The state of Ohio will never allow Sam to be found innocent. They would have untold financial remuneration. It was never brought out that the coroner was extremely jealous and critical of the Shepard family who were Ostepathic Doctors, they owned their own hospital. He set out to make Sam Shepard the murder no matter what.

The 1950's were a different time. Taking facts on face value & not bothering to dig deep. The police were shoddy. Sam's defense team were shoddy, Sam alas was no "Husband of the Year" which of course hurt him morally. So 50's leap from adulterer to murderer seemed easy. Was the jury made up of 12 white males?

Wow! Thanks for that information tidbit. Never knew that, I have numerous family members who had relocated to the Cleveland, Parma areas back in the mid 40's to late 60's. So I have heard alot from them about this story, but never heard what you posted. Thanks, again!

sometimes I think that all prospective jurors should be required to undergo an IQ test. might not be a bad thing to apply that rule to anybody running for public office, too. lol.

@@charlesstephens5974 The Sheppard family's argument that he was innocent, as presented at the civil trial, was based on the O.J. defense; incompetent police work framed an innocent man. The last Sheppard trial took place just a couple years after the O.J. trial, and they thought they could capitalize on that fact. It didn't work; the Sheppard civil jury passed the I.Q. test.

@@TheMrSuge You did hear the forensic and other evidence presented here, didn't you? You do realize that "capitalizing" on another totally ludicrous trial has nothing to do with the indisputable scientific fact that it was not Sheppard's DNA, don't you? You did understand that there was no evidence to prove Sheppard's guilt but a ton of evidence proving it was not him and pointing at the other guy, and that counted together that evidence surpasses even the slightest possibility of coincidence to any group of even semi intelligent people with basic education, didn't you? It was just explained in great detail that Sheppard's family's claim was based on lots of scientific EVIDENCE, provided by many leading scientists, and not on the botched OJ trial, so why, after seeing all this, would you still claim such an absurd thing?

Back when I was 19, I worked a gift shop on the Ohio Turnpike one night. Dr. Sheppard came in after getting off his motorcycle. He wanted to buy 4 red cut-glass wine glasses for his current wife, Arianne. I joked a little w/him but he never smiled once. Just looked kind of sad to me. I didn't know who he was till the manager told me later.....

@@TheMrSuge You know, it occurred to me that a person could have committed the atrocity during an alcoholic blackout. Not saying he did...just raising the possibility. Rarely hear that discussed anywhere. They said Sheppard had alcoholic tendencies. Never said how much everyone had to drink that night @dinner w friends either.

My heart goes out to this family. The state of Ohio should be ashamed for there ignorance and heartlessness in how they handled the case from the start. I honestly feel like they didn't want to take responsibility for there departments short comings and most likely was concerned of being sewed.

No surprise science should determine guilt.. instead of ppl who claim to be impartial… I don’t trust justice system. In 2021 black men who was sentenced to life spending 40+ years are now released because science prove they are innocent

@Patrick Dolan Even gay men display behaviour like this. Social view are that men can't admit they're wrong without loosing face for it. This is a general gender behaviour that is continually reinforced by social expectations/ views. On how men are supposed to act REGARDLESS of their sexual identity. So claiming that its a 'hertophopic' view point is a just claiming the straight male victim card.

The jury were not to blame they of course are fed information they are not the investigators. If evidence is withheld or not presented that is the role of the judge, prosecution & defense. 1950's straight laced middle class jurors who perhaps had served in WW2 were a different breed. The judge was unethical & should have been recused.

What a sad case families destroyed career ruined and finally death at such a young age poor man .Justice in this case was not served to begin with due to police incompetence and a judge who shouldn’t have been a judge.

I haven't read all 438 comments so excuse me if this has been mentioned before, but the huge weakness in this theory is that if Sheppard grappled with this man losing a T-shirt in the process then surely he would have recognized him as the person he and his wife employed to do odd jobs for them.

He did it. His T-shirt was covered in blood, so he got rid of it. She never screamed, she was knocked out with the first blow on her skull, then he massacred her. They called it ''crime of passion'' because of the unnecessary and excessive amount of energy the perpetrator delivered during the act. It was personal, impulsive and intimate. He later destroyed himself because he couldn't forgive himself for the death of his parents. His second wife ran away once she understood what he was. Doctors covering for one of their own is nothing new. He killed 2 patients but I bet he had another ridiculous explanation for his failures. I could on and on like that.. Americans are very easy to dupe but I don't know why.. 🤷

How exactly did "politics" affect the outcome of this case ? What, if you know, was Sheppard's politics ? The Judge's politics ? The prosecutor's ? Were they of different political parties ? I am curious as to why you believe politics was involved here

There is enough evidence to create reasonable doubt and say that Sheppard was innocent. I believe if he was guilty, he would've gone about his life like nothing happened when he was released, but his devastation was apparent. My heart goes out to his son.

Compare his tragic outcome for example to how Jean Harris reacted, after being found guilty. She knew she was fortunate to have gotten away with murder, and then exploited her situation - using it as a platform to establish herself; this in spite of previously being an unstable drug addict.

Well, in 2000, an Ohio jury looked at that very issue, examined all the evidence (not just the stuff this documentary wanted you to see) and determined that the State of Ohio didn't destroy his life, because in their opinion, he was guilty.

My thoughts exactly. Beyond a reasonable doubt is the question? Sam's defense team were shoddy, did not bring up the handyman, who knew the layout of the house, perhaps knew Sam did not sleep in the marital bed, plus was a lunatic.

