Learn the basic about the difference between the equitable and registered mortgage. Both these type of mortgages are valid in India.
While equitable mortgage is done by way of submission of title deeds between bank and borrower, in registered mortgage sometimes title deeds are not involved and further, mortgage agreement need to be registered with Govt. department. There are other differences also which are explained in this video. Please watch till the end.

@CA Ankush Jain...In Maharashtra price for Equitable and Registered Mortgage are now same.( Maharashtra Stamp Act).Uptill now for majority of the loans I have done Registered Mortgage only....It's more convenient & safer in the sense it is Registered with Sub registrar office...

Nicely explained sir. I have understood the basic concept thru this video. Really helpful. One more question sir :- Is there any guidelines that if loan amount is greater than this specific amount than banks have to create RM only? If RM is more safer than why banks prefer EM?

Because.... RM is very castly as compare to EM... example wagon r is for 5 lakh and having low safety features and same mini looper is of worth 30 lakh with safety features... Still people buy wagon r 😀

but actually bank is following hybrid method of both the documents of property as well as registration. Lender opting the good feature of both the mortgage , taking the property original paper as well as registration of loan agreement just in order to secure their exposure

Please check if it is due to any particular state law or due to the property chain not enough to create an equitable mortgage.

Ideally avoidable but it depends on internal policy of the bank.. normally third party property guarantee cases goes to senior authorities level for approval

Two question- 1. Whether original documents required to submitted to bank in case of registered mortgaged till the repayment? 2. Is there any way that advocate while providing legal report states whether is there any equitable mortage or not..Usually we have to raise Cersai request while creating charge?

Hi Question 1: whatever is available is kept in the bank in original for record purpose. Question 2: No advocate does not confirm that

@@art_soul_words you are right. I am just stating that I have not seen lawyer capturing about it in his title search report. Although this information is critical as u said and need to specifically captured somewhere before granting loan.

Lien marking is putting up information on the property record that the bank is having charge over the property. With this, if the borrower tend to sell the property then he will not be able to do any changes in property records without noc from bank. Further since it is a public record, any buyer of the property can also verify whether the property is having charge of other bank or not. Exclusive charge means that we are having sole right/charge over the current assets in the event of default. Any recovery from sale of assets shall be used to knock off bank dues first

Hi, I am not able to check the actual meaning of it. Somewhere it is written that simple mortgage and equitable mortgage are same while somewhere it is written that registered mortgage and simple mortgage are same. However considering that equitable mortgage is simpler as compared to registered , i think simple mortgage is another name of equitable mortgage only

@@AnkushJain okkk... Main Rajasthan se hu Jaipur city se to yaha jab koi JDA alloted property hoti hai to waha equitable mortgage lagta hai and Jo rural areas hai jaise phulera, Dausa and many more waha Registered mortgage lagta hai. Got it sir thank you 👍👍

Sir I work in semi urban area, during my audit the auditor has commented on many loans that EC is not obtained,even for housing loans……whereas EQM is sufficient to possess our banks charge…..kindly comment @AnkushJain

@@AnkushJain Property registration charge in UP in 2023 Now, the registration fee is calculated as 1% of the sale consideration. This means that if the sale deed is being registered for a property valued at Rs 50 lakhs, the buyer should set aside Rs 50,000 as the registration charge.19-Apr-2023

Hi shahrukh, cost is high in registered mortgage further equitable mortgage is easy and quick process. Bank do all safeguard all its interest in equitable mortgage also 👍
