A doctor I know was on trial, and another doctor, who was an expert witness in his trial suddenly became upset on the stand. It turns out that during the lunch break, the expert witness had been informed that he was also being sued.

We recently had a ED doc at my facility who was sued by family of a patient who died soon after leaving his care. Reporting was limited and my health system is pretty opaque with its bad pr so hearing about the process of doctors reviewing the care of other doctors will be fascinating!

I had to get surgery for ACNES (anterior cutaneous nerve entrapment syndrome) twice. The first time we thought I only had three entrapments, but it turns out I had eight. I had my second surgery and all was fine, but my family was trying desperately to get me to sue my surgeon because he missed the other entrapments the first time. It wasn’t his fault, he was an amazing surgeon, and I just so happened to be a rare case. I have ehlers danlos syndrome, and nerve entrapments are common with it, so suing my surgeon for missing something that he had never seen in 10+ years of doing this surgery, is frankly entitled. I genuinely am so glad that this topic is being discussed more, I’ve been in and out of hospitals my entire life, and my best doctor had to stop practicing because of a malpractice suit. He won, but his reputation was ruined and he lost most of his patients.

This is a great topic. I thought about this during my physio training and intership. What would I do if this happened and whatnot. The only thing people ever talk about is, what not to do to not get into such situations; basic Risk management. Would've listened to you discuss with this guest for hours on end. Lots of things to go over! Thanks for the episode.

In August, I had neck surgery that required two additional surgeries due to a complication. The surgeon was absolutely excellent-as were the residents. The problem was my neck! Any way, i can't tell you how many people told me I should talk to a lawyer just to make sure I was cared for well. NFW. Why is that everyone's first thought? Things happen.

IMO, getting a lawyer wouldn't have helped you get good/better care, in fact it could distract those caring for you. That said, if you're in the US and your surgeries cost big money, and your neck issue was detectable before the first surgery, I would argue that getting a lawyer could be a good idea so you don't have to pay for surgery #2 and 3, since they only happened because of a mistake prior to surgery #1.

@@Ms.Pronounced_Name I had thyroid cancer and spread to my lymph nodes. The complication was a chyle leak from my nodes-a known but rare complication or clearing the cancer. Took the two additional surgeries to address the leak.

Litigation is a life destroyer for almost everyone involved. There’s so much stress and pressure, and unknowns because most people don’t know what the heck they are doing. The stakes are also very high. Even with good lawyers (who cost a butt load) it is hell. Like the medical system, lawsuits need to be addressed

Wow this was one of the most reassuring things i've heard in a long time. I'm starting my education with the goal of working in a ED as a nurse or paramedic, and i already have so much anxiety on the daily from non-medical things. My instructors mention a lot to take many good notes while you're on call incase you ever have to appear in court. Before listening to this i was just always nervous about that possibility, but hearing Dr.Pensa's story is extremely reassuring. I feel a lot better about entering the the side of emergency medicine now after hearing this.

These stories were so intense and interesting. I can understand both sides so well. The patient goes to an expert and expect the expert to find the thing. Probably feels not taken seriously, when something very serious happens, even though there was no way the doctor could have seen this coming. But... who else could have caught it? I am very glad Dr. Pensa won her case. I am so sorry for the patient. I will definitely check her out. She has a wonderful way of telling the stories, was very well to understand for a non-native English speaker. I would have loved to know more about 'how to be' in court and 'what kind of game' is played in court. Thanks a lot.

He probably wanted men on the jury because so many women go through the experience of medical professionals minimizing and dismissing their medical concerns to the degree that many turn to quacks and DIY medical care guided by questionable online sources. This would be an effective way to sway bias in a positive direction.

It's interesting AND at the same time I always keep thinking like how America keeps shooting themselves in the foot by having such an utterly ridiculous "justice (not really) system" which really starts off of biases galore! 🤦‍♀ You need to prepare, cause it's not about justice but rather a mix of theatre performance and chess. All while trying to maintain the front of all of it being "justice". I always imagine poor justitia head-desking, whenever I hear of the American system. And our is already worth a host of sighs!!

@@bobhanson1037 They're talking about it from the perspective of not understanding why the lawyer says "Don't discuss this with anyone" and then discussing why it should be talked about. I agree Doctors should have training regarding malpractice, and the ethereal concept of litigation should be taught/discussed more often, but so long as Hearsay is a rule that exists in court EVERYONE should NEVER discuss litigation they are involved in.
