also sell them at auction. In their case, they're selling their own cars, so they'd be liable for any errors. However, they'd be the exception to the rule.

Ok, as a 25 year diesel technician, fleet and independent, I can tell you that speedometers fail quite frequently. I have changed dozens. Tech orders parts, parts come in, as new 0 mile reading and it gets installed. Some times it will be documented, sometimes not. You can access the ECM, but those fail too, and when they do, sometimes they can be downloaded, and reprogrammed to the new module, however, they can lose internal memory when they fail as well. My honest opinion, FedEx just wants their equipment fixed economically and doesn't care. The auction house is the one taking advantage of both sides of the situation. But seriously buyer beware, you can't honestly think a 90's delivery vehicle would have 80,000 miles on it really???

This sounds like 25% to 50% failure rate and that seems rather high. As for the buyer not questioning the low mileage, I wondered about that myself, especially if you knew it was a Fedex truck. Maybe if it was something like a food truck from new where is was driven to locations and spent most of its time parked in a location. You see low mileage vs age on lots of RVs because even if they are drive cross country, they also spend a lot of time parked.

The law says you have disclose the information about the odometers being changed out. If an individual or corporation fails to comply with the law, there is a legal liability. The Federal Trade Commission or perhaps FBI should investigate.

@@JohnDayDude If this happened a few times, one could chalk it up to sloppy paperwork or an accident. On the scale that is being reported here this is either deliberate fraud or massive negligence. Either way, you are correct, it should be investigated and folks at the top prosecuted. I just doubt that will happen.

I can't say who I work for because I've got bills to pay, but I will say that their vehicles wouldn't pass a crash test when they were built. Now they're all over 30 years old and scary as hell. One of our maintenance guys replaced a faulty brake line on my vehicle, on the same side, three days in a row, before he finally got a good one. Yes the brakes went out 3 days in a row while I was driving. Yay Me. Recently, my vehicle wouldn't start so they replaced the distributor. About an hour into my route, the brand new distributer went out again. The horn usually doesn't work, unless you're turning, then it just honks on its own. There's a "fresh air" vent, that is worn out and won't close, in the firewall, coming straight from the engine compartment directly into the cab. It comes out right under the fan that is mounted on the dash, so it blows that hot air right on us. It's the only air vent in the cab. When it rains, the windows fog up and the defroster isn't powerful enough to clear the fog. The windshield wipers get caught in the bolts (yes BOLTS) that hold the windshield in place, so the wipers are always messed up when it rains. Most of the windshields leak and the water runs right down the inside firewall onto the fuse block. There is literally a puddle in the floor of my vehicle, when it rains The wiring has never been replaced on these vehicles so, sometimes they just catch on fire. The good news is, sometime between now and the next 10 years, we're supposed to be getting our new fleet of trucks that we were supposed to get 10 years ago. WOOHOO!!!

I was a general manager at a auto repair shop and ok be of our fleet accounts was Fed ex I noticed that when the same truck would come in the mileage wouldn't be correct for six or ten months I would ask their fleet manager and he'd say oh we don't use that truck, it was a running joke in our shop we knew they were trading them in. 😂

Changing odometers on stepvans seems to be a common industry practice. I bought several vans from Frito-lay, and just about all of them had their odometer changed. The big difference is they had the sticker stating this fact so you knew. It seems when they went in for a company refurbish, they swapped in a new odometer since it was a new engine and a "new" van to them. Again, at least they were honest enough to tell you this, so you knew what you were getting.

Hard to believe that many odometers failed. Seem like it should be easy enough to convince a court why they were not disclosing the odometer change. FEDEX is pointing a finger at the other company but reaped the benefits of a higher sale price.

Depends on what else is wrong with it. It really does not take a whole lot to make fixing a fleet vehicle worth less than a replacement. Between the base model price and usually some form of discount for a bulk order something as simple (yet generally expensive) as lifter collapse become more expensive than the cost to replace.... to the company. Lets say the truck is worth 10k but needs 5k in repairs (making it really worth 5k) you sell it for 4k, the other guy dumps the 5k into it and gets a truck for a little less than what it is worth. Meanwhile the company writes the 6k difference off on their taxes and goes ahead and buys a new one for 25k and then writes that off as an expense as well.

