Watch Crime Stories Season 3 Episode 7 The Elusive Rapist on Bad Day HQ
In the winter of 1968, the prairie city of Saskatoon is ravaged by a string of savage rapes. A few months later, fears are bolstered when a young nurse is found raped and murdered in an alley near her home. Police attention is brought to a young man named David Milgaard - the evidence on him is thin, but the court finds him guilty. After spending nearly 20 years in prison, David continues to plead his innocence. Through the undying faith of his mother, the real killer is slowly discovered to be a man named Larry Fisher.

I feel so sorry for the guy that spent 23 years behind bars for a crime he didn't commit. Thank goodness for a loving mom that wouldn't give up on her son.

Thank Goodness that scientists in England developed DNA testing in the first place, I hate to think where we would be as a society without the ability to tie criminals to their crimes. What an awful tragedy that David was jailed for so long even though he was innocent.

@@sophiamcdaid2030 how are you gonna blame it on them. There were multiple people claiming that he had done it and at that time there wasn't DNA research or whatever. Witnesses were the main evidence at that time

Milgaard was awarded 10 million dollars. The largest compensation package in Canadian criminal history.

Milgard's mom is an amazing person, she never gave up on her son then she helped to put away the right person. The mental strain on all the children who were unknowingly a big part of the investigation, I feel for them as well.

Thank God for DNA testing. Has proved many innocent, and helped find the guilty. Even helped catch the Golden State Killer! I just hope there is a special place in Heaven for those who were unjustly punished for crimes they did not commit. Still, its BETTER that the RIGHT person gets caught in the first place on this mortal relm!

equarg, it is even more reliable than fingerprints. Unfortunately, both the federal government and states are not updating their rules of evidence to be stricter now that we have DNA, and allowing things like eye witness testimony to have equal weight. Prosecutors don't want to make their jobs too challenging.

DNA evidence only showed that he was not the rapist. It did not show he had nothing to do with the murder!! The other evidence seems to point that he was there and had something to do with Gail MIller!

What an extraordinary story. I can't believe they didn't investigate Fischer more, the man wearing the hard hat who took the same bus route. And what an amazing mother who never stopped believing in her son's innocence and pursuing the case to find the real culprit. I've seen other cases where the Canadian police were so thorough and professional, but in this case they really dropped the ball and failed on many fronts. If they had dug up the snow they would have found the knife handle and maybe even her purse.

I adore these episodes. There are certain series that bring memories, intrigue and kind of bring you back in time. I also love the concept of the show. Its so well done. Mr. Milgaard is very lucky , many innocent are jailed experts say 1.5 to 2 % of people in prison are innocent no one should ever brag or react crimes they never committed it cost this man Milgaard 23 years of his life . A man was recently released served 43 years for a crime he did not commit .

Between those who were deliberately railroaded by a corrupt system, there are those who plead to avoid a longer sentence or because they can’t afford a good lawyer and their public prosecutor takes a deal. In the USA, about 17O people have been released from death row thanks to DNA.

When I was a younger lady and worked,and had to walk home alone,being a hairdresser,would tuck into my sleeve,a "tail comb"..( it's a comb that we used at work) and at the other end were the "teeth" of the comb,so I put it upside down with the sharp end in my hand,and the "teeth" inside my sleeve,and I walked home like that,for me a piece of protection is better than nothing

One of the most amazing cases I've ever seen...& about which I knew nothing. An amazing Mother (& team) ,& proof positive that DNA & Penicillin are surely THE greatest scientific achievements of man?! I lived thru a Winter in Winnipeg over 50 years ago ...& will never forget it! I like cold weather but that was something else again. When people here in Sydney tell me...(in mid August, say...) that it's freezing outside.....I laugh in their faces......😜🤪☃️⛄

"Bailing" is an Olympic event in Canada. I was in a Union environment for 15 years and the moment power shows up people would bail. That would NOT happen in Los Angeles, and I have the experience in both countries.

Did Millguard ever receive ANY COMPENSATION FOR SPENDING 23 years of His life in Prison?! He should be given a HEFTY SUM OF MONEY FOR HIS PRISON STAY!!!! People feeling sorry for Milgaard & his mother. He wasted police time for 'SHOCK VALUE' as his mother endearingly calls it. ho ho how hilarious. How much money did his stupidity cost the taxpayer? Yet only his own woes are mentioned about how badly done to he's been. Someone goes into an airport says 'I've got a bomb in my checked in bag' I suppose we should laugh at the shock value. A poor woman lost her life & he wanted to pretend he did it leaving the real perpetrator to attack more us. If you can't do the time don't pretend to do the crime!

Janet Taylor > Millgaard brought this on himself. Sad that his stupidity took 23 years out of his life. And denied true justice to the victim’s family. A hardcore criminal was left on the streets to continue his criminal ways. He was compensated $10 million. And was still young enough to enjoy it. Too bad his mother had so little sympathy for the victim’s family.

What he did came down hard on him. But then he received a huge reward he did not deserve. He was a victim of his own circumstances & sat in prison while the real murderer was out causing more tragedies in society & not being sought due to him. How old does one have to be before you think them responsible? Nobody forced those drugs down his throat!

Wow, I remember this story. That man suffered horribly because of our not so great canadian justice system. His Mom's an angel though, a true hero in my eyes! Hell even I spent a little over 3 months in the Edmonton Remand Center for a crime I didn't commit, that was back in the early '90s. When I went to court in handcuffs the judge let me go because it was pretty clear that I didn't do what I was accused of. I went nearly nuts after I got out I was so freakin mad and I never saw a penny or an apology and I lost a good job and a bunch of friends and my woman cleared out too. Took me a long time to get the folks in my little hometown to realize I was an innocent man but the damage was done and I packed up and left, been back for visits but that's about it.

