Probably a small private shop with no money. The large smoothie operations have well established procedures regarding food allergies.

@@Stealther Still, at least try to sue. My son has an amoxicillin allergy, if a little walk in clinic gave him amoxicillin and I didn’t know I wouldn’t care I would try to sue. I wouldn’t threaten these poor high school girls, and I sure as hell would not end up in jail because then I couldn’t help or protect my son.

Despite that, and despite knowing there's _always_ a risk of cross-contamination with non-homemade food that isn't made in a dedicated environment, he still chose to get his kid the smoothie. He made a bet and lost. This is 100% on him. It's not the responsibility of some poor schlub making $12/hr, nor of the establishment's owner.

No. When someone asks for no nuts, it is the responsibility of the establishment to, A: assume it's because of an allergy, and B: make sure they don't serve the customer something that will kill them. Yes, there's a risk of cross-contamination, but the reaction was so bad that the boy was hospitalised. It's simply gross negligence.

He could try to sue but he would lose. The business never gave him any guarantee at all that it would be but free and had no duty to. Unless the story is wrong and he actually mentioned allergies, in which case the employee should have told him that they can't guarantee it will be safe and that it is at his own risk.

Emotions being uncontrollable isn't an excuse for behaviour to be uncontrollable. This is why it's important to teach people how to handle and respond to their emotions in safe and productive ways. If he really needed to get that anger out, he could have gone and sat in his car and screamed at no one. There was no excuse to go in there and harass teenagers.

I worked at Dairy Queen for 3 years and we use the same blender for everything and if someone said no peanut butter we wouldn’t put peanuts in it. But if they say allergy we use a whole different blender put on gloves and keep it totally separate. That’s the customer’s responsibility to say. I don’t know if he would’ve won a lawsuit because everything says may contain nuts so that your safe from a lawsuit if the customer fails to tell you. Almost every food business says that to make sure the customer understands they are putting themselves at risk. He is the one responsible for informing the restaurant as I feel any good parent would. This guy is just a horrible person

I had a vegan restaurant that wouldn't even serve me because of all the cross contamination with almonds in their kitchen (almond milk, almond butter, frying stuff in peanut oil, etc). Now imagine if I'd never mentioned my allergy to them or the severity and had just said "no nuts", then came back in there actin a complete ass because I expected strangers to look out for my health better than I could be bothered to look out for my own 🤦🏾‍♀️

If one milligram of nut dust will kill you, then you probably shouldn't be eating at places that serve nuts in the first place. And it is absolutely your responsibility to notify the restaurant that it's a life or death scenario, and not just because you aren't hungry for nuts.

It is unreasonable. Even in factory made pre packaged food (a way more controlled environment) you'll often see seals like "contains traces of nut", or "this product was processed in lines that also process nuts". You are choosing to be either naive or entitled about this. Specially if we are talking about menu items which already contain said ingredient and you just oot out, you do not know how "sterile", as some already told you, that product is gonna be. At that ñoint you are being iresponsible as a customer.

The people making the smoothie probably thought it was just an omission to reduce calories. As someone who made smoothies for a few years, the caloric value of pb was the most common reason to omit it from orders, not allergies.

Same with a guy who has celiac disease. All it takes is one person to accidentally touch stuff and it's game over. Because lord knows when we're in a hurry, things can get sloppy

Another thing to be aware of is that pretty much everywhere you go you're gonna get some kind of cross contamination so if his son had that bad of an allergy he should have known to ask about how they prepare there smoothies. His sons health is no one's responsibility but his. If he'd told them he was getting the smoothie for someone with an allergy and they still used contaminated utensils then he has a case against them. But if all he said was no peanut butter, it's on him.

Not really, even protein powders state that cross-contamination its a possibility most products have this warning if he really cared that much he would not go to a smoothie shop period and or specified it better. He committed multiple crimes here, tresspassing when asked to leave, assault and tried to forced entry into the establishment.

Agreed. Ooting for a menu item that contains peanut butter by default,and is prepared alongside similar items, just to opt out of the single ingredient, doesn't mean at all he'll get an "alergy safe" final product. As a 48 year old and a father, he should know better...i would feel like i'm tempting fate if i did that to a loved one who depends on me. Why even go there or choose that item in the first place....

I feel bad for the son because the father obviously cared so much about his son, that when ordering, he couldn’t be bothered to take the time to inform the staff that the drink was for someone with an allergy. I know ppl with different food allergies, and every single one makes sure that it clear to the server, because it is dangerous. It is not something you just assume. It is something you make sure is clearly known and acknowledged.never something you just forget, especially if it is your child at risk. It is so automatic that you say it without really thinking it, then double check when you receive it. There may be a case against the server, but this man just showed major and unforgivable neglect in the care for his son.

