Grateful my husband was a serious guy about dating and courting. we didnt string eachother along and we saved sex for marraige for both of us

I think John doesn’t understand that in some states, you’re legally required to live separately for a year before you can file for divorce. It doesn’t matter how much you want it to be over, unfortunately.

that's if all things being equal and the divorce being uncontested and agreed on by both. If one partner cheats/abuses/acts in an unsavoury way you can get the divorce faster.

I think we've all been there. Hanging on to hope and praying things will change. Ego doesn't want us to lose but we have to accept that loss and put it behind us. Was here 6 months ago. She woke up one day and decided this life wasn't for her. No complaints, just she wanted something different. She ended up being unfaithful and leaving and she cut everyone of our friends off and moved across the country. Thank God we didn't have any kids, but the person I married is dead.

Nobody just wakes up like that. It was brewing within her long before. Not trying to excuse any bad actions on her part, but you missed signs. Try to look back and see what signs you missed so it doesn't happen in future relationships without your knowledge. I'm not trying to blame you in the slightest, but it is something to learn from- even if that learning is finding out she was toxic and you missed the signs.

That's my story that started in July 2020...man does it suck, but there is a happy life on the other side too. Saddest part for me is what the new normal for my daughter is. And there's nothing I can do to change it.

Relationship is good with daughter. I only see her every other weekend. I wasn't gonna drag out a custody battle and spend 10s of thousands of dollars. But we have fun everytime we get together. The Ex and I do not communicate. She ended up married to one of the guys she was having an affair with in less than a year.

In some states you have to be physically separated for a year before you file for divorce. North Carolina is one of them. Separated and living apart.

Hey John, it is true that in many states you legally must be separated for one year before filling a divorce. if there is abuse that can be proven it is different but generally this is the case.

Here in Canada as well. And you have to go to coparenting classes during that time. But you get a legal separation so finances are separate and temporary custody and child support is decided in that.

This man deserves so much better! I am glad he has full custody of the kids because they have a dependable loving selfless parent to count on rather then an emotionally unavailable selfish mother! No! He should not have continued to allow his wife to spend like a child nor tolerated it! He is her husband not her father. Poor guy! I hope he has all the support he needs to heal from this and that his daughters get the support they need to know this was not their fault nor this is how you act as a wife. My heart goes out to this man.

Yes. Many states require paperwork to be filed regarding the onset of legal separation. This period of ‘separation’ provides couples with an opportunity to enter counseling, and possibly reconcile, before finalizing the divorce after a year from the onset of separation.

He is feeling guilty and is struggling with the idea that it's his fault that she left. This is why she asked should I have let her keep spending. The overwhelming guilt that you may have been at fault for something like this that you never wanted to happen or see happen, is huge and it prevents one from making any moves.

In Canada, you have to be separated for a year before you can divorce . In addition, if you live together for more than 6 months you are legally in a common-law relationship, which means you have the same status as a married couple.

The marriage is over. He needs to find a counselor for himself and his daughters. If his ex would be willing to go to post divorce counseling, I think he should investigate that as well. The caller made a comment that concerned me. He said, “I’m not abusive. I don’t abuse her.” From my own personal experiences, that means he has been abusive towards his wife. Abuse comes in many forms. I would be interested to know what his wife experienced during their marriage .

You are eligible to file for divorce, also called an “absolute divorce,” only after being separated for at least a year and a day. This means that you must have been living in different homes and that at least one of you intended that the separation be permanent during that time. To file for a divorce in North Carolina, either you or your spouse must currently live in North Carolina and must have lived in the state for at least six months before the divorce case is filed.

we only just passed new "no fault" divorce laws here in england and wales but before then you had to be separated from your spouse for something like 5 or 6 years before you could file for divorce unless both parties agreed to proceed, absolute insanity.

It sounds like the caller is going the “constructive abandonment” route to end the marriage. I believe in some states a year of this abandonment has to have been stated for these terms to go through.

We don't have all the details. There are always two sides to a story. However my theory on this is a woman gets married to a guy when he is still in decent shape. They have kids. He has to work long hours to support the needs of the family. He may not have the time or has not found the way to make time to stay healthy or in shape. The woman starts to look at other guys who are in shape. She joins a gym which is full of people in good shape. That is when affairs happen. It's sad because it demonstrates just how hypocritical women can be when they talk about men being shallow and yet they have an affair with the new trainer. But will the new gym bro she met be willing to take the baggage (her kids) that come with the package? Is the gym bro willing to commit long term to her? Probably not. Most gym bros don't want that mess. I know first hand. I was one of those gym bros who had an affair with a married chick I met at the gym. But I had no intentions of getting into a long term relationship with her if she left her husband. She had kids and I didn't want that baggage. Just being honest.

@@tritosac Of course she complained about her husband. She wanted to justify her cheating, and hopefully activate your "white-knight" genes to take her on. Women who hops from man to man typically badmouth their exes to make themselves appear as victims of circumstance rather than as unreliable partners. So unless you have direct evidence of this abuse, it night not have happened. That said, I DO appreciate your honesty.

There are parts of the world where you need to be legally separated for a full year before you can file for divorce. But I did not hear that in the US, in Colorado none of that is needed (as an example).

In my country, it's actually the law to be provenly separated for 1 full year. And only then starts the divorce circus. Maybe it's like this in some US states too.

It sucks, but he needs to let her go. If she had left say, last week, he could talk about saving the marriage. But she has been gone a year.

Can I get divorced after less than a year if I prove fault? No. Unlike some other states, North Carolina only allows for no-fault divorce, which requires at least one year of separation.

In Minnesota in 1999, we had to initially file, and then wait separated for 6 months before it could go forward, because we had children. If we had slept together, we would have had to start all over again.

We all feel your pain and have experienced some of the same. Expectations are high in the beginning for both parties and nobody is entirely compatible. Hormones run the show and then reality dawns gradually. The independence of a single existence is not applicable and the lifestyle of other beings have to be considered. Sacrifices have to be made and the feeling of exclusion and being less attractive as time goes on, takes effect. If serious issues are not being thrashed out and all it includes, then the rift apart begins in earnest. My advice is you need a rock of a friend that travels with 24/7. Who is this friend ? His name is Jesus Christ. Make Him your best friend for life, through the highs and lows. "Blessed the man or woman who does not lose faith in me". Pray for and forgive your wife. Let the first person without sin cast the first stone.

@@karenherbert1410 For him it isn't over. They aren't even legally separated. She deserted him by leaving and emotionally deserted him the year prior. He has hope that she will find her way back. We all know she wont but it's hard for him to see her in that negative light. I'm glad he has the kids. My heart goes out to him. I don't understand why some people don't understand him.
