She can't. He would have had to file for a hearing once the mother relinquished guardianship, so because he didn't he's not now entitled to any back pay.

She should have. I went through a case and the judge made me pay back pay even though I was making payments every month. I was even paying his mothers rent and they said all that was a gift and made me pay back pay

I believe that income is what her buisness makes a yr, but since she is the owner she believes she has to mention it as her income. But out of those 400k a yr she paid employees,materials,insurance ect. If she would have said she has a salary for her self out of the buisness, the judge would have wrote down that salary amount.

Let's see, while building up a business to support their family (because you can't live on dad's $40k per year) dad CHOOSES to then have an affair with her SISTER. Mom originally has custody of the child but can't watch him properly because of the business so she gives him custody. He then makes up a home with her sister. There is a lot of blame to go around and it seems to have started with the person who came out the winner....

Lots of people pay even though they're the one raising their child. They're afraid to rock the boat. if they petition the court for a change in custody because other parent who has sole custody will come rushing back in and legally take the child back. Usually in cases that this has happened the parent who has custody but has abandoned the child with their non custodial parent are not really fit to be a parent because they put other obligations before being a parent. That leaves the parent who is responsible but is the non-custodial parent in a bit of a bad position because yes they can petition the court but then they're not going to have any idea where their child is and if they're being taken care of.