No they shouldn’t. Not if the listing says “LOW MILES” and list another amount of mileage far lower than what they claim. There is a reason why odometer swaps without disclosure is against the law. Because it is done with the sole intent to mislead and defraud the end buyer of the actual mileage and therefore stated condition of said vehicle. Just because an auction sells “as is”, doesn’t give them a free pass to violate the law and straight up lie and defraud people. I hope this guy wins and wins HUGE! And that the companies involved also end up with massive fines in the end. Along with an order to “cease and desist” this criminal practice!

The way i've been REPEATEDLY treated by FedEx, this totally makes sense. Even when they make a mistake, or send your package to Kalamazoo instead of Colorado, they always, ALWAYS try to blame the customer. In my business, i am seeing more & more companies that i deal with, that have notices on their websites and in their literature that say "WE DO NOT USE FEDEX",...there's a reason for that. Guess what it is. Go on, i dare ya',...LOL They will actually change the delivery date on their website on the daily. I once had them change it 5 times! It will tell you that the package will be there tomorrow,...tomorrow it changes to the next day,...then the next day it changes to the following day,..and so on. Haven't had anything delivered by FedEx in quite a few months now. If they don't clean up their act, i never want to use them or have them deliver to me again. I've also seen the "WE DO NOT USE FEDEX" disclaimer on TV ads for merchandise.

I wouldn't mind them changing the delivery date, if I could pick up my package at their facility.. Re-scheduling happens. My beef is with them leaving packages out by the street, or on a fence post, because they're in too big of a hurry to walk up to the door. They leave packages in my mailbox so the mailman can't get my mail in there. That is still against the law. They also won't let you go to their facility to pick up a package that needs to be signed for. They expect you to take off work and stay at your house until they show up. Then, what if they don't show up that day? They just have poor business practices that need to be changed. They truly don't care about the customer.

Don't think FEDEX is alone. It's just their logo in the news. UPS and any of hundreds of fleet owners needing to liquidate old broken down trucks can and likely is doing this same shit. Just now Hearing about this sorta shit, doesn't means it's not an old con. The old school version of this is sawdust in the differential to quiet trashed gears, effective for a little while, but not the only version of such stuff.

They were contracted by FedEx. FedEx is, in the end, responsible. When American Airlines was using smaller planes for short flights, they claimed that is was not their planes as they had "contracted" out the flights. The courts held that they were responsible anyway because the tickets were sold by American Airlines. The trucks are FedEx trucks, originally, and ARI is contracted (by FedEx) to sell them. In effect, FedEx IS selling them. They are just using an outside contractor to do it. Ultimately, I believe a court will rule against FedEx. The real criminals here are the auctions.

I knew years ago when vehicles were using digital or electronic Odometers it would cause more and newer problems this story is big if FedEx themselves is doing this they should be seriously fined I too have seen those trucks sold alt with low miles

I work for fedex and the only time they would ever get rid of trucks is either they have high miles or they're not worth fixing. Usually it's the latter, especially now.

Thank you for pursuing this. People that pad their pocket's off the back of the working man are the reason our society is crumbling. All this litigation is a waste. There's a crook stealing from us all when they steal from you. The crook has been singled out & a Judge needs to end this. It sounds like someone is being protected...

What is very, very sad is your local and State law enforcement fails to do anything about this because its against a big company. We have filed at least 6 State complaints and all have closed the investigation saying FedEx is an out of State company and they have no control over them. If YOU or I did this we would already be in prison !!!

Big corporations aren’t doing it, buildings are not going around harming people and ripping them off... it’s people within the business who are doing the harming of people and ripping off of people lol. INDIVIDUAL PEOPLE need to be held accountable BASED ON THEIR INDIVIDUAL PARTICIPATION IN EAXH INDIVIDUAL CRIME THEY ARE BEING HELD ACCOUNTABLE FOR and board members and executives need to be replaced with people WITH MORALS WHO ACTUALLY CARE ABOUT PEOPLE, food, OTHER ANIMALS and our environment.

@@aembusiness but the employees are part of the business... their actions on company time directly reflect the company. His point is that it is a corporate problem because it’s not being addressed weather they gave the order or not. Every employee represents your corporation. Im pretty sure the guy at fleet sales isn’t changing odometers for his personal financial gain. Someone told him to do it. 1 or 2 trucks is one thing. This dude bought over 100 trucks and 96 had the odometers changed. Thats not a mistake on one individual at FedEx.

Auctions are "as is, no warranty" dealing. Nobody ever complains when they get a vehicle they thought was trash, but a $3 part fixes. It's called an auction because it's a gamble
