In January 2011, Lacy Aaron Schmidt fatally murdered his friend and former girlfriend, Alana Calahan, at her residence.
Lacy Aaron Schmidt was found guilty of felony murder while committing an aggravated assault, malice murder, possessing a firearm during the commission of a crime, and theft by taking a handgun in February 2012.
According to the prosecution, Lacy Aaron Schmidt premeditated the shooting and had stolen the firearm from Alana’s father.
They claim he shot the Harlem Middle School girl in the back of the head as she posted images to Facebook and then carried her body to the woods behind the house to hide the crime.
Aaron Schmidt received a life sentence.
Schmidt filed an appeal with the Georgia Supreme Court.
According to the appeal, Judge Michael Annis had failed to inform the jury.
They may have found him guilty of the less serious crime of involuntary manslaughter.
In addition, Lacy Aaron Schmidt claimed that his defense attorney was incompetent and that the penalty he received was an example of “cruel and unusual punishment.”
But the highest court, as stated by the justice who presides over the case, P. Harris Hines, has rejected every one of his reasons.

Wow! This defense attorney seems like she made no effort for a defense. She couldn't have gotten a psychologist to evaluate his mental health? Nothing?

They aren't using an insanity self defense. There is a good chance they wouldn't have been allowed to do that...

I realize laws have changed since this case in 2011 but I am amazed that they interviewed him for hours and didn't read him his Miranda rights until they were ready to arrest him for the murder. He had very ineffective counsel who claimed a traumatic childhood and mental health but never brought any witnesses to collaborate this.

I'm surprised the defense didn't offer any witnesses to testify about everything they brought up in opening statements regarding his mental state, his past trauma, some kind of triggering event... they really had nothing. Seems like she was relying on the prosecution's witness testimony about Aaron having a bad childhood and anger issues, yet she barely delved into that in cross either.

Yeah, his defense attorney is just trying to get the fux out of there.

I've never seen a defense counsel more ineffective than this. Essentially no defense at all. No cross examination, no objections, no positive defense or testimony... Even the judge himself said that so much irrelevant testimony was allowed in completely unobjected to that he considered jumping in for the fairness of the trial. Check out 54:00. Seems like the defense counsel graduated in the bottom half of the class. Kid was guilty, for sure, but she didn't even try to argue the accidental aspect, or the previous trauma aspect she opened with. If I hadn't seen the interrogation, I'd say he would've been better off representing himself. Yeesh.

I understand and agree that Aaron is guilty. However, I am not convinced that it was proven by evidence on EITHER side that he killed Alana maliciously or accidentally. Which makes a difference when you’re considering cold blooded murder or voluntary manslaughter. The prosecution had nothing, in my opinion, to support malicious intent. And the defense is a disgrace! They should be ashamed of themselves! They didn’t even attempt to defend their client. No mental health evaluations, no witness to testify on his behalf in terms of the past trauma and abuse that I have no doubt impacted him mentally and emotionally. I’m just blown away at this point. Did I just completely miss something here? I am not finished watching but I’m just venting at the moment the defense rested.

I do not think you missed anything. I think the DA is saying he planned the murder because they say he had taken the gun days earlier and he brought it with him that day. He says he got the gun that day at that moment but then they found the case and manual in his home and he wouldn't of had the time to go back home hide that stuff right after kill the her. The defense never gave an explanation for that.

Agreed. He is guilty and deserves punishment but there is absolutely no evidence of premeditation or malice....if anything there's evidence against that like taking his shoes off and knowing Amanda was only gonna be gone for a few minutes. I do not think he should have gotten life without parole. People who have done worse with much more evidence get less. Life without parole with no evidence of those things is pretty crazy to me

I remember this case and this kid was a physchopath and his family was in so much denial. He was plundering the house with Alana’s stolen keys after Mr. Callahan went out of town. It wasn’t one time. It was many times

Did you listen to this whole case? His family was abusive, there was a lot of sexual deviance, incest other disgusting things. His family wasn't even in the picture let alone "in disbelief" I'm not defending his actions but to make a comment like that says you don't really know anything about the case and you're just calling him a psycho from what you've heard people say, not from any real info or evidence that was given in this case and trial

@mandivvy

I heard that too! He said “it was left to right and slightly upwards”! What does that mean???
@kinseyclay

Yeah im confused why that was just passed over as it completely ruins the states story of it

Its crazy to me that the defense in opening statement, states Trauma, abuse and that its was an accident. Where's the proof? How ineffective. Not that I think Lacy Aaron was/is innocent but I'd like to see an arguement or some fight for his life here for my curiosity in all aspects of the courtroom amd law.

Guess you didn't listen to his sisters testimony. Just because the state called her doesn't mean she didn't have any info beneficial to the defense...

I have to say, after watching all the segments, Erin Schmidt’s lawyer was largely ineffective. I realize this case was a steaming pile of crap of a case, however, you still cross, examine witnesses, trying to poke holes in their testimony. Nevertheless, the biggest problem was his interrogation, he let that genie out of the bottle. And apparently his guardian was a fool to let him talk to police without a lawyer present, and that’s on her. You never ever talk to the police without a lawyer present, because they’re not your friends. However, in this case, he couldn’t help himself, however, he’s just a evil kid, and not very intelligent. Here’s hoping his time in prison will be a nightmare for the rest of his miserable life.
