Pryor now owns Daybell's house. I really believe it's a slimy tactic to get the DP thrown out or to delay the trial or both.

There is no legal justification for removing the death penalty in this case. The client being unable to pay isn't a valid reason.

Exactly! My aunt passed away January 3rd 2024. She was not afraid and ask us to please not mourn her death but celebrate the eternal life she will have with our Heavenly Father 🙏🏼 She’s no fake like CD

The majority of inmates don’t want to be on death row because the conditions are horrible and they know it can take 10+ years before the day actually arrives. isn’t that ironic they’re worried about horrible conditions I guess they forget what they did to their victims 🤷🏻‍♀️

My issue with this, if I was the judge, is that the lawyer has known for awhile that 1. Daybell is broke and 2. That this is a capital case and he is not qualified. This should have been filed months ago.

I also thought Daybell signed his house over to him… a property to can rent and get income from for forever ! PLUS, he has known this was a death penalty case …he KNEW he wasn’t qualified….but he has NEVER bought in another lawyer to help….EVER AND HE KNEW !! DELAY TACTIC IMO. clearly the money also…..

John Prior knew this 3 years ago. He has been warned over and over. The State has a handful of Death Penalty Attorney's, with BK Trial, they may not have enough Attorney's at this time. I feel this is a wal of delaying the Trial. My heart goes out to the family's!!!!

Prior has been saying "I don't have enough time" from the beginning. He 's the reason Dumbell's trial hasn't taken place. Why has he been complaining this whole time but then never does anything proactive about it? Whose responsibility is it to see that they have enough help? He certainly found the time to spend every day at Lori Vallow's trial.

Prior has known since the beginning of this case that the death penalty was possible. He's had years to get certified and/or find another certified lawyer to take over the case or help him. He's known that Daybell only had his house to pay the lawyer and signed it over to Prior. The judge removed Lori's first lawyer since he wasn't certified. So why hasn't he done the same for Chad? Also there are very few certified lawyers in that state. Lori's lawyer's would have to get her permission to be able to take Chad as a client. But personally Prior knows he's going to lose this case and doesn't want it on his record. He knows from watching Lori's trial what all the evidence is and he knows Chad is guilty.

Lori's first lawyer was removed because of conflict of interest. He represented both Chad and Lori in the past. He still thinks it was a conspiracy against him.

Criminal attorneys don't keep win/loss records. It seriously sounds to me like he's panicking because he couldn't get that 2nd attorney. That leaves problems with having an indigent client, more than just "it sucks for me.". You can't hire more paralegals, investigators, or attorneys. You can't contract out any work.

What I don't understand is that if John Pryor is not death penalty certified, why did he a) take the case in the first place and/or b) how did it get to 3 months before trial for it to come up the he's not certified when Idaho has put Daybell on notice from the beginning that they were seeking the death penalty?

I believe this is John Prior’s way of attempting to force the Judge’s hand to remove the death penalty. Either let him withdraw from this case since he is not a DP certified lawyer & then extend the case even longer waiting for 2 Capital lawyers catch up on the case. Or remove the death penalty and he will continue with the case free of charge… I think this is really a shame!

@@indicolite3355 As far as I understood, the jail he is in now is way nicer than any prison he will go after the trial, death row or not. Don't get me wrong, I am usually a BIG fan of the "Innocent til proven guilty-thing", "proven guilty" being (to me) convicted in court. But the kids bodies where on his property, how they where "buried" especially what they did with Tylee's remains.. that is not possible doing all that on his property without him knowing and when his wife was killed, he was present. So I guess we can agree that he is not an innocent man. I don't know enough about the system in the US but are there even cards left to play ? I would guess that you need a really good argument to get the DP from the table. He was arrested after they found the kid's bodies, his wife was exhumed to discover she was killed. So in other words: he never cooperated, never helped get the truth together. So, to get a chance of throwing the DP out of the options, he would have to tell them something they don't already know and proof? Confessing that the death of Charles Vallow was a planned set up, testifying against Lori in that trial (which could have her end up on death row?) Or if they had something to do with Alex Cox's death.. confessing to that good enough to make a case? But what kind of substance would come out of the words from a man who literally does not have anything left to loose? One more reason why I don't like the DP. It is far too normal, that people in Chad's situation would do or say anything that might keep them from death row. To save his life, he might even confess to a conspiracy to murder Alex, even if Alex did die from natural causes (or something self inflicted). As far as I understood the DP was off the table in Lori's trial because the prosecution did not turn over everything they had in time for the defense to build a defense against everything. So: When Chad decided that he did not want a speedy trial. Was there ever any chance that the DP would be dropped in his case?

