It is NOT a difficult problem at all legally. It is not the town or states, bikepath, trail., or roadway. All those things are THE PEOPLES PROPERTY, paid for by our taxes! And are protected by our United States Constitution. Those rights would include right to free travel.

What we need here is to have a large group of e bikers organize a ride on our e bikes over there, ride legally on the streets only and see if they're gonna arrest or issue fines to dozens of riders. But, of course, it won't happen. People around here are like sheep. Going along with whatever the Gestapo govt decides to do.

I have a e-bike. I don't use it as a scooter on bike paths. I pedal. When necessary I used the Assist. Otherwise I consider bikes are for exercising and it happens also to be my main mode of transportation. I don't go 40 mph and I don't try to. Especially on bike paths. So if one wants speed get on a car or a motorbike and enjoy yourself. Otherwise more places are going to ban e-bikes because some people abuse their freedom which for some people means "Me, myself and I".

Biscayne Florida has two bike shops and a Everglades Bike club in nearby Miami. Contact them. They are local and should have an interest n this issue.

@@pedrofernandez8729 if you don’t find local ally’s , you are wasting your time. Bet there are people in the bike club who knows ebike riders. Bike shops sell ebikes. Don’t assume. Always ask. Remind them they are next. License , insurance, speed limits etc.

So, have they banned cars? I am pretty sure some people have died from car accidents. Of course not wearing a helmet was not the actual cause the same way driving under the influence, or not wearing a seat belt. how about phones? How many deadly accidents are caused by phones?

I'm no lawyer but I believe Key Biscayne is using Florida Law Section 316.008 (1) (h) to give them the powers for the ban: 316.008 Powers of local authorities.- (1) The provisions of this chapter shall not be deemed to prevent local authorities, with respect to streets and highways under their jurisdiction and within the reasonable exercise of the police power, from: (h) Regulating the operation of bicycles. That would explain why Crandon Boulevard is exempt since that is a county road. The emergency ban that was put into effect Feb 16, 2024 became permanent until 2025. The only way this ban can be overturned is for someone to sue the Village. Question is, who has the resources to do so?

You are exactly right with your last statement there it’s going to take somebody to sue. I am aware of the 316.008. The problem is they have now discriminated against electric bikes because they stated very plainly regular bikes are not included in this and Florida state law says E bikes are the same as regular bikes, with the same rights. I believe this is where they have their problem. I’m still waiting on a phone call from somebody with any authority down there. Thank you so much for watching and thank you for the comment.

As far as I know, class 1 e-bikes are considered regular bikes and can go anywhere bikes can go in all 50 states. If it’s class 3, most e-bikes that go over 20 mph, it basically has to be ridden only where scooters and mopeds would be legal.

Thank you for watching and yes, that is my understanding as well. However, this town has completely banned all ebikes. I am not talking about on bike paths, but from the streets as well. They have already done their first reading of an ordinance that I have not been able to find the verbiage, too. I believe they know full well. That dis is completely unconstitutional and illegal. But I believe they are doing what much of the government does, and that is doing it anyway, in hopes that no one will challenge it or they could get a judge that would back them up. I spoke to the chief of police in this town and he told me they were giving a $250 fine. For the first offense and five hundred after. He claims they can do that because they are under an emergency order. I don't think that would hold up legally as well. Because In florida, ebikes have the same rights as bicycles, I am talking to legally defined ones. I e class one. That would be like saying an emergency order can ban all blue mustangs from the road. But again it has to be challenged

On the legality side, I’ve only looked briefly, but I do wonder what the underlying ownership of the village roads is. It was originally developed as a planned community, and I think those roads were HOA roads. The ebike ban exempts the only County road that runs through the community, so there might be something unique about the ownership of the other roads. The public works department only mentions that it oversees contracts to make repairs to village roads, which sounds very HOA like. Given it was a 12 year old on an ebike that seems to have caused this accident, it seems like a better approach would have been to ban people under 16, if that’s the problem they are having (as articles suggest).

Thanks much for watching. I think they are just looking at this with the attitude of never let a good tragedy go to waste. Their meeting last month, one of the council members plainly stated that he’s been trying to get rid of these E bikes for a long time. as far as the HOA’s and the legality. I am pretty sure even with an HOA, they are public roads. If that were not the case, I would guess the village police could stop any person on any of those roads and do whatever they wanted. Now, if it is a private community, that would be different. I’m still gonna stay on top of this. Again, thanks for watching.

@@southernebiking On the HOA thing, I’ve lived in big HOAs before where there were fully private roads in many parts of the community, the County wouldn’t service them. Looking at the history of Key Biscayne, it clearly started out as a private development and then became a municipality much later, but I wonder if some weirdness with the road ownership persisted and that’s why they may be able to do this if they aren’t public roads.