I’ve seen so many people attack the smoothie place by saying that the dad shouldn’t need to specify the allergy because it’s standard practice to sterilise everything when someone asks for an item sans ingredient, and maybe that’s true. But it still doesn’t mean that you shouldn’t state the allergy up front. When you eat out with an allergy like that your rolling a dice, you have no idea how clean the kitchen, how robust their practices are or how well trained or experienced the staff are. In a smoothie place most people will be teens and probably minimum wage with little training so are you willing to roll the dice by leaving it up to chance? Or are you going to take 10 seconds to mention your kids allergy so there is no room for misunderstanding? I don’t see how anyone could argue that the former option is reasonable.

@@cheezwiz8425wjjeje I have a severe nut allergy. Thing is, I would never ever act the way this oaf did, because I that a lot of people are ignorant about how bad allergies can be. I am also aware that most restaurants/cafes have traces of nuts in EVERYTHING, they can literally never guarantee. Some servers are incompetent or overworked, It's your job to specify that you want a separate scooper/blender, they aren't there to safeguard your kid.

Sad story guys😢, On 14 January, 2022 My son Timothy Fernandus dissapeared. He left a note saying that he was being constantly bullied by Beluga fans all over the world. He was mentally harmed and harrassed to the point where he likely did something bad. I am not an emotional guy but this truly enrages me that how far is Beluga willing to go the sake of views.

Sure, however the employees were actually being quite unprofessional themselves; they had a very nonchalant attitude, almost like they were saying "whatever, it's not our fault", instead of simply apologizing on behalf of the company. It doesn't matter if _they_ weren't the ones who made that smoothie - that is beside the point.

​@@vincentlucario5450 Sure, however my issue with the employees' reactions is that they seemed more concerned with escaping blame, instead of the fact that this guy's son had a serious allergic reaction from something that he had bought there; the employees essentially have an attitude like "okay, your son may have ended up at the hospital, _but_ none of us in here made that specific smoothie". If I were an employee at that workplace, then I would immediately apologise for the general unpleasant outcome of the whole situation, and try my best to set things right; people who work in the service industry aren't supposed to escalate arguments with their customers. And sure, the guy in this video obviously overreacted in unacceptable ways, but the employees might have been able to keep him from reacting that way if they tried to set things right to the best of their ability before he started becoming racist and violent; he _did_ have a valid reason to be angry at the beginning, and that was when the customers should have shown genuine concern for the whole situation, even if it wasn't those specific employees who were directly responsible for that smoothie.

Yes, the employees’ attitudes aren’t excellent, but at the same time, this was a classic Karen move. Yelling at employees and blaming them for not having the full scope of the situation when they weren’t given any additional information.

I feel so bad for his son. Has a severe allergic reaction, goes to the hospital, and then his *extremely* breadwinning dad loses his job and reputation (as well as becomes a laughing stock online) so now suddenly any hospital bills will feel very real when before, Mr. Big Money could have very comfortably provided for his son, paid the hospital AND taken the smoothie business to court if only he hadn't been a huge fucking idiot.

The biggest issue for me is he didn't declare to the staff that his son HAD an allergic reaction to the ingredient. Like I cannot stress enough how important it is as someone who works in hospitality/catering, so many people DO NOT remember to specify that, and it's dangerous. If you ask not to have an ingredient, then yeah, ideally, the ingredient won't be in there. But when dealing with allergens you would absolutely take extra steps to avoid cross-contamination because you MIGHT have come into contact with the ingredient prior to that, and you could still unwittingly cause harm to someone. It's so infuriating how many customers do not make that information known to employees so we know to be careful. We can't read minds, just saying you don't want a particular thing is not enough.

When you have an allergy and choose to eat food made in such an environment, you're taking a risk. Sometimes you get burned. Accept responsibility for your choice in taking that risk, and move on.

yeah man. the kid deserves better. i hope he's doing better now. and i hope the dad learns his lesson. it's understandable that he was upset about the situation, but his behavior toward the innocent employees and just the way he handled things is way over the line and unjustifiable. good thing it was recorded, too, the girl did the right thing calling the cops and recording the incident after he crossed the line. what an awful situation for everyone involved.

This is a perfect example of why learning to control your temper--even when you have every right to be incredibly angry--is such an important life skill. If he'd gone through the proper channels (ex. complaining to management/corporate, filing a lawsuit, etc.) instead of acting like a racist lunatic and committing assault, he'd very likely be able to get compensation and whoever made the drink reprimanded, he'd still have his cushy job, wouldn't have had his reputation ruined, and wouldn't have gotten arrested.