Some really good comments here. Joyce Milgaard is the kind of mother we should all be blessed with! I briefly met David in 1976 in Sask. Pen. I asked my friend why David was in population (as apposed to protection where rapist usually go). My friend said "He says he didn't do it and refuses to go to protection (protective custody), even though he had a few beatings" While many of us thought he was guilty back then, I began to believe his innocence when he refused to admit to the crime in front of the parole board. If he would have admitted guilt, he could have been freed much soon. I respect that he didn't confess to something he was not guilty of. True David was given a settlement of $10,000,000 but not until 8 years after his release, and how much did the lawyers take of the settlement?? I don't know anyone who would trade 22.5 years of their life (sitting in prison, and having people think you are a rapist/murderer) for $10,000,000.

On May 17, 1999, the governments of Canada and Saskatchewan announced that a settlement had been reached with Milgaard, and that he would be paid $10 million CAD compensation for pain and suffering, lost wages and legal fees.

i feel sorry for guy milgaard.. he spent 23years in prison.. ,,😢😢😢💔 but thanks to the mother who support his son..and never stop believing that his son is innocent 😇

The David Milgaard case will go down in Canadian history and legal history no doubt. A shame what happened to this young man who was innocent of the crime. His mother was a strong determined woman.

It is indeed pure luck that the evidence was preserved, especially after a large portion of it was discarded after an unsuccessful DNA test. As the man said, once the case is closed the evidence is typically destroyed in a few years.

He now lectures law students at universities across the country. ... In 2020 - 50 years after Milgaard's wrongful conviction - the University of Manitoba presented him with an Honorary Doctor of Law degree. He lives in Alberta and works as a community support worker.

That's really good to know. I'm glad he turned his awful & unjust experience into something positive to help other people. I can't imagine what he want through, but to come out of it with the intention of educating & helping other people is really good. Such a strong man to do that. Good on him & i wish him all the best.

I served in US Navy and visited various countries. I enjoyed visiting countries. In order to do that safely I want to know about that countries crime rate and types. I enjoy these stories very much.

I think the police should tell the public when there is a known violent predator on the loose. (statistics show that they are at least 8 serial killers in any given city operating at the same time, just a little something to think about) They don't have to give all the known details that could help the killers escape but just enough to allow the public the choice and knowledge that they need to protect themselves. In this day and age it's best to stay safe, eyes wide open, as a rule. And hats off to the actress who had to lay in the snow with her pants down to play the role of the raped victim. But crime deaths are always a tragedy no matter how you look at it.

I’m sad for David and his family for the years they lost..but glad mom has the means to fight for it. Makes me wonder how many innocents are sitting in jail who does not have mom like her or the money it takes..😔

this documentary is a milestone to the Canadian police incompetence. a person that has the same blood type of the perpetrator, and happened to be around at the same time, is not necessarily the perpetrator. there is no single forensic evidence to tie him to the victim. circumstantial evidence is insufficient. this is a crime of opportunity, grab and overwhelm the victim. it is obvious that the perpetrator had to have physical superiority in body mass. not a skinny young man.

No matter what sum he received, he is completely broken from inside and even out from prison, he still wakes up in the morning with a terrifying heart for a while. It is like repairing a broken porcelain pot; the scars remain forever.

VERY POOR POLICE WORK, when they talk to Lenny Fisher on bus stop he just say day before he took early bus, went to work..Years after girlfriend says he was home...If they follow this simple basic task, he should be suspect..instead of kid when he is high on drugs bragging friends with some story..Canadian police, not professional the mother done better job!!! How they could missed this basic task check his alibi?????

what a great mother & such supportive team!! never gave up!! that's awesome bc it's easy to get discouraged and fed up with the Justice system. I hope he got something like a shit load on money or whatevz for them taking all those years away from him and bc once you go to jail, it changes you. so I can't imagine what it does to a person when you're innocent and spend 23yrs behind bars!!!. I'm just glad the right person is in prison. they got that monster off the streets. I feel for the women who got caught in that psychos clutches! I WISH nothing but good graces from God to all the innocents. this is an extremely sad true story. .god bless u all.

wtf type of solid alibi, saying the Miller had a solid alibi and take only his word for it, his alibi was that he took the earlier bus to work, then his ex wife tell that she saw him the morning of the murder cleaned and taking the day off from work. then how the ff could they miss that big sample of semen. the detectives messed this up big time .

The rapist killer lived just next to the scene crime, his wife knew he was a rapist (he raped her, took the knife) but they sent an innocent young boy in jail because of the wallet ? Why the police did not interrogate all men of the area ?

This is exactly the reason I don't believe in death row or capital punishment. Too many innocent people are put in jail. Thank God for that tip phone call who got the right person arrested.

At that time very difficult to solve this type of case no mobile location no DNA test only finger prints facilities. Poor innocent guy spent his life in jail but i salute to mum who never give up to fight for her innocent son 👏👏👏👏

I wonder if David Milgaard's friends secretly hated him...they were the ones who brought him to this whirlpool of wrongful accusations in the first place...especially the kid who reported him to the police. I hope David (and all of us) can have some valuable lessons, some silver linings, probably even money/compensation, and the most important thing I think: peace in his heart and happiness for the rest of his life, from his horrible experience in life. PS: Screw that piece of shit rapist, I hope he got tortured in jail and later burn in hell.