Back in the 80s here in NM, the state DOT attempted to ban ALL bicycles from any state road above with a certain speed limit. The State Police said they wouldn't (couldn't?) enforce it and various cycling group statewide stood up against. It's been a longggg time, but I believe that since the stated takes federal money to help maintain those state roads, the state wasn't allowed to ban cyclist from riding on them. It shouldn't be any different in other states and for ebikes

If something like this could happen. It would need to happen with all classified ebikes. If a bunch of folks went down there on very fast bikes, it would just solidify their decision. But I would love to get about 30 of us together on class one ebikes. I stand by their ordinance to ban all E bikes from public roads cannot fly. Thanks for watching.

I don't think anybody from Florida actually cares, key Biscayne is only about a mile long stretch of road, it's definitely a pretty ride,, but it's not very bicycle-friendly getting there because you have to go through downtown Miami.

Yesterday I passed a cop here in CA on my Mars with 2 small baskets front & rear, saddlebags, no chain or chain ring, crank arms aligned & 9.5" rise on Gull Wing bars. I had 4 shopping bags & no helmet wearing flip flops & half gloves. He followed me & pulled in behind me at my residence but no bubblegum lights lit up. He wanted to know how long I'd had it, how far on a charge, how much $ & if I liked it. Told him $750 at Amazon or Walmart but Heybike now only sells the Mars 2.0 on its website. Not the best customer service but they do sell replacement parts for their eBikes.

The ebike was written by a minor so the accident is not public record. Even if I assume that the E bike caused the accident, the E bike did not tell the regular bicyclist to ride without a helmet. How many cars hit bicycles? Yet we’re not banning them. This is definitely a case of these town officials having a problem with ebikes. The problem that I have with them is they are not addressing the true problem, but it just trying to take the easy way out. If they have used running around on Ebikes, causing a problem. I would be willing to bet they were undefined the bikes. They could address it that way. They could address the violation, not the vehicle. They could’ve put out an emergency order that everybody riding a bicycle has to wear a helmet. Of course, that would’ve been just as easy to do as banning the ebikes. no, I am convinced someone with some perceived authority in this town has a problem with ebikes, and one of the committee members even stated he’s been trying to do this for several years. Notice I said, perceived authority. We have to remember these are our servants. We are not theirs. Thanks for watching.

As I understood it some time ago Federal law on e bikes prohibits legislation on e-bikes that all bikes are not subject to. All the idiots that voted for the crime and the city attorney must be held accountable for their abuse of power

A Class 1 Ebike, is Pedal Assist Only. No Throttle. So the motor only works when the person is pedaling. Class 2 Ebike has both Pedal Assist and a Throttle. I ride a Class 2 Ebike. Class 3 is an Ebike with Throttle only, now your getting into the grey area of Electric bikes. Where they are more of a moped, and less of a bicycle. A few states are working on laws that will make a person who rides a Class 3 Ebike, that can go over 28mph, on the flat, using the Throttle, acquire a license, and have insurance. I see nothing wrong with that. My Ebike has a top speed using throttle of about 18mph. I can get it up to 20mph, if I pedal really hard, in a high gear. Your probably not going to get any where trying to call those people. Like some one else said. Contact the two bike shops in the town, and any local clubs. That"s a good work around. Good luck

Not sure what state you were in but every state that I am aware of, class three has no throttle. It has pedal assist only. Any bike can pedal as fast as you can pedal it but the motor cuts out at 28 mph. there are some states that vary somewhat. But I have not seen any state that has a class three is throttle only. @@southernebiking California has set up the Ebike Class System. Oregon, Colorado, and Wyoming have follow its example. So again. Class 1 is pedal assist or PAS only. The motor only works when you pedal. Class 2, which is what I ride. Is a bicycle with a PAS and a Throttle. I like having the throttle, makes it easier to start up at a stop light or stop sign. Class 3 is also a bicycle, with pedals, but has the Throttle Only. And if it can go above 28 miles per hour, and many Class 3 Ebikes can. I have a friend who rides a Class 2, that can go over 28 miles per hour using throttle only. In California they are working on a law that will require people who ride a Class 3 Ebike, that can go over 28 mph, on the flat, to get a license, wear a helmet and get insurance. And yes I am talking about a bike with pedals, and some kind of electric motor. I converted my two wheeled recumbent, into a Class 2 Ebike back in 2019. I live in Wyoming. Its not a law yet, but I think it soon will be. Too many kids and young people are getting these over powered high speed Ebikes, and many are not ready for them. I've almost been hit several times. Oh, and my Ebike, uses a 48 Volt 500 Watt hub motor, built into the front wheel.

I just checked california dmv.gov and it states class three is a low speed electric bicycle which can attain a speed of 28 mph by paddling only. At that point the motor cuts off. Something to that effect. if you have some different information than this, I would be very interested in seeing where you have found it. Thanks much.

@@southernebiking Well this was a few years ago that I looked. So it has been changed. So what class is a Ebike with pedals, and Throttle only, that can go over 28mph? Because I know they exist. Plus where I live I've seen Ebikes, with pedals go zooming past me, and I know they are going faster then 28mph.