If you think for even a moment someone is winning a court case based around a peanut allergy you don't understand the courts or food safety in the slightest. The second peanut products enter the door of an establishment all responsibility is placed on the consumer. That's part of the reason peanut free products need to be produced in completely seperate factories.

If you ask for no peanut butter or something of the sort then there's only two options, no in between: you don't like peanut butter in anything or you're allergic. The establishment really is at fault here, not the consumer. Especially since the consumer is absolutely sure there is no nut in this product because he specified. And if there does turned out to be nut after he specified, whos at fault? Certainly not the consumer. Does this mean he should have handled it the way he did? No, of course not. I don't defend racism and assault. Would he have won if he took it to court? Very likely. His son is in the hospital due to peanut butter inside of a drink that he specified should not have peanut butter, and since we don't know how serious this nut allergy is besides the fact that he went to the hospital, I'm assuming he's deathly allergic which means the corporation could be at fault for the death of a child. I still don't care who you are or what status you have in life though, you can't handle any situation the way this man did. Take it to court instead.

Anyone with a severe allergy knows not to buy anything from a facility that handles their allergens. If you buy packaged items from grocery stores, they will say if they've been manufactured in a facility that handle certain allergens. They do not guarantee they are safe for people with severe allergies. The customer is responsible for choosing products they are not allergic to. The father knew about the allergy, bought a smoothie from a place that uses the allergen, and didn't inform the staff about the allergy. Even if the staff had known, and used a separate blender, a risk for cross contamination would have still existed. All the ingredients, and measuring cups for them, could have come in contact with the allergen. I have relatives with severe peanut allergies. They do not dare to consume anything that has come from a place that uses peanuts, even if the item they'd want shouldn't have any. They always ask if the place uses peanuts or peanut products in any of their products. If the place does, then they go somewhere else. The smoothie place is not at fault. The father knew about the allergy, and he knew the smoothie place used the allergen.

Do not assume that food employees at a chain restaurant or chain smoothie place or w/e think you have a nut allergy when you say no peanuts. They are more than likely 18-20 year olds at their first job. I'm not saying it's not their fault bc they're new to working, but to have as little problems as possible always say it's for an allergy if you have an allergy. The father definitely should have pursued this legally. He would have had a much better time.

My brother has severe nut allergies. My mom always SUPER stressed that he had a severe allergy everywhere cuz that’s the smart thing to do. If this had still happened to my brother, my parents would have been BEYOND upset but neither one of them would have suddenly become racist (or gone violent).

The thing is; nut allergies are very severe most of the time, so sometimes there doesn't even have to be real nuts in something, but just made in the same room or on the same counter, meaning even trace amounts are enough to trigger a severe reaction. And as Charlie mentioned, if you say that it's because of an allergy and not just because of personal preference, some places have extra blenders, knives or even whole counters that are specially treated to close out any possibility of trace amounts.

I don't think he does have a right to be upset. He said no peanut butter, he didn't mention an allergy. They even had a sign mentioning the potential allergens at the cash. Not including an ingredient because of a taste preference and dealing with a peanut allergy are two very different things within the food preparation industry and they are handled in very different ways. He endangered his child and then abandoned his sick child to go yell at more children because of his own mistake.

I genuinely think emotional management should be a skill that isn't only taught in like, family therapy. Your emotions are always allowed, but the actions you take as a result are always your responsibility. It takes practice to be controlled enough to stop yourself before impulsive, angry actions, so better practice on inconsequential things before you end up ruining your life.

Sad story guys😢, On 14 January, 2022 My son Timothy Fernandus dissapeared. He left a note saying that he was being constantly bullied by Beluga fans all over the world. i've worked at these places. getting barely any training, barely any help, tons of customers on top of each other, faulty equipment. at my place we only had one machine for the shakes. trying to clean it of peanut butter or other common allergens (strawberries is one i learned on the job a lot of people have) between shakes was awful and customers get snappy at you for taking so long. my place didn't even teach about allergens period. i learned that from customers who were kind enough and smart enough to inform me why they were saying "no x please". not excusing the employee btw or even saying they're not sharing the blame here, just saying this is a top down problem and i can easily imagine an understaffed, undertrained, unequiped and overworked place like this missing that stuff. it's awful and i really wish these stores cared at all about these things because people's lives can be in danger because of it.

