Absolutely! The interpreter missed crucial details on the witness emotional and mental state as well as details about opposing parties. Also, having a Spanish speaking police officer conducting the interview is not sufficient nor does it allow the witness to have an objective person there to be neutral. Why on cross for the defendant did they not throw out that evidence about the interview conducted by the Spanish speaking police officer.

One thing this case showed me is that people who question weather the Idaho 4 could have been killed by knife in the 12 minute window, the answer is yes. In this case this guy stabbed 5 people right in front of others, and they didn’t even realize it until after they were all stabbed. Took only 10-20 seconds.

I still believe that Miu is guilty. The force he used was not appropriate. His behavior aroused suspicion in the teens. Why does a 50's individual act like that? I am 69 and would never have acted like that. Very immature of Miu. I am sure the State will make mince meat of Miu when he takes the stand next week. Miu never stayed behind to tell police he acted in self defense. He lied and said the teens had a knife. The way he acted while in police car. He knew to put on his shirt hat and sunglasses but in the police car he acts clueless. Unbelievable.

1, 2, 3 - irrelevant to the self defense charge. 4. Maybe, or she was shoving a phone in his face and he was just clearing his personal space. 5. Might have worked, but when he came up swinging, he might have been really fearing for his life, and not in a position to make a reasoned assessment of the situation. 6. Irrelevant to whether subsequently when he was in the water being whacked and pushed he felt he was in danger. My assessment is that he is guilty - of manslaughter and intentional endangerment etc - but I suspect that the state will lose because of overcharging - but it won't matter for re-election or political advancement - so winning!

So glad you are talking about this! Defense counsel was permitted to lead all of his witnesses and take out of order by blaming translators. Also they just happened to permit them to stream the entire trial by ‘forgetting’ to provide the translation saying not to do that and not to align their testimony. The prosecution is so mellow, let it all happen.

I find it interesting that he didn’t say anything the entire time the video is recording. He could have walked away. He wasn’t in a contained room. When I look at the taunting and bullying compared to one killed and at least 3/4 seriously injured, it just doesn’t seem justified. I wonder what the jury will think of him not saying a word during the altercation. His behavior after the fact is insane. Ditching the knife. Not telling his friend group what happened, and then straight up telling the police he heard someone got stabbed and he matches the description?! How much man power was used looking for him that could have been used in aiding the victims? Interesting SD case and extremely heart breaking.

@@salinaraey5165 I didn’t actually see that. I haven’t watched opening statements or seen any police interrogation videos besides what was said at the river. I wonder if the defense will say that he was afraid to speak because of his accent. That it may have made things worse. Not justified-just curious. @salinaraey5165 The knife was just 2 inches long. Had to have force to plunge and use upward motion to inflict maximum damage. That is intent to kill. Several of those kids almost died. It wasn't just slicing through skin or superficial wounds, it was deadly wounds to vital organs (intestines, diaphragm, heart). How can anyone not see the difference between drunk kids being foolish (yet not violent since they didn't attack him even when he charged them and pushed on the tubes they were sitting on, and they called for help instead of attacking him when he wouldn't leave.) Versus him, he claims self defense when he never called for help, refused to leave, and was the 1st to use violence by striking the female. He's old enough, any sane person, to know that would set off a reaction in her male friends standing nearby.

Several items that stand out as not self defense, but 3 main items. Self defense has to be that you fear for your life being in immediate danger, and have no choice left but to use deadly force. If he feared for his life, then why did HE refuse to leave when everyone else was asking him to leave, walk away from the situation. That was his obvious no violence choice, just walk away. 2nd, using a 2 inch knife, yet he gutted one kid with his intestines spilling out, the girl he plunged into her diaphragm, etc and killed the last kid. That takes a lot of force, and deliberate upward motion to inflict as much damage as possible. He wasn't wildly swinging or slicing, he was plunging the knife deep and upward. That is intent to kill. Which makes it seem like rage, not fear. 3rd, He lied to police and claimed the boys had assaulted him trying to pull down his pants, and they had knifes and we're threatening him; that he had no knife, and had no choice but to defend himself.
@nanettesilverwolf
@nanettesilverwolf 5 месяцев назад
@sA-ny2jl Those are very good points. I would have been scared and would have bolted from there as fast as I could to get back to the safety of my friends. #2 is hard for me to get past. Is it self defense to stab multiple people?? Having a hard time wrapping my head around how that is self defense. I do think that the young guys started it by taunting him and then surrounding him. That in itself would be terrifying, but he did have a chance to walk away...