I think Prior has turned this case into a 3 ring circus. The victims families have suffered enough. Shame on him this is tactical where did he think Chad was going to get more money to pay him. He knew all these issues years ago. TACTICS !!!!!

At one point John prior claimed he was ready to go to trial the Fall of 2022 and disagreed with the states motion to push the trial out into 2023. So how was he ready then but not now? If this were truly just a money thing then why wouldn’t he withdraw a year ago when Chad was deemed indigent?

@@skygodess87in many ways it would be better not to give him the DP. It’s a quick easy out and he believes he’s going to a better place. The problem with DP is the constant appeals which drag the family,it’s through the courts constantly. The only advantage I can see to DP is if they are kept in solitary. That’s where I believe he should be with or without the DP.

In his closing argument Lori Daybell’s lawyer said something like - we did our job we got the death penalty off the table. I feel like this is the same thing - they will consider it a victory if he goes to jail for the rest of his life and not the death penalty. As an aside, the hypocrisy of people who think they are gods and have lived many lives being afraid of the DP in this life…

I can’t imagine that house being worth more than $150K TOPS in that area of Idaho. A private death penalty defense can run upwards of $400K with all the transcript fees, expert witnesses, trial strategists, independent testing of evidence, etc. And that’s not even including the penalty phase where the lawyer has to hire an entirely different person to investigate the person’s _whole_ life and interview almost everyone that person ever knew, to see if there are any mitigating circumstances. I’ve wondered how John Prior has been doing it all by himself this whole time. If you talk to any criminal defense attorney who has handled a high profile case like this they will all tell you it’s a total practice killer. You don’t have the time to take on any new clients so you don’t have any supplemental money coming in. I do wonder why Prior didn’t think about this _four years ago_ when he knew Chad only had his house to put up, but it does sound like he did go looking for a second chair but that person couldn’t get death penalty qualified for some reason. I think Mr Prior just bit off a little more than he could chew.

Would they even offer him a deal? I don't know enough about the justice system in the US, but aren't deals offered if the prosecution is not sure that they will get a conviction or if they want information they can only get out of the defendant? With the children's bodies on his property and him being present when Tammy was murdered.. I don't think that the prosecution has to "fear" that he might not be convicted in a trial?

They would offer a deal to save the families the heartbreak of going through another trial, or to take away his right to appeal the conviction, since he would have to admit that he did the crimes. Lots of reasons.

While I understand an attorney can’t work for free, I feel he knew the money well would eventually dry up and she should have notified the court ahead of time. This feels so last minute and unnecessary delay. Be shouldn’t be allowed to withdraw now but I also know if he is convicted Day ell will use it as a reason for appeal.

Hey. Did you know that John Preyer now owns Chad Daybell’s home? That was payment. Simone said that they are playing the court into get an unapproved (but soon to be approved) defense attorney approved sooner so that Daybell can have multiple attorneys on his case.

CD signed over his house to Prior, and I'm sure gave him whatever money was left from Tammy's life insurance policy, so it seems a little strange to me that now all of a sudden money is an issue. And Chad waived his right to DP qualified counsel when he wanted Prior to stay on the case. He knew full well what that meant. Prior has been doing whatever he can to delay this case and try to get the DP off the table and now he's out of options. He got the case severed, he got it delayed for the DNA testing that magically he decided he wasn't actually going to test after he was able to get the cases severed. I don't think for one second that this isn't just another way to delay and try to get the DP off the table. If money is such an issue then why would he stay on the case is DP is off the table? He is making a mockery of the court and spitting in the victims faces. All my opinion though.

But that was all after Tammy's death was confirmed as a homicide with Chad as a suspect or even charged with her murder already. Wouldn't the insurance company demand (and get) back every dime from that insurance that is still in Chad's name? Or would his kids get that money? If they did I guess they would be free to use it to pay Chad's lawyer.

