Lawyer Reacts : Mark Means - Lori Vallow Daybell's Attorney Removed From Case 

Mark Means was in way over his head. He filed ridiculous motions. He doesn’t have the skill set to know the difference between a criminal and civil trial.

Thank you Peter. I believe the judge made the correct decision to best serve Lori. She was declared indigent before she was declared mental incompetent. Means is not a criminal attorney much less a death penalty qualified attorney, Means is a family law attorney. I personally don’t want her to be able to appeal on ineffective assistance ( or whatever it’s called).

Great job breaking down the legalities. This is a complicated case and I hope Idaho’s court system will deem Lori Vallow competent to stand trial as soon as possible.

Greetings from Argentina Peter, on this new year. I have a question with regards to the "right to choose your counsel". As someone outside the profession, my understanding is that your right is to have a counsel, not to choose a counsel. That's why, if you can't pay one, you're left with the one that the jurisdiction provides for you. Otherwise the jurisdiction wold be infringing on the right to choose their counsel on those without means. Just wondering... and a great 2022 to the Peters, to Big George and to all the families.

If Lori eventually is declared competent and insists on having Mark Means as her attorney, will that preclude her from appealing based on ineffective assistance of counsel down the line. My brain says she waives that reason for appealing on that ground. Her choice could have consequences.

When Lori told mark means that she was his mom in a previous life, that was a huge red flag to me about his thoughts of her considering the odd relationship between them. Now he's moved to the state of Chad and Lori's "end of days", wow! This whole thing is wild! I don't know what's more frightening, Chad's involvement while sane, or Lori's while very mentally ill. Great breakdown of means' removal.

Idea for your consideration in future videos: the retrial in Florida of Katherine Magbanua (Dan Markel/ Adelson family, need I say more?) begins in February. Tragic and fascinating, with a side order of the reality of the two justice systems.

I think the court absolutely made the right decision. Not only does Lori need competent legal assistance, as every person deserves... but Mark Means was turning this entire procedure into a circus and a joke. Everyone involved, including the deceased, deserve to be treated better than that.

Basically, the court is saying the state doesn’t like your lawyer and we are giving you a lawyer that will play ball (our game).

Given that she is indigent, how does this affect her choice of counsel?

Honestly I think its a moot point since Lori Vallow will probably never be deemed competent.

Is there a risk of mistrial if the attorney is disqualified as has happened here and the defendant then saying she was denied counsel of her choice and/or leaving an unqualified counsel of her choosing in place? If so, which would carry the greater risk? Or is that even something the judge would be able to take into consideration at all at this stage [i.e the judge can only rule on conflict of interest at this point]? As a Brit, we do day-month-year dates so the month-day-year system throws me completely 😂 Two things in the same month sound like one happened in February & the other happened in September!

Of course Lori will fight it.... anything to delay being confronted and convicted works in her favor.

If the court can impose stricter rules on lawyers because it's a capital case, why does it not allow the cases to be severed in the name of convenience and economy?

My question for you is does the fact that Lori is watching/listening to these hearings, reading legal documents and communicating with her attorney say anything to you about her competency? It seems to me that an incompetent defendant wouldn't be involved in any of these proceedings if they were truly incompetent but idk the law. Can you fill us in on this please

Well Peter, I enjoyed it and I also realize why I am not a lawyer- Jeeze- my ADD kicked in about 5 minutes into your explanation but I think I have the gist of it. ( although do we really care what LV thinks ? Lol ). Okay, Lori should be able to keep the lawyer she hired and confided in, but that lawyer is not a competent lawyer, sooooo they scheduled another hearing…… for what? It’s so cute that Lori watches the hearings from the mental hospital, I wonder if she gets Netflix?

This is fascinating, seeing how the sausage is made wrt this horrific case. Mark Means checks all the boxes in the ‘Sleazy Lawyer’ column. The 2 perps:: Evil Bimbo and Stormy Prophet of Doom, had it all figured out…until they didn’t

Agreed. It appears the fix is in and they want her convicted…why else would her basic right to choose her lawyer be denied. The court is choosing her lawyer with the expectation that that lawyer will do the courts biddening. I see appeals going on for year. If a court, based on the opposing parties motion (desire) can take away your right to choose counsel we might as well be guilty until proven innocent.

LV may have chosen MM but since she was declared indigent MM was being paid by the state. Does this make a difference in her "choosing" him? He is not death qualified. MM also filed motions while her case is stayed, how is he visiting and getting factual assertions he placed in these filings and does this not affect this judgement? You saw from previous filings in this case MM asked for sanctions and all court costs etc to be executed against the prosecution. I hope the state auditor goes over his "bill" with a fine toothed comb to prevent extreme overpayment.

Can a conflict of interest, on the part of the attorney, be determined, after a decision has been reached, in a case? And can a case decision, be overturned, based on such a conflict of interest? Could the lawyer be disbarred for taking on the conflict of interest?

Mark Means ego got in the way of this Case, he was totally in over his head, but he kept pushing on and only drawing negative attention to himself...The Judge certainly made the right decision...He seemed like a real nightmare for anyone dealing with him...Jim Archibald seems the complete apposite to Mark Means, but will manipulating Lori be happy with JA? Please don’t forget she was deemed indigent and he stayed and that is why Archibald who is death qualified attorney was also added to her attorney team. Means was kept on the team. Prior to her being deemed incompetent she was already deemed indigent. And right after that Means through a fit about billing for a trip to Rexburg for materials.

As soon as Lori is deemed competent, she is gonna scream bloody-hell, may become destructive, will claim that the court is playing a crooked game, etc.

Wasn’t the other attorney disqualified too? I thought an attorney can represent a person for multiple cases This whole case is such a shit show. It feels like they’re in the news every week for some new twist or turn in the case. But he’s been trying to separate his case from hers from the beginning. So wouldn’t paying for her lawyer give him an advantage over her ?

I believe Means should have been removed from the beginning. That is since it is a death penalty. I hope Prior is the next to go. I felt like Prior and Means teamed up together to attack the state.

☠️ *~ My only comment is I hate the theory that “death is different“. In fact, when your sentence to death you actually get MORE rights for appeal and better attorneys than you would if you were sentenced to life in prison without the possibility of parole. A death penalty actually has many more rights. That’s why there was even a guy recently that once he was convicted of murders, He actually wanted to be sent to death so that way he would have better attorneys for appeals. I think he was convicted of murder by arson on several houses.* And also, many people would prefer to be on death row then in a prison that would eat them alive for the rest of their life. That’s a second point.

I agree with the court that Lori's best interest must be protected , especially while she is deemed incompetent to understand what is going on in her case. Once she regains her understanding she should be allowed to fire Mr Archibald if she believes he does not have the proper grasp on her case. However, Mr Means has undone himself. I do not think he should be allowed back on the case

Please stop calling her Vallow , she does not deserve that name .................................................... she is married to Daybell or did they divorce ?