Absolutely no doubt the man had military training in hand to hand… 5 done in less than 30 seconds. I am not comprehending the level of blame being put upon the victims. Prosecutions opening statement says there are two videos taken back to back by the kid… has the first one been shown yet? Even if they started it with verbal bs… he followed them. He was on his feet running after teenagers on their butts in tubes. He grabbed at their feet and their tubes… he was all up in their space causing them to start yelling for help… yell go away… leave us alone… what are you doing. Where do you ever see his hands up with fingers splayed completely out as Issac’s were? That is a clear universal unspoken sign to stop known by every human. The fact I am reading so many comments from people who think that kid deserved to die like that over names being called makes me sick. No one including those kids know what the hell that man said to them as they floated past him that day… everyone gives everyone a pass on not being able to hear but those kids. And they were kids… sick of that too… under 18 is a kid… regardless of height or weight. There is no evidence of a single one of them touching that man… Issac is the last stabbed and his hands are up trying to stop that from happening as it happens. Hes not here to testify that maybe he saw the knife now is he?Guess he had no right to self defense.

I feel that Mr. Mui had plenty of chances to leave the teens alone. He also started it by going in front of their tubes so they could not continue down the river. There is no excuse to stab so many people because your feelings are hurt because of the words they are saying or calling you. Where was his group, why did they not go over to get him out of the situation. I feel that he is guilty, he killed a teenage boy and injured several others. That one young man that he stabbed him so hard his intestines came out, and spent 27 days and numerous surgeries including feeding tubes. Mr. Mui did not have a scratch on him, I do not believe this was self-defense, it was anger!

10 in a 10+ v 1, you expect the 10+ to have a good enough conscious to collectively come up with the right decision, and they didn't. you can’t rely on one person to make the right decision. He was ridiculed, harassed and assaulted beyond what most people can tolerate. He also had a heart attack with a triple bypass before this, so I don’t doubt he feared his life. They had no regard for his mental capacity, and that’s how it got to this level of extremity. The outcome is very unfortunate especially over something so irrelevant, but I guarantee you Miu would not have gone on a random stabbing spree had they not triggered him to do so. I wasn’t understanding of his side at first, but I simply cannot stand behind individuals who said while assaulting him that this was “for the culture,” which they claimed meant “greater good,” when the greatest good would’ve been to call the professionals trained to handle “rapers” if they had felt any sort of unsettling feeling of him “looking for little girls” (in which they also failed to mention what i assume would’ve been an important piece of context to police or in the report). One persons guilt doesn’t define the rest of their innocence. All, including Miu, should be charged.

Why??? Several items stand out as not self defense, esp 3. Self defense has to be that you fear for your life being in immediate danger, and have no choice left but to use deadly force. If he feared for his life, then why did HE refuse to leave when everyone else was asking him to leave, walk away, from the situation. That was his obvious and easy no violence choice, just walk away. 2nd, though using 2 inch knife, yet he gutted one kid with his intestines spilling out, the girl he plunged into her diaphragm, and killed last kid. That takes a lot of force, and deliberate upward motion to inflict as much damage as possible. He wasn't wildly swinging or slicing, he was plunging the knife deep and upward. That is intent to kill. Which makes it seem like rage, not fear. And no need since after initial reaction to his striking a female and coming to her defense they were already backing off and yet the guy that was telling them to stay back even got stabbed. 3rd, He lied to police and claimed the boys had assaulted him trying to pull down his pants, and they had knifes and we're threatening him; that he had no knife, and had no choice but take away a knife from one of them and defend himself. If not for the video, his story could have ended up being believed, him the sober adult vs drunk teenagers.