Florida has been busy taking away rights . The last few years. Since this is a local issue, they don’t care about outsiders input. Outsiders can’t vote. You found out how effective calling is. They have been given the power in the state constitution , they will use it. Have you heard any input from local bike shops in Florida. Or from Florida ebike RU-vidrs? 0:00

@@Patriot7-t4u my experience has shown a little bit different. I see regular cyclist, pass people walking much faster. They don’t want to slow down because then they’ve lost momentum. On the bike, you can speed back up. I also see the road cyclist with her head down for aerodynamics quite often, so they’re not looking for in front. And I very rarely ever see them give an audible warning. On the other hand in the areas that I have written, most ebikers will give an audible warning that they are coming by on the left. They slow down because they know they can get going again. I find the vast majority of people on E bikes are older and they’re out for a leisure ride. Not out feeling like they’re practicing for the Tour de France. That has been my experience. Maybe that’s just in my area. I also have to wonder how many people that are walking even recognize the difference between an E bike and a regular bike. I am not talking about the ebikes that look like a little motorcycles. I’m talking about a pedal. Assisted bicycle. I wonder how many people have respectfully come by them on an E bike that looks like a regular bike and the walker does not even know it. Thank you for watching Paul and you are completely correct. And their overreaction has just passed an ordinance that makes this permanent. I am looking into it right now as my FOIA request has not been respected yet. We are going to stay on top of this, even though I do not live in Florida. But as you say, it will spread like a disease. the real issue is regulation, e-bikes are supposed to be governed to 25mph but these bikes are being bypassed to go much faster. in many cases they are being shipped here without any governors to limit speed. it's simply too easy to make these bikes illegal. what they should be doing is confiscating bikes by anyone who has obviously exceeded the speed of that legal 25mph governor or impose steep fines to those who do.

I’ve been on record many of times saying anything that is not defined is open to any regulations that they get. @@markstevens4264 thanks Mark. I have advocated long ago that anything that is not a class one class two or class three be named something different. Maybe eCycle or something along those lines. I stayed at a year ago this was going to happen and here we are. Of course, there will always be someone who can modify something. That I would not be overly concerned with. What does concern me is that manufacturers are producing them that are already well above define classes and selling them as E bikes. I would also suggest that you probably have not even noticed the majority of the bikes that have come by you because they are coming by in a very respectful way, and really don’t even look like an E bike. I know the general public only sees something like the fast suron type and think that all E bikes are like this. That is something else I am working on, is to brainstorm away to bridge the gap between the ebikers and the general public.

@@markstevens4264there are a lot of kinds of e-bikes. I can’t say young kids are the only ones on go faster types, but a number of us have assist because otherwise we wouldn’t be riding at all. I added a motor to my trike and the assist goes up to 20mph while pedaling but it only delivers 50% power to the throttle. Most of the time I pedal along at 10-12 mph. I know some people who have their trikes registered as ADA mobility devices when Tucson wanted to keep e-bikes off their trails. ADA lawsuits are very expensive for cities full of retired people

Firstly said I'm in Australia, here and in all Europe (as far as I know) eBike are restricted, on public roads, in both max speed and max engine wattage (respectively: 250 Kph, 250W). While I found the wattage limit unfair for big people like me (125Kg), I believe the limit on speed being fair. And here I believe police enforces these limits. If you need to go faster you should get a plate and an insurance like all other vehicles that go over that limit. I personally saw a stupid guy going very fast on the sidewalk such that an accident was just waiting to happen. That is clearly a dangerous behavior that need to be addressed, possibly before tragedies happens. BTW, I'm waiting for your new review on your URUS... 😁

I guess, according to this philosophy, your car should be outlawed in school zones. Probably should be outlawed on residential streets as well. See I have been passed more by cyclist then I have by E bikes. I have to wonder how many E bikes you have been around that you did not even realize they were E bikes because they were not speeding. This is what gets a bad reputation on the E bikes. But it is undeserved, just the way it would be undeserved to tell you your car is not allowed in a 20 mile an hour zone.

According to your philosophy, that would be the case. You see we can all make an argument. How about if we start to enforce speed on bike areas. I’ve been passed many more times by road cyclist than I ever have ebikes. I will grant you that the E bike industry is slapping the name Ebike on anything with a electric motor. This can be addressed. But let’s not throw a blanket over all of them.

Unfortunately, they cannot ban ebikes for disabled people. Electric bikes can be considered an "other power-driven mobility device" under ADA law, and the ADA itself explicitly states disabled individuals can choose , within reason, whatever mobility device they want. The state or county government is prohibited from preventing disabled people from using ebikes as a mobility device. " (a) Denial of participation. A public accommodation shall not subject an individual or class of individuals on the basis of a disability or disabilities of such individual or class, directly, or through contractual, licensing, or other arrangements, to a denial of the opportunity of the individual or class to participate in or benefit from the goods, services, facilities, privileges, advantages, or accommodations of a place of public accommodation."