How is the smoothie place at fault when he bypassed the necessary information, ie. that the request was allergen based? Have you never worked at any sort of food or drink establishment? EVERYTHING is cross contaminated. Choosing to feed his son something from a place that he KNOWS serves the object of his son's allergy is just so unbelievably careless. @@lindsfreey9080 I actually did work at a place that served milkshakes which are similiar to smoothies and we cleaned and sanitized the blenders after every use because of the peanut butter. I don’t know how they did things here but you should be able to buy something from a place that also uses peanut butter and not have to worry about it having peanut butter in it. If they properly cleaned maybe they wouldn’t have to deal with cross contamination, also maybe it wasn’t cross contamination at all and maybe the orders were switched up and a employee accidentally put peanut butter into the smoothie.

I watched the unedited video, it seems like he did. I mean he was likely already angry when he entered but the beginning seems to show the employees denying knowledge of who made the drink and refusing to help further, maybe out of fear of the charges that could come from a child nearly dying because they weren't paying attention at work. I think it's important to remember the girls could've called their manager or tried to review security footage of who made the drink at any time prior. This would've probably appeased the dude and the employee that should be fired would be fired.

Didn't they say to call corporate, which is believable since there are workplaces who don't let their employees, especially teens, deal with this type of situation or review the security footage. They really should have called the manager though, but there wasn't much time between the requests and the insults based on the video, I hope the kid is OK and that employee understands that no peanuts means no peanuts though.

I don't think it ever could have ended peacefully regardless. The father was the one who took an unnecessary risk with his son's life in the first place and he was looking for someone to blame because he was angry at himself for nearly killing his son. The employee never told him to give the kid food prepared in a machine that frequently has peanut butter in it, which is something anyone who has a nut allergy is strongly advised to never risk. This is why even products that have no nuts have to say on the label if they are made in a factory that processes nuts. Point being, the father was responsible and couldn't psychologically handle nearly killing his son so he was going to find a target for his anger, one way or another.

@@mynameskobe6838 I don't know if this was the situation, but often at places like this the manager isn't even present. I worked at a smoothie shop and the manager just checked in once in awhile. I opened and closed on my own most of the time. If there was a problem I would have had to tell the customer to contact corporate. Besides all that, in this kind of situation the manager would have said the same. It's a potential law suit, they know better than to try to handle it themselves.

@@chasejohnston9015 and they didn't put peanuts in his order, it was small traces from the blender and the tools, so if he mentioned the allergy they would have used their sanitized tools and blenders and this wouldn't happen.

Im severely allergic to cheese (closes my throat up). When there's a messup, i just don't go back there and (if it wasn't handled appropriately) leave a bad review. That being said, if you're that sensitive to allergies BE EXPLICIT. And don't fucking john wick the other employees.

@@singate Yes and no. The company is responsible for 'erring on the safe side' which they didn't do. Also mentioning medical conditions such as allergies is (indirectly) giving insight into your medical records to non qualified people which at least over here is a big nono. Having said all this I however agree that it is probably safer to explicitly mention an allergy.

Nope. All companies are different and I’ve worked at a Steak ‘n Shake where our managers were told to tell people we cannot promise zero cross contamination with the shake ingredients. Managers would tell them to not risk it. Candy pieces fall into each other’s cups and no ones throwing the whole damn thing out cause a Reese’s cup fell into the m&m’s and the pb dust got on a piece of candy. And if you have deathly allergies like that, why even risk it at a restaurant? Just make your shit at home.

to be honest, his actions here and the criminal charges they brought probably have no impact on his own ability to bring a suit vs the company, nor on the outcome of any such suit, its a completely separate matter legally. his big mistake in that respect was throwing the smoothie in question at the girl, because that cup was his physical evidence that the peanuts his son reacted to came in the smoothie. without it, he certainly has a weaker case.

I'm in shock and awe as a young woman at the employees and how ready that one girl was to yell back at an angry middle-aged man. Granted, the yelling only made it worse, but any other girl would be terrified. I'm almost upset with the other girls for not pulling her back for safety reasons. He could've had a weapon.

My thoughts too. I also think his reaction was based in guilt for not caring enough that he made his son’s allergy known when ordering his drink. That kind of laps in judgment make one wonder just how good of a parent he is. No parent of a child with allergies would not make sure that that fact went unknown. I had someone come in the other day who made sure that we knew she couldn’t eat gluten, that she was a Coeliac and that she would get extremely sick if even the smallest amount of gluten was in her food. Because her safety was at stake. Now imagine how careful a person would be if the safety of their child was at stake.

If the workers can't cater to their needs, all they have to do is communicate that; a simple: "sorry, we're currently very busy and cannot follow all procedures to ensure you're 100% safe" is enough.

As someone with a peanut allergy, I would never even consider getting a smoothie from a place that I KNOW uses peanut butter in their blenders. Only one at fault here is the father for being that dimwitted and uninformed about the severity of his son's allergy.