When does this madness stop? When will we start prosecuting ‘teens’ as adults ? Any bullying teen close to the apparently single quiet man who innocently just wanted to find a friends cell phone. If they were within reach which average human biological males reach is 25 inches so the perps refused to step back/ so whatever Mui needed to do to escape harm was warranted in my opinion. He didn’t get time to choose how many teens were going to keep coming after him- he did not choose to be attacked. As long as the young adults kept coming within striking range they were going to get hurt. This will become the new normal because elderly adults are tired of being terrified of loosing their lives over the rabid dog mentality of groups of teens. I barely scratched the surface for news for brutal slayings of teens acting like ANIMALS. They get in a group and there’s always one who incites the goon squad and in this case it was the person who hurled inaccurate slurs about Mui’s preferences for children. The young woman who was harmed came over and started pushing and yelling because she thought she was attacking a child mo. She almost revealed this on the stand - then couldn’t remember. What gives anyone the right to put their hands on anyone. The teens assumed Mui was alone and frankly Mui’s friends were too scared to come and help. The wife knew he needed help yet the 50 yr old men were too afraid to approach except for the ONE - the Cousin’s friend and even he didn’t hurry to intervient. When in a mob mentality with these teens death has certainly been the outcome for many adults. How many is too many? You say 2? One is too many to get hurt but as they kept coming to Mui they made that fateful choice. ( iMO) A young teen was mobbed at his school in Nevada and passed from a head injury. A mob of female teens brutal beating just made banana mash out of a young girl’s brains lately and she just got out of her coma. Spare me the liberal ‘ but they are just kids!’ They are mobs thrown act like rabid dogs when they are excited into violence. Mui just wanted to find a cell phone . Sure he didn’t talk - would they have listened? Does that make it right to swarm and disorient and beat down a quiet and peaceful man in his 50’s with recent heart failure? Nope and hell no. Again - the teens chose their fate by being too close to a man who was in fear of his life. Screaming GO? Seriously? The minute he would have turned his back- could he trust them? I would trust those animals about as much as a friendly alligator. A pack of dogs- are more easy to predict than a mob of drunken and High entitled teens- for Pete’s sake they couldn’t even ‘remember’ their movements on that day! I'm a disabled veteran in my 50s with decades of martial arts and hand to hand training, including a good amount of full contact experience. I can tell you that if I have any chance of winning a fight, I have to do it fast because I will not be able to get my strength back during a fight. I can also say, and I've trained and proved this a hundred times, that any two people with fighting skills working together, can defeat almost anyone. Simply kicking feet toward each other and stomping ankles can make a superior grappler lose. Fighting two people in shallow water is suicidal. As an older man, you can't get back to your feet repeatedly, and laying in the muddy water it's impossible to defend yourself. Once he got back up, it was life and death for him to stay up. Instinctually we know you can't run from a group of predators, it will encourage the chase and you will be taken down and overwhelmed by the more confident predators. If you have them afraid of you, running is going to quickly end thier fear and resume the attack. I haven't seen the whole video, but I saw just the part with multiple big fit men pushing him down into the water, and I saw the man charge him when he got up and was backing up. The first stabbing was the only reason the old man wasn't back in the water being pushed under.

This is a really interesting point. I keep trying to imagine what it would be like for me to be surrounded by 13 people less than half my age. In murky water up to my ankles/calves. If I’m in my 50s, not in superior shape and with a serious heart condition, I’m probably terrified beyond belief. Once I go down one time, then get put back down again, my fear is through the roof. I’m really disturbed that this happened but some people seem to be ignoring the reality that being surrounded by 13 people all ridiculing and taunting you would put anyone on the defensive. The defense has a really effective exhibit which provides a birds eye view of where everyone was standing at the height of the altercation. Once you see that exhibit it becomes hard to maintain that he could have just walked away. To the person asking about the girl he allegedly hit, I have not heard any clear evidence that she was ever hit. And unfortunately, the teens recollection of this is not consistent and is getting more and more confusing. The defense is doing a pretty good job of creating doubt that she was “punched” at all.

