An S-Corp is also a pass-through entity. LLC's are much more personally dangerous than a corporation. Piercing the Veil of an LLC (your private property is liable) is rather simple for a middle-grade attorney. ALWAYS form a corporation (same cost as an LLC) and then elect a Chapter-S with the IRS. Your tax liabilities are no different than an LLC, yet your personal protection, ability to raise capital, contract procurement, and interest rates are FAR superior!

Dot Should have restrooms available for the trucks they pull in. With out restrooms they are harassing truck drivers. The states should be sued for not having them.

I don't know why people are celebrating, this will be horrible on trucking. If the states start to regulate trucking it will cost a whole lot more. Also from several lawyers I watched and read articles from stated that it is not retro active. So the courts will only look at future cases after SCOTUS decision.

Hopefully they do something about the 10hr mandatory rest period. All drivers don't need 10 hours to sleep, let alone 6. Drivers can be more productive and efficient with more drive time. It’s my belief that most if not all branches of government are illegal and over reaching in their power to mandate laws and enforce them. For example the United States Coast Guard first was created to protect the water boundaries of the United States. Since their inception they have been moved inland and are the federal agency that police’s the inland waterways. This branch of government has been moved all over the place as to what department of government they should be in or connected too. In 1970’s they were mandated by Congress to do some type of cleanup of all the towboat operators (actual men piloting these vessels) we were unlicensed because there were no laws mandating that diesel power vessels be inspected and have licensed personnel operating these vessels. There were a few steam powered vessels operating up to the end of the 60’s then they were totally fazed out because of licensed requirements for steam powered vessels. Ever since this has come about there been nothing but more and more requirements added to this movement. When I retired from the industry you were required as a minimum to have and operators license that you were tested for by the USCG, radar endorsement, a DOT physical, drug screening along with random drug testing and DOT security card and now required to go to a similar school. Which all these things cost you money. Which without one of these requirements you couldn’t stand a navigational watch on the inland waterways of the United States. Now in 1970 when I started piloting there wasn’t any requirements! By 1971 you were given a multiple choice test of twenty questions on rules of navigation and given a color blindness check which meant you know red from green. And you signed a form stating that you would not willfully pollute the waterways. Well guess who came up with the form for the pollution you guessed it the EPA! The whole thing of the government telling everyone how they are going to operate their business and who they can hire and why they can’t fire someone is totally out of control! The very idea of illegals being able drive commercial vehicles on the roads of the United States just doesn’t even seem legal to me. I hold a CDL class A license took all the test didn’t go to a driving school. Now my understanding is you have to go to school to get a CDL period. You can’t obtain this license on your own. And our government doesn’t have a corrupt politician one in it! It’s totally out of hand! People driving commercial vehicles in our country that can’t speak English! On some kind of work permit! What’s next?

I love my 20 minute power naps. Longer than 20 minutes and I wake up groggy. I’m up at midnight to 1am and I try to be asleep my 5:30 pm. Life happens, someone calls, there’s some household chaos that needs addressed like a broken water line….. 💩 happens. 23+ years as a commercial driver has conditioned me to function on limited sleep and a Power Nap or two if it gets to hard. And yes, I know where my limit is, and I’ve never gone too far. I become miserable when I get that tired. I honestly don’t know how anyone can fall asleep at the wheel. And any company giving me 💩 about stopping for 20 minutes came blow me. Clean driving record with lots of experience…. I have options. If the dot wants me out, I’m sure Pablo would love my job. It is what it is. But I see more accidents now than ever… maybe we need more rules?
Get rid of the EDL's. A professional trucker was not born with a big switch on their chest. They are also professional enough to know when their body is ready to wake up and when it is ready to go to sleep. Sometimes the professional truck drivers sleep is not as deep and long as they would want it to be, but they are also professional enough to know that at those times they need to stop for a 1/2 hour or so nap, so that they are 100% fully aware when they are behind the wheel driving these semi trucks.

You should check the produce market up here in PA, NJ and NY. The most of the fully legal carriers have been force to move to other types of freight or even close down because we have a couple of mexican-owned companies that have taken over. Drivers with no cdl’s, trucks that are copies (running multiple trucks with the same titles, registration and plates) and even running fully with no type of insurance.