Who would have been the father of the baby? I am from the area and remember this well. I always thought Eberling. But convicting a 'playboy' doctor was more exciting if you will. Lots of publicity. Prayers to the son. How awful.

@@yolandawilson6619 Oh, sweetie, did you not watch the documentary ???????? He filed a lawsuit to get awarded damages to compensate him for those very things. Following presentation of all the evidence, the jury determined he was not entitled to any damages. And as a legal matter, Ohio's statute granting damages for wrongful imprisonment allows ONLY the person wrongfully imprisoned to file suit. That would be Dr. Sam AND NO ONE ELSE. That means that legally little Sammy Jr. here has no legal cause of action, since he wasn't the person actually imprisoned. He is owed bupkiss, deary. The middle of the donut. Zippo. The Big Fat Goose Egg.

I think the judge could not face the fact. As he had told journalist Kilgallen before hand. Plus she wrote in her paper that Dr. Shepard was not guilty. She thought the trial a sham.

Virtually no one else who attended the trial found any improprieties. Furthermore, she NEVER told anyone at the time what the judge "allegedly" said to her (and she waited until he died before she went public with it. What does THAT tell you ? It might interest you to know that, in her opinion, Sheppard probably was guilty. Sensational journalist looking for a sensational story angle. And you fell for it.

I believe he is guilty. Not that it matters what I think in any way, shape or form. But many members of this family were affected by this tragedy and only Sam knows for sure what happened and it’s just so frustrating. But the more I look at the evidence the more think he’s guilty. I doubt there was ever an intruder. But again, my opinion doesn’t matter, what matters is that a woman lost her life in the most awful way and only she could tell us how her life ended and who was responsible for it. My heart goes out to her family. RIP Marilyn. People haven’t forgotten about you yet.

Same tbh. People online don’t have all the information that Ken Mains presented and so they like to assume things. Although the detective Mains did say he is not 100% sure he’s guilty and he probably wouldn’t arrest the guy, but it’s more than likely he was the murderer. There are many things that just don’t make sense if someone did actually entered their home and did this to Marilyn.

The fact that they think this doctor wanted to have relations with his wife, got turned down, went to the kitchen and got a knife and then stabbed his wife LEFT HANDED is beyond me.. and what, she waited for him to come back with it so he could kill her properly? He was exonerated (conviction reversed). They chose to try him again and he was found not guilty. The civil suit was lost though. One Court ruled they had not proved he was wrongfully convicted and another said it shouldnt have went to court because Sheppard had already died. Statute of Limitations also played a role.

I remember when this happened. I'm from Louisiana and this was big news. The police seemed to decide that he was guilty immediately. Later I read a book about it and it was said there was a bloodstain on a pillow or sheet that was made by a surgical instrument. How they could come to that conclusion was beyond me.

F. Lee Bailey attacked the surgical instrument issue in the second trial. Got the coroner to admit he was guessing, had no idea what sort of surgical instrument could have been used and had never been able to find such an instrument!!!

I might have misunderstood at the end but would it be possible (and I don't know the answer to this one way or another) that the unidentified blood on the wall maybe came from the baby? She obviously miscarried during the attack and that's where the blood came from? I've never had kids. Does the placenta, umbilical cord or anything of the unborn child have a different blood type?

I don't get why this case is so famous but the exact same thing happened in my hometown of Tustin except the husband was in jail more than 20 years when DNA cleared him, and all he got was like $100,000 in compensation that he quickly lost in stocks. The wife was even pregnant just like in this case, and they had argued earlier.

First of all.. lawyers and scientists need to speak in layman's terms when talking to jurors or anyone frankly, secondly For Shame on the jurors for not asking for clarification or explanation. I wouldn't hand down a quilty verdict if I didn't understand the underlying information.

Richard Ebberling, wearing a bushy toupee in the dark would be difficult to recognize, especially if you're getting beat on your head and face, and being hit from behind in the bedroom. Another thing is we do not know whether Sam ever met Ebberling, and even if he did, it was probably only once or twice because Sam was usually working at the hospital when Eberling worked at the Sheppard home.

BUT, very disappointed to feel it heavily leans towards Eberling being guilty when a cursory quick research suggests that Eberling was right handed and Blood type A. And he was known to lie about committing other crimes. Pity this was overlooked

There is definitely reasonable doubt. The blood on the wall, the injuries sustained by Sam Shepard. If they had DNA back then they could of checked under her fingernails. That guy Eberley was a good suspect. The way Sam Shepard acted after he was set free makes me think he was innocent otherwise he would have just got on with is life. He was suffering.

I agree that he certainly was suffering. However, exactly from what---the ingredients thereof---I don't think can necessarily all be confirmed. I'm wondering if he had alcoholic tendencies before the murder. And, unchecked alcoholism merely progresses, I've observed. I'm not saying it's the only factor and explains everything, but could be one factor.

Has anyone ever seen a jail cell? Of course Dr. Sheppard was suffering. Anyone who is used to the cleanliness of the OR now sees only the jail cell with no end in site, plus when you reach 40, your days of being a neurosurgeon is over. The State of Ohio closed the case with the wrong guy rotting in jail. They didn’t care.

there was a book out about this crime and I read it many years ago. Marilyn wasn't just bludgeoned, her head was flattened from the blows. as we have seen from other family annihilators, husband is a cereal cheater and wife is pregnant (Jeffrey McDonald, Scott Peterson, etc.)