I’m going to respectfully disagree after seeing several pieces of evidence and testimony. Why that particular area to search for the phone and stay there? Initially he is seen forcefully pushing the kids tubes which could be seen as a threat to the kids. He didn’t say anything of why he was there. Another threat to the kids. The kids yelling posed a threat to Mui. Their fear response to his actions. He did initially have the opportunity to leave and forget about looking there for the phone initially. The kids who were seen just trying to tell him to leave with no force were stabbed , which looked to me like an irrational impulsive response. In the moment, he was in fight flight response , specifically fight. With the knife. On the video there was no threat for the subsequent stabs, which were more like gutting. Excessive response IMO. As a reasonable potential juror I would say guilty . At this point. He also lied twice. Telling his friends the kids took his knife, and telling police he heard someone got stabbed. That says he is hiding something. Looks like he froze and went straight to fight mode. Not rational mind. Let’s see what the defense has … my opinion may change.

I looked up self defense, came across good explanation. Four elements are required for self-defense: (1) an unprovoked attack (2) which threatens imminent, immediate injury or death (3) objectively reasonable degree of force, used in response (4) an objectively reasonable fear of injury or death. Using the above, He hit 1st, and those present reacted in defense of the female he hit. He provoked the actual physical reaction. And 3, they hit and slapped him, while he used deadly force and was the only one with a weapon. He went for vital organs (intestines, diaphragm, heart). With a 2 inch knife that took force to deliberately cause as much harm as possible (including upward thrust which causes maximum damage)

Every stab, slice or cut that was done on each person, happened because "they" the injured, walked right into it. Mr. Meu lifted his hand with the knife but did NOT lunge or take one step towards those who got injured. They got closer than his arm's length, and that is unacceptable and their fault. All this other stuff the prosecution is trying to convey, makes no sense and doesn't even matter. To me, whatever he said or did afterwards doesn't matter either because he's on trial for the stabbings and how it happened at that time. If anything, his actions of trying to cover it up and possibly lying just makes him less or unlikable. Thank goodness for the video!

Just imagine if the teens stopped to help him look for the phone rather than mobbing him. It really is that simple, isn't it? Teach your children respect and don't allow drinking or drugs before they are ready. We don't allow it in my house. Not ever. Not everyone lives reckless lives. We respect our lives and the lives of others. No excuses. 100% accountability.

I agree. If they knew he was looking for a phone they could have helped and the whole incident avoided. He never said anything about a phone before running up to them or when he got up close. He also never told them about the phone when they repeatedly asked him what he was doing. Imagine how nice of a day everyone could have continued to have if Miu asked "hey have you guys seen a phone in the water" before running up them and reaching into their personal space.

The kids did not "mob" him as you describe. They were sitting in their tubes and the 1st physically aggressive act was by the defendent. He charged at them, they did not charge at him, they were mouthy hut not aggressive. He was absolutely in a position to turn around and walk away while they were in their tubes but he did not...instead he ran at them and assaulted them. It is only after that the kids actually get up onto their feet. You clearly see that the Asian kid runs off, he clearly was startled by the defendents actions. The defendent knew he had a knife and he had no issues with pulling it out, the kids were unarmed and at no point in time before he charges at them do they threaten him or engage with him physically. They may have been drunk but they were not violent until after he becomes violent. He knifed those people in cold blood and then casually walked away. The video that the woman in his party took after the stabbings shows him casually sitting in the tube calmly watching events unfold. He lied to his group by saying the kids attacked him and took his knife from him, which did not happen. Then, after his arrest, he acts like he doesn't even know what happened. His interrogation video shows him lying over and over as you will see if he testifies. That man is a cold blooded killer. His eyes and face were expressionless, he absolutely was not afraid. At any point he could have turned around and walked away, he chose not to. And on the stand his friends clearly lied about what they saw and heard and they absolutely had been watching the trial. That young boy did nothing to deserve him being butchered and if it was your child, im certain you would see in that video what the truth is. He was murdered by that man.

