Twitch banned Herman Li, the lead guitarist for dragon force, for playing his own music. Edit: People keep saying it was for nudity so i did some research, discord/twitter/google search. I couldnt find anything saying for sure why he got banned, so I stand corrected its not 100% DMCA, but nudity as far as I can tell is also speculation. If someone wants to post a screenshot of the man himself saying either way I would appreciate.

Herman Li got murked for playing HIS OWN music. He did get reinstated, but that shows you how free and loose these media companies are with takedowns. I respect this dude but I disagree a lot on what he is saying, twitch should 100% ban people who play music, since 99% of the time the music is the only thing that makes someone streams interesting and that shouldnt be the case. @Leo Rostagni 1st: Muting is not a good punishment because it could only be applyied to the VOD, wich would not hurt the streamer enough since almost no income comes from VODS, there should be a harsh punishments when someone breaks any rules because that makes other people think twice before making the same mistake. 2nd: Then why are streamer so scared of turning off the music background? because thats a huge part of the content, streamers are leeching out of the hardwork of other for their personal gain since they arent being entertaining all by themselfs. 3rd: When a streamer plays a game with copyrighted content he is supporting a game who infringed DMCA, so therefore the game AND THE STREAMER should suffer hardcore punishment.

Twitch in their statement gave like 5 examples of licence free music libraries you can use on your stream without worrying about this. Or you could reach out to an indie artist for a licence/permission. You just want to play popular music off Spotify or not check a game's EULA to see if there's any music you have to mute. If streaming is your job please do it professionally like every other self-employed person does.

Also, if not all music in a game is copyrighted then you're stuck with either constantly stopping the experience to mute and unmute the music when you need to or you mute ALL music, both of which can ruin an experience when it comes to an audience watching someone play a story-driven game. The simple "don't play copyrighted music" is outdated, so it should be updated to allow for things like that as well as many other circumstances like getting a channel banned for streaming while walking with Kanye playing in a cafe he's paying

If you're publishing media on the internet without any understanding of copyright, it's your own fault. Companies abusing DMCA claims against a clearly fair use of work is a serious issue and there needs to be some kind of punishment for it. Also, the cost of fighting copyright claims needs to be reduced significantly. However, just playing music over your stream isn't a fair use, music isn't free to give out to your audience just because you paid for Spotify. Copyright and DMCA apply to protect streamers if other people/companies use their content too. Stop giving streamers a free pass to steal content and advocate for better avenues for streamers to affordably and easily licence music for their streams. That's a win-win for everyone involved.

i work at a cat shelter. there was a particular cat who’d been at the shelter since 2008 because he was so incredibly shy and traumatized from his earlier life. his name was ghindi. most visitors and even some volunteers didn’t know he existed because he’s such a good hider. after working there for nearly two years, i finally gained his trust enough to pet him which he absolutely LOVED but is so reluctant to allow. he was so adorable, rolling around on the floor, rubbing on me, demanding more and more pets. he was even purring! and i got it all on video!! this was prime social media material. however, upon uploading it, i learned my phone’s mic picked up some of a phil collins song playing on a radio in another room. although it was barely audible to the human ear, it prevented me from being able to upload the video anywhere and it got some of the shelter’s social media accounts into some shit. that was probably the best promotion we could have ever possibly gotten of that cat and i just couldn’t do anything with it because of this stupid ancient fucking law. anyway, ghindi died in the shelter earlier this year, never having found a real home. he would’ve had a much better chance had i been able to use that video to show people how sweet he could be.

It’s a RU-vid problem too, jameskii has gotten strikes for no clear reason. One example is when one of his friends played all star on his own guitar. It was 30 seconds and followed every fair use law
they've been doing it since their conception, gamers think EA is bad but copyright holding music companies are about as bad as it gets without literally killing people (like food companies do)
I mean, from the music industry perspective, they are selling licenses for people to have the music in the game, but not public performance licenses. In my opinion, it should be standard for game companies to pay the public performance licenses (which they probably can considering the gaming industry is 6x larger than the music industry)
Charlie, this is not just Twitch. I also recently played both these games, and specifically, Miles Morales got claimed here on RU-vid. The only solution I had was to take down the original video and literally play MY OWN music over those scenes. Fortunately, when I record gameplay, I record my voice separate from the game sound, so this wasn’t completely awful, but the point is the same- RU-vid does this too. The solution is for game companies to STOP putting copyrighted music in their games, which is an awful solution, but due to lobbyists and greed, there will never be DMCA reform.
On RU-vid claim and strike is different. However if music company would get all ad money from video that have claim when music is only 1% of video then it should be different.

Music claims here on this platform have a few different effects, from as simple as a copyright claim, to as severe as an outright takedown which results in a strike. For those of us where RU-vid is our job, these claims hurt our ability to make a living. So if you’re a gaming channel that is consistently getting claims, it’s functionally the same as the Twitch model- you’re being shut down. The two hottest games on the market right now (Spider-Man and Cold War) BOTH have copyrighted music in them, meaning the content you’re making will either earn you no revenue or will be compromised in some fashion.
Imagine a music artist going live on twitch, just to sing their own song and then getting strike for their own song and then going to jail for singing their own song..

As long as you don't stream Utada songs, which aren't actually apart of the story mode outside of the very first song you play, you should be good to go.

tbf RU-vid has never turned a profit. It's been a money sink since day 1 due to the sheer resources required to store all the video. Maybe a migration would be the start of Google's investment paying off?
The other platforms have to catch up to be competitive, and Amazon doesn't give a fuck about twitch. Its not a moneymaker for them directly, all they care about is using it to drive Prime subscriptions. Google at least knows that RU-vid is a moneymaker, or would be if there were enough ads to sell

Music is often a core part of a game's identity, and it's downright pathetic for Twitch to push streamers to censorship of the game they're playing on a platform made for gaming.

I just started streaming on twitch and I normally do art streams so having music is very important to keep people entertained, song request is also very helpful and keeping watchers engaged in a way. I found new songs and artist via song request and stuff. I thought video game music would be ok but I guess not. Geez this fucks up a lot of stuff. Idk what to do. Guess I'll go find some free music and hope it ain't shit. I guess.

T-Pain has been one of the unsung hero's during this whole thing. He has created a lot of royalty free music for people to play without having to worry about takedowns.
I recently had several of my art streams from months ago flagged and muted because of audio claims, but the flagged files either didn't have music (mic only, the section flagged was from my phones generic ring tone), or had royalty free music (a few seconds of the royalty free music was similar with a sing from the 1980's and got flagged). So even if you do mute the music you're not safe.
True, artists should be able to use their own music without any issues, they have all the rights to use it because it belongs to them. I'd freak out if my own music or even my own OC's got me banned from Twitch or RU-vid because of DMCA.