@fraukie1598 that is one of his charges, insurance fraud. I'm sure part of the penalty will be him having to pay the money back, but if he's sitting on death row, they won't really be able to collect anything. The insurance company can't just be like give us our money back, they have to press charges for fraud, so any of the money he had left went to Prior and I'm sure he gave his kids some of it too. Unless he lied and told them he didn't get much. 🤷‍♀️

Chad was probably broke and couldn't pay for further testing. In any case he is entitled to two death penalty qualified public defenders if he has no means to pay for his own defense.

Total ploy. Prior has owned Chad’s house for years and has been paid rent by one of Chad’s adult children. He knew that Chad was broke when he took his case but probably banked on ultimately cashing in on the publicity and fame. This 11th hour “he can’t pay me anymore” is complete BS. He is either trying to get the DP off the table and/or is trying to bide Chad some extra time.

I wonder if his attorney originally stayed because he thought he'd win the motion to remove the death penalty but when the judge gave his final ruling and said the death penalty stays he realized that he wouldn't be able to be appointed because he's not qualified as a death penalty attorney so he had no choice in filing the motion to withdraw as Chad Daybell's attorney. This might be a tactic on their part to force the issue of removing the death penalty so that he doesn't have to withdraw as Chad's attorney therefore not creating another delay.

Can they do that? If it's a private attorney, he doesn't have to be desth penalty certified, but if the state keeps him on , i think he has to be death penalty certified, at least to be lead. He might be able to be co counsel.

He's known from the start it would probably be a death penalty case. He chose to go it alone. Only recently did he try to get another lawyer. He wanted all the funds for himself. That is no reason to let him off the case, UNLESS he's willing to give back ALL the funds he's been given so far so it can be used in daybell's case. This is just a game to delay the trial further.

As far as the money issue goes, i absolutely agree they deserve to be paid for their work. However, Prior has known from the beginning Chad was broke thats why he agreed to take the house as payment. It would be different if Chad had money before then it ran out but Chad Daybell has been broke his entire life and everyone knew it. This is a last ditch effort to get the death penalty removed after all other attempts have failed.

This lawyer knew CD was a man of limited means… he’s taken every penny the man had plus his property and his children are paying him rent….so this crook decides he’s Done???? Because the rule is (at least in ID) that if your attorney is a public defender they have to be Death penalty qualified, but if you hire your own private attorney you can use whoever you want. Look at Lori’s old lawyer Mark Means. He was a family attorney and mediator! Never defended a criminal case in his whole career. But they still let her have him until it because glaringly obvious that he wasn’t up for the job. Then she got two death penalty qualified public defenders.

Prior knew all of this years ago. I think he stayed on this case for the notoriety just like Casey Anthony’s attorney Bias did. Daybell is absolutely guilty and should be held accountable. I think Prior also realized this was a case he could not win. He was at Lori Vallows case every single day and has filed many filings and never once brought up any of this. His case has been pushed back multiple times for multiple reasons I don’t think it’s right now that we were only 3 months away from opening statements and he pulls out now. He should be forced to stay and represent Daybell period.

He knew this the entire time from at best the end of January 2023. Why not request for state funds then? Why would Judge Boyce allow this? That’s absurd. He was arguing solo for cameras in the courtroom and the death penalty to be removed as recently as November 2023. He should be disbarred, he throws temper tantrums about even getting a hard drive that costs $80. It’s so hard to take him seriously. I hear you that lawyers need to be paid; John prior knew his client’s finances- he has the deed to the defendant’s home. He was arguing about this case up through December of 2023.

Seems like Prior has always asked for continuances and he has always known what the case was from being at Lori's trial everyday. Something doesn't smell right with this motion. I know you wish to give him benefit of the doubt, but the timing is sure an issue.

Why can an attorney take a death penalty case if not qualified to begin with? How well is an attorney going to represent a case if he isn’t making enough money to do his job? This sounds like an appeal issue to me.

The lawyer knew this was a death penalty case from the get go. Then should of asked for speedy trial like lori did and they took the death penalty off theboard. Loris lawyers seemed more with it.

I think it's in both the defendant's and court's best interests to approve the request. Continuing on with a single entirely overworked lawyer, regardless of payment status, increases both the chance of an inadequate defense and further continuances (aka delays).