@@mirandaajames You are assuming he did not mention the lost phone because you did not hear it on the video. I appreciate your take on the the thoughts so far. But I found out when i was on a jury that the people that make up the jury are the same people we call idiots while driving around. Our instructions said we were to find him guilty of possession of stolen property if we believed he had direct knowledge or reasonable knowledge that the items were stolen. So the guy on Craigslist that sells you a brand new side by side real cheap tells you not to register it because it has a salvage title (this from the defendant) wouldn't make a reasonable person know somethings not right. Eleven adults thought the "don't tell me, I don't want to know" from school was a valid defense.

I disagree with your analysis, particularly when it comes to the elderly on the jury. I’m 67 and in no way see how he imagined himself in danger of serious harm or death. Despite the bypass surgery, he was moving quite easily as he sliced his way through his victims, not struggling for breath or showing signs of weakness. As a jurist I would also take note that he can snorkel and walk and run easily through moving water. The prosecutor also strongly impeached the witness Ariel who was standing just a few feet away when Nic stabbed the girl and the older brother yet didn’t see it. What troubles me the most is that how or why or when Isaac was fatally wounded has not been discussed at all. He was never seen near the killer in the video. I also think Ariel was extremely lucky he didn’t get shivved too when he touched Nic’s shoulder from behind.

You do understand that most people who’ve testified did not see the knife, did not really even see the stabbing. The one girl thought she was punched. I didn’t see a strong impeachment. As for your other comments, you make it sound like he was doing swordplay or something. The man was knocked into the water, pushed back down, punched several times, pushed and shoved.

A lot of people mention why the girl being punched was ‘cut out’. If I record my grandson, my phone veers because I’m looking. The kid didn’t know the punch was coming until it happened. I think it’s a clear inference the way the group reacted that he did it. He also stabbed to kill, Not injure. He knew 5 languages & couldn’t say ‘yo back up off of me’. Or ‘hey guys. I’m looking for a lost phone.’ Or wait for them to float by instead of waltzing straight up in the middle of ‘em. Lots of options that don’t end in gutting folks.

I didn’t tell them anything but to watch it slowly and that he was on trial for murder and his defense is self defense. That’s it. I was shocked. I disagree Peter. Even with the evidence we have seen so far. Mr. Miu ran up and spooked those kids and refused to communicate his purpose for being in their space and stopping their rafts from moving. The kids being drunk as they were, use some harsh laguage to try and shame Miu into leaving. Miu had every opportunity to leave the area but kept returning still not communicating his intentions. Finally when the "Lady" tried to verbally boss him around and tell him to leave he lost his mind. His pride and ego was hurt. Miu hit the lady and all hell broke lose. Miu didnt just stab, he carved them up like a butcher. Later loseing the knife, not telling his party and friend what happened and lied to the cops with denial. Miu is guilty of murder.

I understand and respect your interpretation of the evidence. However, taking all the witness accounts aside and purely view all the video, there is no evidence of the women getting hit or the defendant holding the young, mens tubes back or holding them to prevent forward movement. Even more so, the defendant did not entertain the young, mens insults, shouting or bullying towards the defendant. The defendant did not engage in the verbal hostility he was receiving. Which leads me to believe that he was in distress and had to defend himself. Just my opinion.

Absolutely disagree with you on this one Peter. Respectfully. Defendant 1) Had plenty of opportunity to leave and not continue to engage. He was being taunted but in no way “circled and attacked” to the point fear should have taken over to that point. 2) His age plays into decision making. If you’re supposed to be older and wiser - act it. Don’t play word games with “kids”. 3) If he was in fear, walk away, run, swim or even throw a punch. But, to stab not one, two but SIX people. No. Just no. 4) To leave, put on clothes, rejoin your group and play dumb…he knows what he did. Consciousness of guilt. P.S. This opinion is coming from a 55 year old woman. 😊
