@@traceyduffy3849- People always think they’re living a miserable life behind bars, but they still get three meals a day, they have Internet access, access to books and a tv. They can make friends in prison AND they get mail…fan mail. Some of the most infamous serial killers in the U.S. had constant fan mail. Look at Jodi Arias, she is making lots of money even behind bars. We like to fool ourselves thinking “justice has been served” when in fact WE the taxpayers continue to get punished for the choices other people made.

I think it is unfair to the children that Vallow-Daybell wasn't punished to the full extent of the law. She wanted her kids eliminated to live her fantasy life and for the money, too.

I think the judge addressed this filing perfectly. It seems as though Chad and his attorney’s wanted him to have the best of both worlds. In short, he waived speedy trial so that he and his team could hear the all the state’s evidence against and allow his team to better prepare his defense and he wanted to benefit from the death penalty removed just as it was in Lori’s case; however, his lawyers choose to disregard the reason it was removed in Lori’s case (a remedy) and instead try to argue it “wasn’t fair” for the death penalty to be considered in his case if it wasn’t in hers. The judge was absolutely right in reasoning the two cases are not the same, since the evidence hasn’t yet been heard in his case he can not rule on Chad’s culpability , and lastly…it is not the judge who decides creates laws it is the legislators and voters. All in all a very well reasoned decision by the judge in my humble opinion.

@@specialsause949 well he was a gravedigger in the graves were found in his backyard. There is that that kind of smells bad to me. He kept telling friends and neighbours that his wife was going to die very soon. He seemed to know that ahead of time there is that too.

I’m surprised Lori and Chad fought so hard against it the DP They seem to obsess about the other side, how wonderful it is and according to Lori she longs for the day she will be with her kids. Seems to me they don’t believe the BS they spewed. Otherwise they would want the DP in order to get to the other side.

He, has,at least, to answer for Tammy´s death. Lori might have been part of conspiracy but he was telling people about Tammy´s death for years....imo. I hope state connects him with Charles´s conspiracy.

Lori isn't innocent by any standards but I do think Chad was very manipulative and could have put the breaks on the more extreme actions that resulted from his "teachings". From my understanding, Chad had tried the same tactics with other women but Lori appears to have been the easiest to influence thanks to her delusional issues. She is not well but she knows right from wrong. Chad doesn't have that excuse.

He was the ringleader and she’s crazy. If ever there was a case that deserved the death penalty, this is one of them. This case and the Watts’ case are the two most heinous, hideous, crime cases, I’ve ever heard of. The law should do what it’s meant to do. Some don’t deserve to walk among us.

⁠@@aliciathegem3243Daybell will definitely serve way over 10 years while going through all his appeals. Unfortunately, DP cases have so many appeals before the DP is carried out. Some sit on D row more than 20-25 years exhausting appeals. Then there are issues with carrying out the DP. Idaho uses lethal injection. Most states cannot get the meds to carry out this process as the pharmaceutical companies are not selling the meds to the states for this reason. Right now, in Ohio, the state is so behind on carrying out their injections because of lack of meds that they are looking to change the system.

At this point in time, I think Judge Boyce’s decision is fair. It’s going to be tough listening to this again, but I’m eager to hear the state’s evidence as well as CD’s defense. I can’t begin to imagine what it will be, other than to put it all on Lori.

One can’t help but remember Chad Daybell’s atty. who so diligently monitored Lori’s trial. He appeared to be very determined. Does he think he found “holes” in Lori’s case that he’ll try to avoid?

I think this ruling is very fair. He can’t have his cake and eat it too. He wanted to be separate from Lori and have his own trial. He can’t expect the same favors from the court they she got (no dp) since it is a different trial with a different set of circumstances.

He is charged with an additional crime she wasn't, so he should be held to a different standard. I waiver back and forth on the death penalty. I think for some, it is necessary, but there are too many who have been exonerated after being on death row for years or even after their death to buy into it completely. It's a case by case basis for me

Every decision we make, even when it comes to exercising rights, has consequences. In a criminal trial, the decision to waive speedy trial was a calculated risk. Whether it paid off or not will be seen during trial. I should hope that Daybell’s lawyers explained to him that when the cases were severed it meant that he was risking not being included in any favorable judgment made in the second case. If not that may give him grounds for appeal. But once the cases were severed, they became completely separate cases, and any judgments made for Vallow-Daybell’s case should be irrelevant to Daybell’s. It would be like someone arguing that a favorable ruling in one case should apply to all cases in the future.

That's literally how precedent works. The outcome of one case does indeed influence how other cases go about. But I get what you mean by these two cases. I don't see that happening though. Usually, cases are severed for this very reason - to use the evidence and testimony of one case to secure a conviction of the other. This is especially for co-conspirators who've been involved in the same crime.

Death penalty should stay on the table. It is appropriate. The deadly penalty was removed from LVD case because of a technicality that did not occur in CD case.

In my opinion LWOP is the worst punishment. Seth row inmates get nicer accommodations and Chad will die of old age before he’s ever executed. Carrying out executions take decades.

@@mandystrong8196 very true and I agree with you one hundred percent, but sometimes victim’s families feel like the defendant didn’t get the most serious punishment there is available in their state and are left feeling down. Sometimes it is the same family who asks for Life in prision WP but others feel like they want the most severe sentence there to have justice for their loved one. It’s nice they will have the option.