In cases like this where the charges are so serious, I think it would be beneficial to have a way for the state to take over paying the fees at the state-agreed on rate, and add a qualified attorney, to reduce delays as much as possible. Or find some compromise that won’t prejudice either side too much.

Interesting how Scott Reisch pointed out that Prior wanted it sealed. And the Judge said no way! Prior to wanting to save his reputation is what I think. He did not get the death penalty off the table as he tried before so, he is trying this.. He is throwing the Judge and Prosecution in a tailspin. I think Prior is shifty and thinks he is smarter than anyone else. And I agree with Scott saying the Judge should really sanction him for this move as he has pulled this at the last hours because he did not get his way.

Agree with everything except the Judge can't in good conscience sanction any attorney for aggressively representing his client and ensure he gets AT LEAST at the bare minimum the statutory minimum guarantee of effective assistance of counsel (adequate representation) at trial when the State is seeking the death penalty. This judge is not in a position to deny this motion if the State persists in keeping the death penalty on the table. It's plain and simple a last minute squeeze play trying to force the State to take death off the table before this motion is argued. It's also clear that this judge will never let this happen on another case. He (Judge Boyce) made the mistake when he didn't disqualify Prior, if indeed that was possible under the law in this case.

Prior from day one obtained Daybe’s house and property where the children of his clients new wife were buried and his other wife died. What’s his plan ? I felt that a huge conflict as well.

Love your show, and I have tried many others that got to a frenzied show within minutes. There's no way I could see you beating your wife or kids, or bringing your own mental health issues into your show. You've not unhinged and if I were to ever need an attorney it would be you. Thank you. I have a generator for the 'just in case' scenario plus an alternative heat source. I was ridiculed for getting a generator. My response was, "You have insurance on your vehicles and house and how many times over the years have you filed an insurance claim? You pay a premium every month or year for 30+ years. I made a one time investment which can always be re-sold unlike insurance premiums." Any idea who will come to my house if the power goes out. LOL @@gamingcounselor

@thelawyeryouknow Hi Peter! Could this possibly be a tactic for Mr Prior to get more time? He is saying even if worked 24/7 for 4 month he would not be ready for trial. If the Judge were to appoint new counsel, this trial would not likely start until 2025. Wouldn't the Judge and State prefer to give Mr. Prior more time than to appoint new Counsel as new Counselor would ultimately require even more time?? Is it possible the State could appoint Mr. Prior as a public defender and pay his fees for Chad??

I work construction and if money stops the work stops unless it’s someone elderly or vulnerable and it’s reasonable to complete the job. Don’t think a lawyer should be asked to continue because they will deffo not bring their a game and effort if there’s zero incentive

I feel like this was on that line. Maybe they initially were waiting and hoping they would drop the death penalty and waiting and waiting, but I do agree that lawyers should get paid for the work they do. I also think that they should have been looking for a dearth penalty certified lawyer months ago. I thought I heard somewhere that there is 5 or something in Idaho, two were Lori’s and two are currently working the university of Idaho students for Bryan Kohlburger, so that leaves 1. I’m not sure how the law works, but it would be convenient of Lori’s took over Chads case since they know a lot of the evidence etc, but it could also be a conflict of interest. Definitely tricky.

If the money is gone, how are they going to pay expert witnesses that will be needed? It is suicide not to have any, so is having only one lawyer for your defense. One atty going up against a team of 5 is crazy. This should have been a recognizable issue from the beginning. Either CD was in denial or this is to try to get the DP taken off the table.

There are 13 public defenders that are death penalty certified to be lead counsel in Idaho. Chad’s case is in 7th district of Idaho and the two lawyers for Lori Vallow can’t be his lawyer and there was another lawyer that was removed from Lori Vallow ‘s case and they can’t be Chad’s lawyer either. But there are some lawyers in the 6th district that may could be his lawyers. Anne Taylor and Jay Logsdon are assigned to the northern Idaho area.

I agree Peter. I also wonder if getting the death penalty overturned could have been a reason for the lawyer to take the case. He was given money of some sort. I think, however, it was short sighted going forward knowing the chances of the death penalty being stayed....

The lawyer should get paid, no matter what. If the client doesn't pay the lawyer the lawyer should be able to withdraw.