Yes, it is fair--- If I understand it right, Lori did not get DP because the State messed up filing to seek DP. A clerical misstep. For Chad the state filed in a timely matter.

I'm confused. I thought Lori was also accused of Tammy Daybell's murder. What is the exact difference between what Lori was charged with and what Chad is charged with, please?

@aliciathegem3243 , Thank you. It's interesting that in Idaho, there is a distinction. I've been keeping up with the trials for the killers of Dan Markel, and apparently, in Florida, there is no distinction between actual killers and conspirators -- they both face the same consequences.

@baker_canner yes I think it is the same consequences however Chad is charged with both the conspiracy and the murder so I believe it's an actual charge, so he is on trial for conspiring then actually committing the act, wete as Lori was only charged for the one offence. So they can sentence the conspiracy charge then again sentence the murder charge even though the consequences are the same, if that makes any sense.

Great video! Learned so much from your analysis - you unpacked the rationale so thoroughly - and with insight- and with respect for others as always. I agree with the decision - but I will say the last line about the jury deciding the punishment makes me wonder if the judge overstepped his role by removing the DP, if he could have found some other way to mitigate the delay?

The death penalty is so hard on the families of the victims. Throughout life they must show up to contest hearings called by the inmate to stop the death penalty. It's a long hard h3ll for everyone.

I agree. Carrying out an execution takes decades and victims having to follow the appeals process instead of healing is constant reminder of their losses. Plus death row inmates get nicer accommodations and are protected from the Karma that may come in Gen Pop.

They both were meant for DP. It was a sanction against Prosecution to drop DP for LVD. Chud, is up on 1st degree m*rder charges for Tammy, along with the co conspiracy charges. It makes sense that DP would stay, so long as Prosecution doesnt F that up for all of us.

It would be interesting to know how the Judge felt about the death penalty once Vallow was found guilty. Although his ruling to remove it was proper and certainly fortuitous for Vallow, and although we will never know, I wondered then and now if, given the horrendous nature of these deaths, the Judge secretly wished he hadn't- or didn't have to- remove it for Vallow. He also reminds us that the death penalty will be the jury's decision. Daybell deserves it. It will also be interesting to see if Daybell pleads before trial.

I do get the feeling sometimes as if the state says, "If you're going to make us do this, if you don't comply, if you don't go away quietly (plead), if you are investigating and chasing all possibilities, we are going to come down like a hammer." Prior & Chad thought they won by getting the cases severed. I never saw this as a win given the sanctions & Vallow no longer facing the DP when they severed. I felt Prior & Daybell would regret the decision down the line. What I find incredible is that a defendant can get the DP removed over sanctions. I think there should be ramifications when sanctions are ordered but when it comes to the DP, I don’t think this should be included. People face the DP for a very good reason. They both should be facing the DP. The Prosecution def failed with their actions that led to sanctions in Vallow’s case.

How come Bryan Kohbergers defence didn't use the same tactic of not waiving the speedy trial and therefore taking DP off the table due to the fact that the prosecution wasnt disclosing some discovery ? Could they have not done the same ?

My first thought was that this was a retaliation for Daybell waiving his speedy trial right and costing Idaho more money on a second trial, so the DP should be dropped. But upon hearing that he was charged with his wife's death and Vallow was not, it made sense to keep the DP. IMO, the death penalty is warranted in his case. You brought up something else I was thinking about. If AT had advised BK to not give up his speedy trial, they may have gotten the DP dropped for failure of the state to turn over all discovery whether BT's fault or failure of Judge John to order the IGG evidence to be turned over earlier. Without time to prepare, BK still may have gotten life though. You are damned if you do and damned if you don't.

Sorry that this is going to be a little long. I want to say that I do have a bachelor's degree in criminal justice, and that was directly due to things that happened in my childhood. I have different views on the death penalty. My grandfather was brutally murdered in his home when I was in 5th grade. To escape the death penalty, the perpetrators pled guilty. The driver of the car was in prison for 10 yrs before release, and we were not notified of his release, and my grandmother saw him out in town. The 2 in the house blamed each other so we did not know for @ 30 years which one actually did it. We were subjected to years of parole hearings. I don't think there's enough words to describe how torturous it is to have to travel to different prisons to attend these hearings and having to see the people who were so callous with someone else's life. The one who actually murdered my grandfather actually admitted it about 4 years before he died of cancer. The 3rd man is now out of prison as well. I feel when there is absolutely no proof that anyone else could possibly have committed the crime, the at the very least, these criminals should have life with no parole. I 100% resent having to use tax payer money to give medical treatment to cancer when there are hard working non criminals who cannot afford the same treatments. With that being said, it is also ridiculous the amount of tax payer money that it takes to maintain someone on death row while they exhaust all appeals. Tax payers are better off with criminals being in prison for the rest of their lives with no parole as it is cheaper overall. I think my biggest concern with the death penalty is the number of people who have sat on death row or have been executed who were innocent. For instance, the West Memphis Three come to mind. The justice system definitely needs to own up when they have made mistakes with any aspect of the cases, whether that's at the court level or law enforcement level. The WM3 are trying to get DNA testing performed on evidence, and the courts are blocking them at every turn. If they truly thought that had the right people, then they should not be afraid to let the defense have those items tested. I hope all this made sense. I really appreciate your all you do Peter.
